About this file

This redacted justification and approval document provides the rationale for a sole source award for a direct current motor. The Defense Logistics Agency Land and Maritime will award contract SPRDL1-24-D-0016 to an unknown vendor on February 5, 2024 for an unknown amount. The motor is identified in source control drawing 12524409, and Skurka Aerospace is the original equipment manufacturer as well as the only approved source. Reverse engineering the motor would require significant time and expense. No other vendors expressed interest in providing an alternative motor design after a sources sought notice.

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 3204(a)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited: The United States Government (USG) owned technical data for this item is a source control drawing (SCD) number 12524409. SCDs are not detailed design disclosures. SCDs provide an engineering description, qualification requirements and acceptance criteria for vendor-developed items procurable from a specialized segment of industry for critical applications. SCDs list approved sources of supply and the vendor’s item identification for those item(s) that have been qualified and approved for use. Drawing 12524409 identifies Skurka Engineering CO (now doing business as Skurka Aerospace Inc. and hereafter referred to as Skurka) as the only approved source of supply. Skurka part number K295-C40953 is the only approved motor. A detailed technical data package (TDP) suitable for competitive acquisition is not available because the motor design is proprietary to Skurka. Skurka is the original equipment manufacturer.

Skurka is a high-quality designer, developer, and manufacturer of custom electro-magnetic equipment. They have been serving the Aerospace industry with custom engineered solutions including electric motors, speed pickup transducers, and starter generators. Skurka has been building electric motors for military guns since 1965 and have been a qualified producer for the Motor, Direct Current, since the M242 was first designed and qualified. On multiple, previous acquisitions, Skurka demonstrated their ability to produce a quality motor in the production quantities and schedules that meet the USG’s requirements.

The Combat Capabilities Development Command (DEVCOM) Armaments Center (AC) project engineer determined that a significant amount of time and money would be necessary to reverse engineer, procure, test prototypes, perform qualification testing and release the design.

Sources Sought Notice and expressed interest in filling this requirement. The USG M242 Gun Drive Motor technical data is a source control drawing (SCD); only approved sources and their qualified products are eligible to fill this requirement. Since AMETEK is not a qualified source documented on SCD 12524409, AMETEK would need to create their own motor design in accordance with drawing 1252409 and the M242 Gun Drive Motor Critical Item Product Function Specification, complete and pass qualification testing, and submit a source approval request to the Competition Management Office before being eligible to supply this motor.

On 10 April 2023, US Army DEVCOM Armaments Center project engineer performed market research in attempt to locate alternate sources to obtain the approved Skurka motor. Using internet search engines and search terms such as "gun drive motor", "M242 motor", "M242 gun drive motor", “PN12524409” and "K295-C40953".

Findings:

The internet searches returned only summaries of past USG contract activity with Skurka, and unserviceable motor disposal actions posted by the Defense Reutilization Management Office. The searches did not return any additional motor sources, or any meaningful information that would increase competition.

The Contracting Officer made the determination that the Motor, Direct Current is a commercial item based on information presented by Skurka and a determination made the Defense Contract Management Agency Commercial Item Group (CIG). Skurka submitted documentation that provided the technical details and comparisons of the current motor to a similar motor that qualifies as a “commercial item” as defined by FAR

2.101 where similar types of material were selected for the two products to meet the performance requirements. In addition, CIG case number S5113A23C0324, submitted on 09 May 2023 by Commercial Determination Administration Contracting Officer, verified the Motor, Direct Current was procured using FAR Part 12 procedures and the award is precedent setting in accordance with Defense Federal Acquisition Regulations (DFARS) case 2020-D033 and DFARS 212.102(a)(ii)(A).
