IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”. In accordance with FAR 6.304(a)(2) the approval level for this J&A is the competition advocate.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS OR
NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED
ABOVE (APPLICABILITY OF AUTHORITY
This Flight Safety Critical Part has been designated a high reliability part under a formal reliability program. The cognizant engineering activity has determined that data to define and control reliability limits cannot be obtained nor is it possible to draft adequate specifications for this purpose.
This item is considered highly specialized component of a major weapon system. This part contains critical characteristics whose failure, malfunction or absence could cause a catastrophic failure resulting in loss or serious damage to the aircraft or cause engine shutdown resulting in an unsafe condition for personnel and the surrounding environment. Accordingly, Pratt & Whitney is the only source that has specifically and uniquely designed and manufactured this part for use by the military. Pratt & Whitney has met and exceeded the standards specified for quality and reliability from past productions of this item.
IAW the J&A for the previous acquisition of this item, the contracting officer discussed the acquisition of the data/data rights and approval of additional sources with the Intellectual Property office at Pratt & Whitney on 16 Oct 2017. The contractor maintained that the data and rights to this item will remain with Pratt & Whitney and that there were no plans to qualify new sources.
The development of an additional source to produce this item would cause unacceptable delays in the repair of TF33 engines and the availability of aircrafts supported by the TF33 engine. It is imperative that these parts are readily available to ensure that the requirements of the Air Force are met. Accordingly, Pratt & Whitney is the only responsible source capable of providing the items described in Section III above.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED
FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
In accordance with FAR 5.201, this requirement shall be synopsized and the request for proposal will be posted on the Federal Business Opportunities website. Qualification requirements do not apply.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED
COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE
The contracting officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The contractor will be required to provide certified cost or pricing data. A detailed cost analysis and price analysis will be accomplished. The Defense Contract Management Agency may be contacted to assist with the analysis.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS,
OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT
CONDUCTED
Market research, in accordance with FAR Part 10 was conducted by a multi-functional team. This research included inquiries into internet sites including Haystack, Parts Manufacturer Approvals, Google, Thomas Register, and similar item manufacturer’s websites and was completed on 18 August 2017. Other sources manufacture similar items but none have been identified as having access to the data described in Section V necessary to meet the requirement described in section III. As a Critical Safety Item, failure of this item during engine operation can result in loss or substantial to the weapon system, or death or serious injury to personnel. This is a non-developmental item and substitutes are not available.
A Sources Sought Synopsis was also conducted during the market research effort described above to notify Pratt & Whitney licensees, vendors, or other sources with access to the necessary data of the pending acquisition. This posting was created on the Federal Business Opportunities website
11 August 2017 under the NSN and PR number with a response date of 18 August 2017 and no responses were received.
Based on the above, a high level of confidence exists that Pratt & Whitney is currently the only responsible source able to fulfill the requirement.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION
This item has been designated a Flight Safety Critical Item. Because the risk associated with reverse engineering (i.e., potential damage to engine or aircraft should this item fail during engine operations) outweighs any potential gain or cost savings, the Government considers this item too critical to make reverse engineering feasible.
X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION
United Technologies Corporation CAGE: 52661 Pratt & Whitney Military Engines Division 400 Main St East Hartford CT 06108 860-565-5173
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING
SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED
The AFLCMC/LPSEA engineering group will continue to monitor the marketplace for source development. The Government will continue to synopsize the requirement.
XII. CONTRACTING OFFICER’S CERTIFICATION
By signing the coordination and approval document, the contracting officer determines this document to be accurate and complete to the best of the contracting officer’s knowledge and belief.
XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION
As evidenced by their signatures on the coordination and approval document, the technical or requirements personnel certify that any included, supporting data within their area of responsibility are both accurate and complete.
