accordance with FAR 6.304(a)(1) the approval level for this J&A is the contracting officer.
DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS
OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE
AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)
Safran Power USA, as the designer and actual manufacturer of the item described in section III, is the only known source that has the necessary detailed manufacturing and process data (i.e. production level data) needed to produce this part. Though the Government has limited form, fit, and function (FFF) data, this data is not sufficient to manufacture the item described in section III without an additional design engineering effort. The data required to competitively procure this item, without additional design engineering effort, from additional sources is production level data as specified in MIL- STD-31000. The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data.
This item is a critical application item, as defined in the Aviation Critical Safety Item Management Handbook, on the F-15A/D Generator; as such it is a highly specialized component of a major weapon system. Development of additional sources to produce this part is not feasible within allowable timeframes. Delays in procurement have the potential of disrupting the availability of F-15A/D aircraft, thereby leaving the Air Force unable to meet critical mission requirements and hampering the Air Force’s ability to execute its global mission.
Drawing 31169-1380 is not available in Air Force files. An attempt has been made to acquire the necessary data for competitive acquisition of this item. A letter dated 21 Nov 2014 from Safran Power USA, LLC, CAGE 3CPE0, states data/data rights will not be provided to the Government.
Accordingly, Safran Power USA is the only source capable of providing the requirement described in section III.
DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED
PRACTICABLE
In accordance with FAR 5.201, this requirement shall be synopsized and the Request for Proposal will be posted to the Federal Business Opportunities website. Government defined pre-award qualifications of new sources cannot be identified due to the unavailability of the necessary technical data as described in section V. Safran Power USA, the Original Equipment Manufacturer (OEM) is the only entity capable of approving additional sources at this time. For this reason, qualification requirements do not apply.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE
The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The Contractor may be required to provide certified cost or pricing data. A detailed cost analysis and price analysis may be accomplished. The Defense Contract Management Agency may be contacted to assist with the analysis.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH
WAS NOT CONDUCTED
Market research, in accordance with FAR 10, was conducted by a multi-functional team consisting of the Item Manager, Equipment Specialist, Logistics Officer, and Engineer.
This research included inquiries into internet sites including Google, the Thomas Register, Haystack, and similar item manufacturer’s websites and was conducted over a period ending 12-Feb-18. Other sources manufacture similar items but none have been identified as having access to the data described in section V necessary to meet the requirement described in section III. Further, this requirement cannot be modified nor be satisfied with a commercial or modified commercial item.
A Sources Sought Synopsis was also conducted during the market research effort described above to notify Safran licensees, vendors, or other sources with access to the necessary data of the pending acquisition. This posting was created on the Federal Business Opportunities website under the PR number with a response date of 14-Feb- 2018. No responses were received.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION
The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. Current new source developments for other items on the F- 15A/D weapon systems being undertaken are due to high parts obsolescence, limited supply shortages, and the vendors inability to manufacture. In addition, qualification and reverse engineering of a new source for the F-15A/D Generator Rotor would not only yield a new Generator configuration for the F-15A/D models, it would require extensive compatibility testing and potential re-engineering of the F-15A/D Power Generator System, which would also yield a new aircraft configuration. In conclusion, the Government does not consider this item a candidate for reverse engineering in accordance with DFAR PGI 217 Part 3-303 screening procedures.
