JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

I. CONTRACTING ACTIVITY

II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This individual Justification and Approval (J&A) authorizes the use of other than full and open competition procedures to obtain a new, firm fixed price, sole source contract.

The contemplated contract will be with Marthonnorco Aerospace, Incorporated (Norco), Commercial and Government Entity (CAGE) code 08844, for procurement of mechanical actuators to support the KC-135 aircraft.

III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE

AGENCY'S NEEDS

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(2), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”. IAW FAR 6.304(a)(1) the approval level for this J&A is the contracting officer.

V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE

QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE

USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF

AUTHORITY)

Boeing, as the Original Equipment Manufacturer (OEM), has qualified only the sources listed on the source control drawing 458-50009. The technical data contained within the source control drawing is insufficient to qualify additional sources. Currently, the only approved source is Norco. Though the Government has limited form, fit, and function (FFF) data through the source control drawing, this data is not sufficient to manufacture the item described in section III without an additional design engineering data. The data required to competitively procure this item, without additional design engineering data, from additional sources is production level data as specified in MIL-STD-31000. The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part.

This item is a critical application item, as defined in the Aviation Critical Safety Item Management Handbook, on the KC-135; as such it is a highly specialized component of a major weapon system. Development of additional sources to produce this part is not feasible within allowable timeframes. Delays in procurement have the potential of disrupting the availability of KC-135 aircraft, thereby leaving the Air Force unable to meet critical mission requirements and hampering the Air Force’s ability to execute its global mission.

Accordingly, Norco is the only source capable of providing the supplies described in section III.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED

PRACTICABLE

In accordance with FAR 5.201, this requirement shall be synopsized and the Request for Proposal will be posted to the Federal Business Opportunities website. Government defined pre-award qualifications of new sources cannot be identified due to the unavailability of the necessary technical data as described in section V. The Original Equipment Manufacturer (OEM) is the only entity capable of approving additional sources at this time.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE

The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The Contractor may be required to provide other than certified cost or pricing data. A detailed cost analysis and price analysis will be accomplished. The Defense Contract Management Agency may be contacted to assist with the price analysis.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH

WAS NOT CONDUCTED

Market research, in accordance with FAR 10, was conducted by a multi-functional team consisting of the Item Manager, Equipment Specialist, Logistics Officer, and Engineer.

This research included inquiries into internet sites including Google, the Thomas Register, Haystack, and similar item manufacturer’s websites and was conducted over a period ending 10 Sep 15. Other sources manufacture similar items but none have been identified as having access to the data described in section V necessary to meet the requirement described in section III. Further, this requirement cannot be modified nor be satisfied with a commercial or modified commercial item.

A Sources Sought Synopsis was also conducted during the market research effort described above to notify Norco licensees, vendors, or other sources with access to the necessary data of the pending acquisition. This posting was created on the Federal Business Opportunities website under the PR number and closed 19 Aug 15. No vendors indicated interest in the acquisition.

Based on this market research, Norco was found to be the only source able to fulfill the requirement described in section III.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

Reverse engineering of this part will not be considered as the FAR definition for this AFMSC states the use of a second source part is not approved in the intended application. Only vendors listed on the specified source control drawing will be considered. Vendors wishing to become qualified for this part must be approved by the OEM and be listed on the source control drawing.

REQUIRED

The 423 SCMS/GUEA will continue to monitor the marketplace for potential sources.

The Government will continue to synopsize requirements for potential sources and periodically screen the item for changes in data and source availability.

XII. CONTRACTING OFFICER'S CERTIFICATION

By signing the coordination and approval document, the Contracting Officer determines this document is to be accurate and complete to the best of the Contracting Officer’s knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL'S CERTIFICATION

As evidenced by their signatures on the coordination and approval document, the requirements and technical personnel certify that any included supporting data within their area of responsibility is both accurate and complete.
