VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C250-23-AP-2466
1. Contracting Activity: Department of Veterans Affairs, NCO 10, Battle Creek VA Medical Center, Battle Creek, MI. 2237: 515-23-2-569-0032
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The Battle Creek VA Medical Center in Battle Creek, MI has a requirement for a replacement excavator (and accessories) for their their Groundskeeping section. The estimated value of the proposed action is:
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The service is requesting the Bobcat E-50, manufactured by Clark Equipment Company (a wholly owned subsidiary of The Doosan Group). The Bobcat E-50 standard features include a redesigned Bobcat engine, an improved cooling system to enhance performance, serviceability and component life; low-effort joysticks that respond easily to operator input; hydraulic control for better metering, finite movement and controllability on level grading; and fast cycle times.
The Groundskeeping section of BCVAMC currently utilizes an earlier version of the Bobcat E-50 and has multiple attachments already in inventory. Also, groundskeeping personnel are already familiar with the Bobcat product line and how to perform routine maintenance when required. The current Bobcat excavator utilized by BCVAMC is continually undergoing repairs and the lengthened downtimes cause required tasks to be delayed.
4. Description of market research conducted and results or statement why it was not conducted: Queried VetCert database using NAICS 333924 and 91 concerns were found. Searched both the DSBS and VetBiz websites (NAICS code and keywords “excavator”) and two concerns were found with each search.
There are no mandatory SAC/NAC contractual vehicles for this procurement. CS could find no FSS/GSA contracts as well. Item cannot be found on GSA Advantage. Using market research from a prior Bobcat requirement (less than 12 months old), four companies/distributors were identified who could possibly meet the requirement:
The VA Rule of Two cannot be met due to NMR. The SBA Rule of Two can be met. Recommend small business set-aside and Brand Name Only RFQ be posted on SAM.gov.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
