JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING

PROCESSED

This individual Justification and Approval (J&A) authorizes the use of other than full and open competition procedures to obtain a new, firm fixed price, sole source, C-type contract. The contemplated contract will be with Woodward FST Inc. (Woodward), Commercial and Government Entity (CAGE) 65065, for the procurement of fuel injection nozzle to support the F100 engine. This procurement is for the Air Force (AF). This J&A is to support the rationale that only one responsible source exist and no other supplies will satisfy agency requirements.

III. DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET

AGENCY NEEDS

AMC/AMSC: 3B

Item description and function: 5.8 in. long X 2.8 in. wide X 1.8 in. high, weighing 0.80 lb. and composed of nickel alloy. This item delivers a regulated fuel spray to the combustion chamber.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL

AND OPEN COMPETITION

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(1), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”. IAW with FAR 6.304(a)(2) the approval level for this J&A is the competition advocate.

V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE

QUALIFICATIONS OR NATURE OF THE ACQUISITION

REQUIRES THE USE OF THE AUTHORITY CITED ABOVE

(APPLICABILITY OF AUTHORITY)

Drawing 4084843 from the Original Equipment Manufacturer (OEM) for this item, the United Technologies Corporation, CAGE code 77445, is a source control drawing as defined by the current version of DoD-STD-100. Suitable manufacturing and technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part nor use of a second source part in the intended application. Woodward is the only source listed on the source control drawing, and is thus the only known source that can satisfy the Government’s requirement.

Woodward FST Inc. is the only source listed on the screening analysis worksheet as an approved source for this item. Due to part integrity and quality issues, the Government has approved no additional sources for this item. The development of this item by an additional source would result in unacceptable delays in fulfilling the Air Force’s requirements. Delays in new procurement have the potential of leaving the Air Force unable to meet critical mission requirements. Woodward possesses unique capabilities derived from knowledge and expertise gained during previous production of this item thru the sole source contract SPRTA1-15-C-0112.

The 421 SCMS believes that award to any other source would result in unacceptable delays in fulfilling the Air Force’s requirement. Any other source would have to perform an Initial Production Evaluation (IPE) before being considered fully qualified. The IPE will require lab destructive and non-destructive testing to be performed and the process could exceed 5 months (15 weeks for remanufacture, 2-3 weeks for lab testing, and 2-3 weeks for cognizant engineer to evaluate lab results and document qualification results). Once IPE is complete, the new qualified source must accomplish Non-Recurring Engineering, acquire tooling necessary to manufacture the F100-PW-220 Unstaged Fuel Nozzle Assembly and pass the first article test to be approved. This process takes approximately 12-14 months.

Accordingly, Woodward is the only firm capable of providing the supplies described in Section III above without the U.S. Air Force experiencing unacceptable delays in fulfilling its requirements.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS

ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS

PRACTICABLE

In accordance with FAR 5.201, this requirement shall be synopsized and the request for proposal posted to the Federal Business Opportunities (FBO) website. Qualification requirements do not apply as only the OEM approves additional sources.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR

AND REASONABLE

The contracting officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. A detailed price analysis will be accomplished. The Defense Contract Management Agency (DCMA) may be contacted to assist with the price analysis if necessary and will assist with inputs throughout the life of the contract. Information other than certified cost or pricing data may be obtained and cost analysis performed if appropriate. Should the proposal exceed $750K, certified cost and pricing data will be obtained and a cost and price analysis will be performed.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND

THE RESULTS, OR A STATEMENT OF THE REASONS MARKET

RESEARCH WAS NOT CONDUCTED

Market research, in accordance with Far Part 10, was completed on 21 July 2016 by inquiries of Parts Manufacturer Approvals, HAYSTACK, and web search of Google and the Thomas Register. This research revealed that there is not a commercial item available to meet this requirement. The item described in Section III is used in military applications and no commercial or non-developmental substitutes are available.

A Sources Sought Synopsis was also conducted during the Market Research effort described above to notify United Technologies Corp licensees, vendors, or other sources with access to the necessary data of the pending acquisition. This posting was created on the FedBizOps website on 11 July 2016 under PR FD2030-17-00040 with a response date of 18 July 2016. No interested sources requested consideration.

Based on the above, a high level of confidence exists that Woodward FST is currently the only responsible source able to fulfill the requirements.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN

FULL AND OPEN COMPETITION

Since this item is source controlled neither qualification testing of another part or use of a second source part in the intended application is permitted, reverse engineering is not feasible.

In an effort to identify and remove barriers to competition, AFLCMC/LPSEA will continue to monitor the marketplace for source development.
