About this file

This is an Award Decision and Determination of Responsibility memorandum from the U.S. Department of Justice Federal Bureau of Prisons at FCI Leavenworth, Kansas, dated March 4, 2026, concerning a Fiscal Year 26, Quarter 3 subsistence requirement under RFQ #15B40826Q00000007.

The acquisition is set-aside for small business concerns under NAICS 311999 with a small business size standard of 700 employees. All vendors were verified as small businesses in accordance with SAM.gov requirements. The Government announced its intent to make multiple awards based on pricing per line item, with price evaluation as the primary factor after past performance received "Go" ratings on a go/no-go basis. Past performance assessment focused on timeliness of deliveries and order accuracy/completeness, with evaluation of CPARS data and communications from other Contracting Officers. All vendors achieved "Go" ratings and demonstrated satisfactory performance records with no recent Termination for Cause actions. The evaluation determined all vendors met responsibility criteria under FAR 9.104-1, including adequate financial resources, ability to meet the 30-day ARO delivery schedule, and necessary organization and technical skills for this one-time food delivery order.

Awards were made to 16 separate vendors based on lowest pricing per line item across 61 line items of subsistence products, including commodities such as beans, grains, pasta, produce, meat, poultry, dairy, and frozen items. Total award values ranged from $86.00 for lentil beans to $30,360.00 for ground beef 80% lean. Five line items (Dairy Milk, Hot Dog Buns, Hamburger Buns, Sliced Bread, and Eggs) received no quotes and were not awarded.

Purchase Order #: VARIOUS/SEE FILE

Set Aside:

As stated in the Request for Quote, this acquisition is set-aside for small business concerns. The NAICS for this requirement is 311999 with a small business size of 700 employees.

ALL VENDORS were verified to be a small business in accordance with NAICS 311999, small business size of 700 employees. See file for www.SAM.gov verification prior to award.

Evaluation Factors:

• 52.212-2, Evaluation-Commercial Products and Commercial Services The Government anticipates and intends to make MULTIPLE awards based on pricing per line item.

Awards will be made to the responsible Quoter(s) whose quote conforms to the requirements and is determined to provide the best value to the Government, considering the evaluation factors outlined below.

(1) Price – The Government will evaluate the Quoter’s proposed price to ensure it is fair and reasonable.

(2) Past Performance – Go/No-Go Evaluation - The Government will evaluate the Quoter’s past performance on a Go/No-Go basis. The assessment will be based on the following criteria:

• Timeliness of Deliveries: The offeror must demonstrate a consistent record of on-time deliveries. Documented instances of late deliveries, including Contractor Performance Assessment Reporting System (CPARS) evaluations and communications with other Contracting Officers, will be reviewed. A history of substantial delivery delays will result in a “No-Go” determination.

http://www.sam.gov/

• Order Accuracy and Completeness: The offeror must show a track record of delivering complete and accurate orders. Evidence of recurring issues such as missing or incorrect items – supported by customer complaints, returns, or input from other Contracting Officers – will be considered. A pattern of incomplete or inaccurate deliveries will result in a “No-Go” determination.

Only offerors receiving “Go” rating under this factor will be considered eligible for award.

Past Performance:

ALL VENDORS must also have a good past performance with no recent Termination for Causes. See file for www.SAM.gov responsibilities and determinations.

Therefore, all vendors have received a “Go” rating and will be eligible for any awards.
