Justification for Other than Full and Open Competition (Brand Name)

1) Identification of the agency and the requesting activity Chinle Comprehensive Health Care Facility is performing an IT equipment refresh of existing computers in the Chinle hospital facility.

2) Nature and/or description of the action being approved.

The purchase of Dell branded computers to replace existing Dell equipment.

3) A description of the supplies or services required to meet the agency's needs (including the estimated value).

CCHCF will be replacing 125 desktops currently in use in the facility. The cost estimate for this purchase is approximately $203,000.00.

4) Statutory authority permitting other than full and open competition. List of exceptions for DHHS acquisition:

X (a) Only one responsible source and no other supplies or services will satisfy requirements.

(b) The agency's need is such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources solicited.

(c) A Federal statue authorizes or requires acquisition through certain sources (e.g. Federal Prison Industries, Qualified Nonprofit Agencies for the Blind or Severely Disabled, Small Business Act, Section 8(a) non-competitive, HUBZone non-competitive)

5) A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.

The CCHCF is replacing existing Dell computers with the same platform but a newer model. The management interface for the Dell computers is a big concern, this interface allows us to pull information from Dell computers individually and update their configurations down to the BIOS level. In addition we have created numerous custom programming scripts for the Dell computers to automate the installation, modification and polling of the installed Dell platforms. Switching to other than Dell will involve modification to automated processes in place now and installing and learning a secondary set of management tools. This would affect overall IT department productivity and reporting for the service unit to Navajo area office for our location. The support structure for the Dell computer systems is also very efficient; IT technicians are able to lookup computer system warranties very easily and obtain Dell next day support in a timely manner. Support is only two hours away if the request is urgent. Finally, the Dell web site is much easier to navigate and locate the information we require on drivers, updates, warranty and support.

6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a GPE notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

7) A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

8) A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

Due to item 5 above only one brand of equipment was researched.

9) Any other facts supporting the use of other than full and open competition, such as:

i) Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available.

10) A listing of the sources (if any) that expressed in writing, an interest in the acquisition.

Source used is available via the internet at www.dell.com.

11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Note: Federal Acquisition Regulation states "Contracting without providing for full and open competition shall not be justified on the basis of a lack of advance planning by the requiring activity or concerns related to the amount of funds available (e.g., funds will expire) to the agency or activity for the acquisition of supplies or services."
