4. Statutory Authority Permitting Other Than Full and Open
Competition
10 U.S.C. 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirement as implemented by Federal Acquisition Regulation (FAR) 8.405- 6(a)(1)(i)(B).
This acquisition is conducted under the authority of the MAS Program. The primary statutory authority for the MAS program is 41 U.S.C. 152 (3).
5. Rationale Justifying Use of Cited Statutory Authority
On 7 December 2020, Department of the Navy (DON), the Assistant Secretary of the Navy (Research, Development, & Acquisition)and the Department of the Navy Chief Information Officer issued a Joint Memorandum regarding the Department of the Navy Cloud Policy. This policy requires cloud computing services to be procured from a cloud service provider approved by Program Executive Office (PEO) Digital and granted a Department of Defense (DoD) Provisional Authorization at the information-impact level appropriate to the requirement. All contracts with vendors currently approved are managed in the DON’s Naval Digital Marketplace.
Blanket Purchase Agreement (BPA) Number N0003918A0003 was issued to CSRA LLC in September of 2018 by Commander, Space and Naval
Warfare Systems Command, now NAVWAR through PEO Digital. The BPA was competed at the time of award, and was awarded on a Lowest Price Technically Acceptable basis. This BPA is currently the only contract approved by PEO Digital for the required services.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
A sources sought notice expressing the Government’s intent to sole source to CSRA LLC. was posted on beta.sam.gov on 8 March 2021 and closed on 12 March 2021. No responses from industry were received. Market Research was conducted to determine if any other contract available within the DON’s Naval Digital Marketplace was able to meet the Government’s minimum requirements, but no other contracts were found. For the reasons described above, no additional market research was conducted as no other company can provide the required services.
7. Determination of Fair and Reasonable Costs
Similar quantities of this requirement have been purchased from this offeror in the past and pricing information is available on those past procurements. This information should be sufficient to support the fair and reasonable price determination of this procurement.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, the Department of the Navy has no plans at this time to compete future contracts for the types of services covered by this document. If another potential source emerges, Corona Division will assess whether competition for future requirements is feasible.
