Due to the circumstances described herein, the activity requests authority to acquire the spares listed in this document using Other Than Full and Open Competition as prescribed by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. This action will result in the award of a new contract, which will be a firm-fixed price, ID/IQ contract with a basic year plus four ordering periods in which additional quantities may be ordered. This sole source requirement will be purchased from the following company:

Crane Electronics, Inc 84 Hill Ave NW Fort Walton Beach, FL 32548-3858 CAGE Code: 09062 Large Business

III.DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

This requirement is for spares purchase of the AN/ALQ-131 Electronic Countermeasures (ECM) pod High Voltage Traveling Wave Tube (TWT) Band 4/5 Dual Mode Power Supply. The pod detects unfriendly radar signals, and determines and employs an effective countermeasure to prevent mission degradation. The operational environment for this pod is extremely rugged and includes excessive wind buffeting, engine and acoustic noise vibrations, mechanical shock, and fuel & hydraulic fluid contamination. This item is a critical element of the pod. The main components and subcomponents are powered directly or indirectly by this power supply. This power supply is designed to meet the requirement for a stable precision operation despite the rugged environment.

The AMC for this item is 3B: Buy from Actual Manufacturer for the data package identifies that this item is source control per DOD-STD-100. Therefore, the purchase must be from the approved source only. The Government does not own the required data or data rights are not in government possession and, and it is uneconomical to acquire them by purchase or to reverse engineer the item.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE

OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED ABOVE

The only qualified source is Crane Electronics, Inc (formerly known as Signal Technology (Keltec). There is no test data, qualification data, support manuals, or related data that defines the performance and manufacturing characteristics of the ALQ-131 high voltage TWT Band 4/5 dual mode power supply (Part Number:

585R944H04, NSN: 6130-01-565-7448). The item drawings were created by Crane Electronics, Inc.

The high voltage TWT band 4/5 dual mode power supply is a critical element for the ALQ-131 pod. This power supply is responsible for providing power to the main components and subcomponents of the pod.

Previous version of drawing 585R944H03 was produced under NSN 6130-01-361-0655EW. The previous NSN was designed and built by Crane Electronics, Inc. Low Mean Time Between Failure (MTBF) and parts obsolescence drove a modernization effort. Crane Electronics, Inc developed a modernized power supply.

Crane Electronics is the only company with the data and expertise to build the current drawing 585R944H04.

Based on the last effort by the ALQ-184 engineering office (a similar system), if we had the existing data from the contractor, it would take approximately five years for another contractor to design an equivalent power supply, though it would be a high risk effort from a technical standpoint. The five years does not include how long it would take to get funding (3 year cycle) or the production time (1-2 years) if the development was successful.

AMC code of 3B was assigned to this item for drawings was labeled sourced controlled and can only be procured from approved source only. It also indicates that the Government does not either own sufficient technical data or the rights to use the data. Therefore, acquisition of this part from only the approved source with existing unique design capability, engineering skills, and manufacturing knowledge is required. The Government had recently contacted Crane Electronics by email, and they still refuse to sell the data to the Government. See email attachment dated on 25 Jun 2014.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

This requirement will be synopsized in Federal Business Opportunities (Fed Biz Ops) web page as required by FAR 5.201, citing conditions which preclude full and open competition. There are no known additional actions that can be taken to facilitate competition for this acquisition due to the fact that the Government only has source approved data.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO

THE GOVERNMENT WILL BE FAIR AND REASONABLE

The overall cost of this acquisition will be fair and reasonable to the Government. In accordance with FAR 15.403-4, the contractor will be required to provide a firm, fixed price proposal with certified cost and pricing data to be used in supporting the Government’s evaluation of the proposed cost. The proposed skill mix of labor, labor hours, types and quantities of material, other direct costs, and direct and indirect rates will be negotiated by the Government based on recommendations from Defense Contract Management Agency (DCMA) for appropriate field pricing assistance and expert technical personnel supporting the program. The contract price will be negotiated in accordance with the procedures in FAR Part 15 ensuring the ultimate cost to the Government is fair and reasonable.

VIII: DESCRIPTION OF THE MARKET RESEARCH CONDUCTEDAND THE RESULTS, OR A

STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED

Market Research was conducted on 17 July 2014 as outlined by FAR 10.002 using the following methods:

reviewing industry reports, trends and product developments; discussions with industry representatives; internet searches; and industry knowledge possessed by EA Pods Engineering Staff. It has been determined that no commercial equivalents exist which could fit our needs. Some of the sites used were:

http://www.ustechnologies.com/products/power_supplies.cfm http://www.compusolinc.com/power supplies.html http://www.pioneermag.com/mil.html http://www.naii.com/lgtk.asp

Each one of these vendors’ web-based product lines was reviewed to determine if the NSN under consideration was being produced by that vendor or if that vendor had information concerning associate contractor agreements with Crane Electronics, Inc to share or acquire Crane Electronics, Inc’s proprietary data for the specific NSN under consideration. None of the vendors provided or exhibited evidence of manufacture of the specific NSN under consideration. Manufacture of this complex device is an exclusive sole-source activity.

IX. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION

Crane Electronics, Inc completed design and development of the high voltage TWT Band 4/5 dual mode power supply. Crane Electronics, Inc currently maintains the engineering expertise, technicians, proprietary processes, and specialized equipment to continue with timely builds needed to support mission critical end items. Because the Government does not have the drawings needed to build these items, another source would have to reverse engineer the internal components of power supply to learn how to rebuild it. Moreover, the internal components of the power supply contain specialized technology that is not common in the defense market.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION

See Section VI above.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR

OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT

ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

As indicated above, the results of the study/analysis indicates it is not cost effective to attempt to qualify new sources on these particular items under the cited conditions. Individual situations/items will continue to be reviewed to ensure the acquisition meets the stated criteria.
