V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE

QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE

USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF

AUTHORITY

The rights to use the data needed to purchase this part from additional sources is not owned by the Government and cannot be purchased, developed, or otherwise obtained.

Due to the proprietary nature of this data, the Government does not have the rights to the data nor own the data. The Government does not have appropriate use rights to permit the Government to provide copies of the data. Only manufactures who possess full and complete data and the rights to use that data can be considered as potential sources for this shroud segment. Drawings 489054 has limited rights in the Joint Engineering Data Management Information and Control System as of 14 Apr 15. The judge advocate general has determined that the Government will not pursue the release of the limited rights data furnished under contract NOW-62-0773-1. Currently, Pratt & Whitney is the only known source for this item.

This item is a highly specialized component of an engine assigned to a major weapon system; it’s required for directing airflow through the TF33 turbine module. Accordingly, the contractor listed possesses unique capabilities derived from knowledge and expertise gained during previous productions of this item.

The development of this item by an additional source would expend substantial Government funds for start-up equipment, training, and allocation of facilities. At this time, it is not economically feasible for the Government to fund a new source development; therefore, Pratt & Whitney is the only source capable of providing supplies described in paragraph III without the Government experiencing substantial duplication of cost that could not be expected to be recovered through competition, and unaccepted delays in fulfilling agency requirements. At this time there are currently no Source Approval Requests (SARs) in process for this item.

A new SAR would take two to six years to process and complete, resulting in delays which the Government would find unacceptable. Delays in new procurement have the potential of negatively impacting availability of the TF3 engine, hampering the Air Force’s ability to meet critical mission requirements.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED

PRACTICABLE

In accordance with FAR 5.201, this requirement shall be synopsized and the request for proposal posted in Federal Business Opportunities (FedBizOpps) website.

The Government does not have Qualification requirements (QR) as only the OEM approvals additional sources.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE

The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The contractor may be required to provide certified cost and pricing data. A detailed cost analysis and price analysis may be accomplished. The Defense Contract Management Agency (DCMA) may be contacted to assist with the analysis.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH

WAS NOT CONDUCTED

In accordance with FAR 10.001 (a) (2), market research was conducted on 10 April 2015 by inquiries of Haystack, Parts Manufacturer Approvals, Google, and Thomas Register.

This research has revealed that there is no commercial item available to meet this requirement. Further, this requirement cannot be modified and be satisfied with a commercial or a modified commercial item, due to it being a non-developmental item.

It was found during market research that other companies that perform similar efforts due exist in the market place but they do not possess the applicable data required to meet the Government’s specifications. This is a non-developmental item.

Based on the above there is a high level of confidence that exist they are the only responsible source able to fulfill this requirement

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

Due to this item’s proprietary nature the Government does not have the required data to develop a technical data package.

Reverse engineering is currently not feasible within reasonable time constraints. The qualification of a reverse-engineered part would require an Accelerated Mission Test (AMT). TF33 AMTs occur every 4 years and cost approximately $6M (this is the cost of the 2015 AMT) and would not occur until 2019.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE

ACQUISITION

United Technologies Corporation CAGE: 52661

Pratt & Whitney Military Engines Division 400 Main Street East Hartford CT 06108 860-565-5173

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE

MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES

REQUIRED

In an effort to identify and remove barriers to competition, the AFLCMC/LPSEA3 engineering group will continue to monitor the marketplace for source development, engage in discussions with the OEM regarding additional approved sources, and will periodically re-screen this item and post findings on the Screening Analysis Worksheet (SAW). The Government will continue to synopsize the requirement and rescreen the item.

XII. CONTRACTING OFFICER’S CERTIFICATION

By signing the coordination and approval document, the contracting officer determines this document to be accurate and complete to the best of the contracting officer’s knowledge and belief.
