COMPETITION

10 USC 2304(c) (1), as implemented by FAR 6.302-l, Only one responsible source and no other type of supplies or services will satisfy agency requirements.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS

OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY

CITED ABOVE

In Accordance With (IAW) FAR 6-302-1 (a)(2)(ii), the flight engineer display unit falls under the highly specialized category. The flight engineer display unit is highly specialized for the fact, unacceptable schedule delay of one day in fulfilling the agency’s need will result in the Air Force not meeting the UH-1N Special Operation Forces (SOF)/Search and Rescue Personnel Recovery mission, support of the Air Force Presidential mission and support of missile site surveillance, nuclear convoy protection and Special Operations Forces and Personnel Recovery missions which could result in the loss of aircraft and the lives of personnel.

Avalex Technologies Corporation is the only firm capable of providing the supplies described in Section III above. This effort affects Air Force Presidential support, missile site surveillance, nuclear convoy protection and Special Operations Forces and Personnel Recovery missions which could result in the loss of aircraft and the lives of personnel. The Government’s needs cannot be met by any other source other than Avalex Technologies Corporation in order to maintain Operational Safety, Suitability and Effectiveness (OSS&E) and configuration control.

The drawings, maintenance manuals and acceptance test procedures are proprietary to Avalex Technologies Corporation. Data or the data rights to use the data needed to manufacture these parts are not owned by the Government and it has been determined that it is not available for purchase.

On 29 Aug 2016, the 411 SCMS/GULAB, asked Avalex if they are willing to sell their data and data rights to the Government. On 10 November 2016, Avalex responded that they are not willing to sell their data to the Government.

The Government would not be able to provide the Flight Engineer Display for reverse engineering. The Flight Engineer Display has to meet FAA compliance. Therefore, not just any contractor has or can receive permission to make these assets.

Unacceptable schedule delay of one day in fulfilling the agency’s need will result in the Air Force not meeting the UH-1N Special Operation Forces (SOF)/Search and Rescue Personnel Recovery mission. The UH-1N is a utility helicopter used by the Air Force for missile site surveillance, nuclear convoy protection and Special Operation Forces (SOF)/Search and Rescue Personnel Recovery missions, which could result in the loss of aircraft and the lives of personnel.

These components are qualified and installed on the UH-1N helicopters. The current item designs have successfully operated on the aircraft and there is no known obsolescence or diminishing manufacturing issues to be resolved. Additionally, there are no new technologies that provide affordable best value alternates to the current designs.

Air Force Gobal Strike Command (AFGSC) received congressional authorization to pursue the immediate replacement of approximately 41 each UH-1N aircraft. AFGSC is pursuing the purchase of the Army’s HH-60M version which is currently in production. AFGSC estimates within 4 to 5 years, HH-60Ms will be replacing UH-1Ns. The Agency estimates that this is not a 1 for 1 replacement; therefore, future UH-1N flight engineer display shortages will be subject to Reclamation Efforts prior to the Agency seeking any future buy action.

The UH-1N is a utility helicopter that is used by the Air Force for missile site surveillance, nuclear convoy protection search and rescue missions and supports the Presidential mission.
