1. Contracting Activity
The Naval Sea Systems Command (NAVSEA), Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 0221.
2. Description of the Action Being Approved
This Justification and approval (J&A) authorizes the award of a Firm-Fixed-Price, contract on a sole source basis, for the procurement of Commercial Cloud Services and associated engineering in support of NAVSEA to CSRA LLC. The Government’s minimum needs have been verified by the certifying Technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirement as implemented by Federal Acquisition Regulation (FAR) 8.405- 6(a)(1)(i)(B). The procedures in FAR subpart 13.5 will be utilized for this procurement in accordance with 41 U.S.C 1901.
5. Rationale Justifying Use of Cited Statutory Authority
On 7 December 2020, Department of the Navy (DON), the Assistant Secretary of the Navy (Research, Development, & Acquisition) and the Department of the Navy Chief Information Officer issued a Joint Memorandum regarding the Department of the Navy Cloud Policy. This policy requires cloud computing services to be procured from a cloud service provider approved by Program Executive Office (PEO) Digital and granted a Department of Defense (DoD) Provisional Authorization at the information impact level appropriate to the requirement. All contracts with vendors currently approved are managed in the DON’s Naval Digital Marketplace.
Blanket Purchase Agreement (BPA) Number N0003918A0003 was issued to CSRA LLC in September of 2018 by Commander, Space and Naval Warfare Systems Command, now NAVWAR through PEO Digital. The BPA was competed at the time of award, and was awarded on a Lowest Price Technically Acceptable basis. This BPA is currently the only contract approved by PEO Digital for the required services.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
A sources sought notice expressing the Government’s intent to sole source to CSRA LLC was posted on sam.gov on 09 July 2021 and closed on 12 July 2021. No responses from industry were received. Market research was conducted to determine if any other contract available within the DON’s Naval Digital Marketplace was able to meet the Government’s minimum requirements, but no other contracts were found. For the reasons described above, no additional market research was conducted as no other company can provide the required services.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated costs to the Government for the items covered by this J&A will be fair and reasonable. Significant (or similar) quantities of this requirement have been purchased from the offeror in the past and cost/pricing information was received on those past procurements. This information should be sufficient to support the fair and reasonable cost determination of this procurement.
8. Actions to Remove Barriers to Competition
For the reasons set forth on Paragraph 5, NAVSEA, Corona Division, Contracts Department, Code 02 has no plans at this time to compete future contracts for the types of items covered by this document. If another potential source emerges, Code 02 will assess whether competition for future requirement is feasible.
