STATEMENT OF WORK (SOW)

FOR

EXPLOSIVE WASTE DISPOSAL SERVICE

For Base Elizabeth City

1. Scope of Work: The Contractor shall provide all personnel, equipment, tools, materials, supervision, other items and services necessary to accomplish the following tasks:

1.2 Provide for Contractor services to be performed (within 14 Days) upon award of this contract.

2. Notifications:

2.1 Contractor shall present to the Contracting Officer and the Government Representative valid Environmental Protection Agency identification numbers for both the transporters and the disposal facilities designated to transport and receive wastes generated prior to the commencement of the contract.

3. Personnel: Contractor personnel shall present a neat appearance and conduct themselves professionally and competently at all times on this installation.

3.1 Employment Validation: The Contracting Officer may restrict the employment of any Contractor employee, or prospective employee, and may direct the Contractor to remove any employee from the installation if such action is deemed in the best interest of the Government.

3.2 Contractor personnel shall be trained on Occupational Safety and Health Administration, Environmental Protection Agency and Department of Transportation requirements, as applicable to respective job positions, and certified, where necessary.

4. Hours of operation: The Contractor shall coordinate with the Government Representative designated at the time of award regarding scheduling of service.

5. Transportation of Hazardous Waste materials:

5.1 Transporting waste from the site shall be accomplished in a manner preventing materials from becoming spilled.

5.2 The Contractor shall ensure that transport of any explosive waste is done in accordance with Department of Transportation Code of Federal Regulations Title 49, Subchapters A and C.

6. Vehicles: All Contractor vehicles shall have the company name clearly displayed on both sides of the vehicle and be maintained to present a clean and neat appearance. The Contracting Officer may direct the removal of any objectionable vehicle from the installation.

6.1 Licensing and Proof of Insurance: The Contractor shall provide to the Contracting Officer and Government Representative all proper licensing and insurance paperwork. The Contractor shall also maintain these documents in the vehicle intended for use at all times.

6.2 Driver Requirements: Contractor personnel driving onto the installation shall present a valid driver’s license to the Base Security Office prior to admittance to the installation.

6.3 Vehicle Requirements: The Contractor shall request, obtain and properly use vehicle passes for all vehicles used in the performance of this contract.

7. Reports

7.1 The Contractor shall provide to the Government Representative a waste manifest(s) prior to removal of waste from facility. Contractor’s waste transporter shall obtain the signature of the Government Representative on the manifest prior to removal of waste from the facility. The waste manifest(s) shall meet the requirements set forth in applicable DOT and EPA regulations.

7.2 Upon receipt of the waste at the disposal facility, Contractor shall ensure that Government Representative receives a Return Copy of the waste manifest(s).

8. Security Requirements: The Contractor shall comply with all security requirements. The Contractor shall be responsible for security of his service areas in cooperation with the Base Security Office.

8.1 Access to the Installation: Contract personnel must present to the Base Security Office (front gate) a photo identification prior to entry onto the installation.

8.2 Access Denial: The Base Commander reserves the right to deny entry to any person upon disclosure of information that indicates the individual’s continued entry is not in the best interest of the Coast Guard. Additionally, the violation of, or derivation from established security procedures by the Contractor’s employees may result in the denial of future entry to the base. The Government is in no way responsible for the removal or denial of access procedures.

8.3 Security Costs: All costs incurred by the Contractor associated with security requirements, including routine entry/exit delays due to contingencies or exercises, are to be anticipated by the Contractor and shall be included as part of the contract.

9. Environmental Considerations: The Contractor shall comply with all applicable federal, state and local environmental laws. The Coast Guard has the right to visit the Contractor’s installation and/or disposal facility.

9.1 The Contractor shall provide to the Contracting Officer and the Government Representative a complete summary of all activities, products and services that will be used for the performance of this contract, prior to commencement of services. Summary shall include detailed descriptions of all activities, products and services proposed, Contractor and sub-Contractor information (names, addresses, phone numbers, points of contact and EPA identification numbers).

10. Clean Up: The Contractor is responsible for leaving areas as they were found. The Contractor shall clean up any spillage that was caused by the Contractor and provide records to the Contracting Officer and the Government Representative on the proper handling, transport and final disposition of spent clean up materials. The Contractor shall ensure all cleanup is complete prior to leaving the site.

11. Liability Insurance: The Contractor shall provide to the CO and the Government Representative proof of General Liability insurance and Pollution Legal Liability insurance for both the Contractor and any sub-Contractors prior to the commencement of services.

12. Hazardous Waste Removal Services: The removal, transport and disposal of waste shall be in accordance with the following:

12.1 Department of Transportation Code of Federal Regulations, Title 49, Sub-chapter C, Parts 171 through 178;

12.2 Environmental Protection Agency Code of Federal Regulations, Title 40, Sub-chapter I, Parts 260 through 302

13. Time of Delivery: Services are required no later than 14 days after the award of this contract, at a time mutually agreed upon by the Contractor and the Government Representative.

14. Place of Performance: Services performed hereunder by the Contractor shall be performed at the United States Coast Guard Base, Building 97 Elizabeth City, North Carolina.
