4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL & OPEN COMPETITION: This J&A is based upon the authority of 10 USC 2304(c) (1), only one or a limited number of responsible sources will satisfy agency requirements, as implemented by FAR 6.302-1

5. RATIONALE JUSTIFYING USE OF CITED AUTHORITY:

The current Acquisition/Repair Method/Suffix Code(s) is (are)

0. The part was not assigned AMC/RMC 1 through 5 when it entered the inventory, nor has it ever completed screening.

1. Suitable for competitive acquisition for the second or subsequent time.

H

H. The Government physically does not have in its possession sufficient, accurate, or legible data to purchase this part/contract repair from other than the current source(s). This code is applicable only to parts under immediate buy/repair requirements and only for as long thereafter as the deficiency is under review for resolution and appropriate recoding. This code is only assigned at the conclusion of limited screening, and it remains assigned until the full screening process resolves physical data questions and results in assignment of a different A/RMSC. If one source is available, A/RMCs 3, 4, or 5 are valid. If at least two sources exist, A/RMCs 1 or 2 are valid.

Multiple Method Codes

This acquisition will be solicited to

HEROUX-DEVTEK INC. (36164)

755 Thurber Avenue Longueuil, J4H-3N2, Canada 514-679-5450

HEROUX-DEVTEK INC (36164) will be solicited because the item to be manufactured is a highly specialized part, designed and manufactured by a Non-Government activity and the technical data required to manufacture by other than the above is not available. A criticality determination has not been performed, therefore the subject item does not have a criticality code at this time due to being on Interim Support (pre-MSD) until 1OCT2022; All alternate sources must qualify I/A/W the Design Control Activity procedures as approved by NAVAIR prior to award. This system is complex and unique requiring technical expertise that currently resides with HEROUX-DEVTEK INC (36164). Due to the complexity of the required test equipment and the high cost to develop the electrical and mechanical requirements, achieving full and open competition for manufacturing of this item is not possible at this time.

6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY OFFERORS AS PRACTICABLE: A Request for Information / Sources Sought Notice was entered on the FedBizOpps website for government-wide point of entry on

18 MAY 2018

and as a result

No responses were received

The proposed contract action was synopsized on the FedBizOpps website for government-wide point of entry on

11 JUN 2018

and as a result

No responses were received

Market Research was conducted in accordance with FAR Part 10. The results of the Market Research conducted (or the reason(s) Market Research was not conducted) are as follows:

Market research was not conducted due to item being on Interim Support until 1OCT2022.

The available technical data is insufficient for the development of new sources. Source Development Department files indicate no Source Approval Request (SAR) has been received from any party interested in becoming an approved source.

7. DETERMINATION OF FAIR AND REASONABLE COST:

The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

8. ACTIONS TO REMOVE BARRIERS TO FUTURE COMPETITION:

To promote competition the NAVSUP WSS will continue to encourage vendors with the expertise to manufacture/repair the subject item to submit a complete technical data package for review and source approval by the appropriate engineering source approval authority per the (WSS) guidelines. Also future requirements will be advertised in the FedBizOps website (www.fedbizops.gov) in order to encourage potential vendors to submit Source Approval Requests. For reasons set forth in Paragraph (5 & 6), NAVSUP WSS has no plans at this time to compete future contracts for the subject item covered by this document. If another potential manufacturing source emerges, NAVSUP WSS will assess whether competition for future requirements is feasible.
