JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
I. CONTRACTING ACTIVITY:
DLA Aviation at Ogden Procurement Operations Activity (DLA-OO/AU) 6051 Gum Lane, Bldg. 1225 Hill Air Force Base UT 84056-5825 Contracting Officer: Nathan Gomm Commercial telephone:
E-mail: Nathan.Gomm@dla.mil PR Numbers: FD2020-16-00029 (B-2)
FD2020-16-00028 (B-52)
FD2020-16-00006 (F-15)
Others as Required
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED:
A. Upon approval to use other than full and open competitive procedures, the Defense Logistics Agency (DLA), DLA Aviation at Ogden Procurement Operations Activity, will issue a new 5-year requirements-type supply contract to procure B-2, B-52, and F-15 Wheel and Brake system spares. These requirements are for the support of the B-2, B-52 and F-15 aircraft Landing Gear Sustainment Programs and will be used on Air Force weapons systems. The contract will be awarded to:
Honeywell International Inc. (Honeywell) 3520 Westmoor Street
South Bend, IN 46628-1373
CAGE: 55284
B. Due to the circumstances described herein, this activity requests authority to acquire Honeywell spares using Other Than Full and Open Competition as prescribed by FAR 6.302- 1, only one responsible source and no other supplies or services will satisfy agency requirements.
C. This action will result in the award of a 5-year, requirements-type contract. An initial list of 16 National Stock Numbers (NSNs) has been screened, determined, and certified to be sole-source to Honeywell. This list of initially screened, determined, and certified sole-source
E. This approval request is for more than one fiscal year. There are no feasible actions that could develop future competition during the period of performance of this acquisition as referenced in section V, paragraph C below.
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION:
10 USC 2304 (c) (1) as implemented by FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS
OR NATURE OF THE ACQUISITION REQUIRES THE USE OF AUTHORITY CITED
ABOVE (APPLICABILITY OF AUTHORITY):
A. The above authority was selected because the requirement is for the manufacture of highly specialized components, whose design and data rights are currently proprietary to Honeywell.
Per the 417 SCMS/GUEA Engineer, the subject items are unique to United States Air Force (USAF) systems. They are designed and certified to USAF respective specifications. The wheels and brakes where tested to design requirements which includes failure, fatigue, stress, and corrosion analysis.
B. The Air Force does not control the design, nor does the Government possess the data required to manufacture the subject items. Honeywell is the wheel and brake Original Equipment Manufacturer (OEM) of the subject items, with design control, authorization, and documentation to manufacture the subject items. Honeywell has acquired, at its own cost, the highly specialized knowledge and capabilities to manufacture the subject NSNs. The data that is available to the Air Force is proprietary to Honeywell, and available drawings are top-level only, insufficient for the design or manufacture of the subject items. As part of market research IAW FAR Part 10, the Air Force 417th SCMS inquired to see if Honeywell was willing to sell the proprietary data to the Government for the subject items. If the data was to be made available, it was requested that Honeywell provide a no-cost itemized Rough Order Of Magnitude (ROM) for the data required; Unlimited License Rights, Government Purpose Rights, Form, Fit, and Function Rights, and Operations, Maintenance, and Installation Data (OMID). The attempt to obtain data and rights was completed on 24 Jul 2015 by the 417 SCMS. Honeywell stated that the subject drawings are proprietary and Honeywell is not willing to sell the data rights.
C. Accordingly, Honeywell is the only firm capable of providing the supplies described in Section III above without the U.S. Air Force experiencing substantial duplication of costs that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.
VI. DESCRIPTION OR EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE:
A. A Supplemental Market Research Request for Information (RFI) and Sources Sought Synopsis (SSS) (SPRHA1-16-R-1001) was posted in Fed Biz Ops on 6 May 2015 for the subject items. The combined RFI/SSS notified industry that the Government was conducting Market Research to:
1) Determine if other sources are capable of satisfying the agency’s requirements and if commercial items or non-developmental items are available that meets the agency’s requirements as identified in section III.
2) Improve Small Business access to acquisition information
3) Enhance competition by identifying contracting and sub-contracting opportunities
B. The RFI/SSS closed on 15 July 2015.
C. Responses Received: No responses or inquiries had been received by the closing date.
D. Other actions: No other actions are required at this time.
E. Qualifying Country Sources: None.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:
The following steps will be taken to ensure that the anticipated cost of this acquisition will be fair and reasonable. The Contracting Officer will comply with the procedures and criteria contained in Federal Acquisition Regulation (FAR) under Part 30 - Cost Accounting Standards, Part 31 - Contract Cost Principles and Procedures, Subparts 15.4 - Contract Pricing; to include technical evaluations and audits, as appropriate. Additional steps to ensure price reasonableness will be under the guidance of the Contract Pricing Reference Guides, jointly developed by the Federal Acquisition Institute and the Air Force Institute of Technology. The final step is to prepare a detailed Price Negotiation Memorandum (PNM), which will contain documentation of the price negotiations conducted and a detailed documentation and justification of the price analysis performed to determine that negotiated and agreed prices are fair and reasonable.
VIII. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS,
OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT
CONDUCTED:
A. As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by an RFI and SSS of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.
B. In addition, the respective Integrated Product Teams (IPTs) from the 417th SCMS F-15, B-2, and B-52 IPT’s conducted market research that yielded the following results:
1) The review indicated no other alternate commercial item or non-developmental items (NDI) will meet the requirements, nor can the requirements be modified to permit use of existing commercial items or NDIs.
2) A search and review of the below internet sites was accomplished in which no viable, authorized manufacturing source, was identified.
ThomasNet (http://www.thomasnet.com) Google (http://www.google.com) ILSmart (http://www.ilsmart.com) WorldWide Warehouse Redistribution Services (WWRS) (https://afsac4.wpafb.af.mil/WWRS)
3) A review of the procurement history (AFMC Form 318) for the listed NSNs identified Honeywell, Cage Code 55284, is the only qualified source for the procurement of these item.
4) The Government’s Purchase Request Process System (PRPS) was also searched using the items NSN, in which the results showed the only approved source as Honeywell, Cage Code 55284. Additionally, the Air Force Form 761s, Screening Analysis Worksheets, identified Honeywell as the only source. The search did not yield additional approved sources.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION:
None.
X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE
AQUISITION:
No sources expressed interest during the time that the RFI and SSS were posted; see Section VI.
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING
SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED:
A. A new F-15 Wheel and Brake System Improvement (WBSI) was awarded in November 2014 in which full and open competition was utilized. The WBSI effort resulted in a re-design of the legacy parts. At this time, with the WBSI in process, no further actions will be undertaken to make this legacy spares requirements competetive. In regards to the B-2 and B-52 the Air Force will strive to remove barriers to competition by providing Source Qualification Statements to entities requesting to become a provider of the assets listed in section III A.
B. For any NSNs to be potentially added to the contract under the authority of this J&A, a technical review, sole source certification, and synopsis will be performed prior to items being priced and added to the contract via modification. The Air Force requirements personnel, the Contracting Officer, and the DLA Aviation at Ogden Competition Advocate will review the solicitation and all potential add-on items to determine if there are any potential additional sources of supply. Any items which become competitive after award will be removed from the contract in accordance with DLAD 52.216-9006, Addition/Deletion of Items.
XII. CONTRACTING OFFICER’S CERTIFICATION:
The Contracting Officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(b)12).
