JUSTIFICATION AND APPROVAL (J&A)

FOR OTHER THAN FULL & OPEN COMPETITION

ADDEMDUM

PR: FD2030-14-00312-05

NOUN: Door Access

REVISED DOLLAR VALUE OF ANTICIPATED AWARD(S) _

Statutory Authority: 10 USC 2304(c)(1). Regulatory Authority: FAR 6.302-1.

This addendum relies upon the statutory and regulatory authority recited in the original J&A FAR 6.302-1(a)(2) "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" and the purchase is sole source for the reasons recited therein. A significant increase in the unit price, due to obsolescence of an adhesive, the addition of a First Article Government Test and all associated reports, the addition of NRE Tooling required to use the new adhesive, and additional NRE for engineering updating drawings/modeling has increased the previous approved J&A for a revised estimated total value as shown above; which is not within the approval authority of the official that approved the J&A. In accordance with FAR 6.304(a)(2) the approval level for this J&A is the competition advocate.

JUSTIFICATION FOR OTHER THAN

FULL ANO OPEN COMPETITION

I. CONTRACTING AglVITY

DLA Aviation/ AOA 3001 Staff Drive/2AC4 10SB Tinker AFB, OK 73145

JI. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED

This individual Justification and Approval (J&A) authorizes the use of other than full and open competition procedures to obtain a cost plus fixed fee, sole source contract with The Boeing Company division Defense Space & Security (hereinafter. "Boeing") for procurement of aircraft doors for the B·S2H aircraft. This J&A is to support the rationale that only one responsible source exists and no other supplier will satisfy agency requirements.

Ill. DESCRIPTION OF THE SUPPLIES(SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS

New Manufacture of:

NSN: 1560·00·979-9694FG

Type of Appropriation: 97X4930

Item dimensions: 50 inches long X 38 Inches wide X 4 Inches high

Material Content: Aluminum honeycomb core, skin dad with 2024-T3 Sheet Aluminum.

Item description and function: This Item serves as an aircraft tip gear wheel door; it provides a smooth outer surface matching surrounding airframe skin that when closed, maintains aerodynamics during flight after the wing tip wheel retracts.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION

10 U.S.C. 2304{c)(l), as implemented by FAR 6.302-1 (a}(2}(ii}, with an application pursuant to FAR 6.302-1 (b)(l)(iij. In accordance with FAR 6.304(a)(2) the approval level for this J&A is the competition advocate.

V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUAllFICATIONS OR NATURE

OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED

ABOVE(APPLICABILITY OF AUTHORITY)

The Government does not have, nor can purchase the necessary data for competitive purchases. The adhesive that was originally used is no longer available. Boeing is currently developing a new adhesive for this item. The new adhesive has never been used on any weapon system door. Boeing oversight is needed during the manufacturing process to ensure the procedures are developed and the adhesive is usable for these doors. In the future, this should be a competitive buy. Accordingly, Boeing is the only source capable of providing the items described in Section 111 above.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE

Jn accordance with Far 5.201, this requirement shall be synopsized and the request for proposal {RFP} posted in Federal Business Opportunities {FedBlzOpps) website. The government does not have the qualification requirements, as only the original equipment manufacturer (OEM) approves additional sources. The OEM will develop approved sources during the Implementation of the new adhesive process.

VII. DETERMINATION BY THE CONTRACT! NG OFFICER THAT THE ANTI Cl PATED COST TO

THE GOVERNMENT WILL BE FAIR AND REASONABLE

Cost and pricing data will be requested from the contractor. A detailed cost analysis and a price analysis may be performed. A technical evaluation from the Defense Contract Management Agency (DCMA) and a field audit from the Defense Contract Audit Agency {DCAA) may be requested to aid In the evaluation of the contractor's proposal.

vm. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A

STATEMENT OF THE REASON MARKET RESEARCH WAS NOT CONDUCTED

Market research in accordance with FAR Part 10 was conducted by 424 SCMS/GUME engineering, Philip Phan on 10 Feb 2015. A review of the Parts Manufacturer Approvals (PMA) and Defense Logistics and Parts Information database (HAYSTACK) web search was conducted. The research revealed that there is not a commercial Item available to meet this requirement. The items described in Section II are used in military applications and no commercial or non-developmental substitutes are available. Other companies that perform similar efforts exist in the marketplace, but they do not possess the applicable technical data required to meet the government's specifications. Based on the above, a high level of confidence exists that Boeing is currently the only source capable to fulfill the requirement.

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION

The door is bonded with a new adhesive that only Boeing is qualified to use. The procedures and processes have been developed; and this contract will be the first contract among all weapon systems using the new adhesive. Boeing oversight on this contract is required since they developed the manufacturing process utillzlng the new adhesive. After the approved sources are provided by Boeing, then the future buys will be competitive.

X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION

The Boeing Company Defense Space & Security 6200 J S McDonnell Blvd St Louis, MO 63134·1939 480-891-1045

XI. A STATEMENT OF THE ACTIONS, IF ANY THE AGENCY MAY TAKE TO REMOVE OR

OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT

ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED

In an effort to identify and remove barriers to competition, the 424 SCMS/GUEA engineering group will periodically re-screen this item.

XII. CONTRACTING OFFICER'S CERTIFICATION
