ERDC Control No. 21-2155

SOLE SOURCE JUSTIFICATION

1. Agency/Contracting Activity: Engineer Research and Development Center – Construction and Engineering Research Laboratory (EDRC – CERL)

2. Description of Action:

Nature: New Requirement Follow-On Requirement Mod to Existing Purchase Order/Contract Number

Pricing: Firm-Fixed Price Time and Materials

Funds: OMA Other Funds: 97 x 0400

3. Description of Supplies/Services:

a. The total estimated dollar value of the proposed action is $45,920

b. We require the analysis of the engineering performance and cost data generated by the ongoing ESTCP project entitled Energy Neutral Wastewater Treatment with a Hybrid Microbial Fuel Cell and Biofiltration Approach. The analysis should address scalability of the technology by projecting data from the ongoing pilot scale demonstration to assess design scales of interest to the military, including decentralized systems (5,000-20,000 gpd) and centralized systems (1-10 MGD). Recommendations on the most cost-effective implementation of the technology shall be provided, based on detailed life cycle cost analysis.

4. Authority: FAR 13.106-1(b) (1): For purchases not exceeding the simplified acquisition threshold

(SAT), contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency, exclusive licensing agreements, brand name, or industrial mobilization.)

5. Reason for Authority Cited: This sole source service contract is needed as a follow-on to an ESTCP research demonstration study at Tobyhanna Army Depot, PA that was led by ERDC with previously contracted support CDM Federal Programs Corporation. CDM is the only engineering firm that can perform the required follow-on analysis work due to their unique knowledge of the materials and design of the microbial fuel cell system that was demonstrated. The analysis needed pertains to this specific system. Other potential sources for these services were considered and are described in the market research section below, but only CDM can provide these services in a manner that will meet the government requirement.

Actions to Increase Competition: A notice of intent to sole source was posted to beta.SAM.gov from February 2, 2021 through February 17, 2021 and no s were received.

Market Research:

(1) Market research included an extensive web search for companies that can potentially provide engineering and cost analysis services for microbial fuel cells for wastewater treatment, including Suez, Evoqua, CH2M, and Jacobs Engineering. Microbial fuel cells are not widely used or known for wastewater treatment, as it is an embryonic technology. A few companies have research studies or engineers with microbial fuel cell experience. However, they do not have experience with the system to be assessed or access to the information required to assess it. The system to be assessed is unique to an ongoing project and was designed and assembled by CDM Federal Programs Corporation. The system contains proprietary or trade secret components and materials, and it is not possible for another company to assess the associated costs for designing, fabricating, and producing these unique components.

(2) The market research was completed by Martin Page in November 2020.

8. Procurement History:

Previous Purchase Orders(s) or Contract(s): Yes No

Purchase order or contract number: W9132T17C0002_(BAA Service Contract) Was action competed? Yes No (The BAA is considered a competitive mechanism IAW FAR Part 6.102(d)(2) If action was not competed, state the cited authority, summarize rationale:

9. Additional information to support the justification: This work was initially planned under a previous contract (option), but due to necessary changes in scope for the option period, a new contract to CDM is required.

10. Technical/Requirements Certification: I certify that the supporting data under my cognizance which is included in the abbreviated J&A is accurate and complete to the best of my knowledge and belief.

11. Fair and Reasonable Price Determination: As Contracting Officer, I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. Basis for the determination: price analysis techniques.

12. Contracting Officer’s Approval:

I hereby certify that this Justification is accurate and complete to the best of my knowledge and belief. Based on the foregoing, I approve this sole source justification subject to availability of funds, and provided that the services and supplies herein described have otherwise been authorized for acquisition
