JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
The Defense Logistics Agency – Warren (DLA – Warren) is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."

ACQUISITION METHOD SUFFIX CODE (AMSC): 3
Acquire, for the second or subsequent time, directly from the actual manufacturer.
EXPLANATION of AMSC H:
The Government physically does not have in its possession sufficient, accurate, or legible data to purchase this part from other than the current source(s). This code is applicable only to parts under immediate buy requirements and only for as long thereafter as the deficiency is under review for resolution and appropriate recoding.
This code is only assigned at the conclusion of limited screening, and it remains assigned until the full screening process resolves physical data questions and results in assignment of a different AMSC. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
PART II - Technical Information and Certification
1. The US Army TACOM LCMC requires the acquisition of the above item. The only known source of supply for the above item is:
a. Contractor(s) Name: SCI Technology, Inc.
CAGE: 2J622
Part Number: 12992057-1
2. Reasons the item is not suitable for full and open competition:
a. Status of the Acquisition Data: This is the second version of the Interface Unit, Fire (also known as the Position Interface Box (PIB-II), P/N 12992057-1), which is part of the Position Sensor System used on various BFVS Turrets. CPU Technologies, Inc., 5753 W. Las Positas Blvd, Pleasanton, CA 94588 (CAGE Code 0XRH7) which in Dec 2012 became IOnU Security, Inc., 2105 South Bascom Ave Suite 310, Campbell, CA 95008 (CAGE Code 6THT3) was the only Approved Source of Supply for this item.
Currently SCI Technology, Inc., 13000 Memorial Parkway SW, Huntsville, AL 35803 (CAGE Code 2J622) owns all of the Automated Test Equipment (ATE) and the exclusive rights to the proprietary TDP and all associated documentation needed to produce and test the PIB-II, CPU Tech’s Part Number 003-100137-002.
b. Efforts to Increase Competition or Qualify a New Source in Relation to this Procurement: To date the government has not purchased the data regarding the present proprietary design of the PIB-II by which competition of this item may be accomplished. At this time funding to purchase or develop competitive data is not available. Since there is no competitive technical data, no contractors are in the process of being qualified at this time nor will be prior to the contract award due to funding constraints. It should be noted that some of the electronic components in the current PIB-II design are either obsolete or will become obsolete. Thus additional suppliers may not be able to obtain these electronic components and would not beable to become a qualified production source for the PIB-II even there was a competitive
TDP.
c. Demonstration of Approved Contractor's Unique Qualifications: Both the PIB, Vendor P/N 003-100137-001 (Army P/N 12992057) and the PIB-II, Vendor P/N 003- 100137-002 (Army P/N 12992057-1) were originally designed, produced and tested by CPU Technologies, Incorporated. When the major part of CPU Tech was sold to Boeing, the portion of the company that was responsible for both the PIB-II and the Turret Drive Control Unit-II (TDCU-II) (used on the Bradley Turrets) became IOnU Security. In 2015, SCI Technology, Inc. purchased CPU Tech’s proprietary PIB and PIB-II TDPs, test equipment and all associated documentation from IOnU Security. The ATE and its technical documentation includes the Bill of Materials (BOM), schematics for cables and equipment, configuration requirements for hardware to work with the test software, assembly drawings, and installation/setup procedures. The PIB and PIB-II TDP’s, owned by SCI Technology, Inc.) include all component and assembly drawings, schematics and BOMs. Note that both the PIB and PIB-II are used in the A3, A3 BFIST FSA, ODS-SA and M7-SA BFIST Bradley Turrets.
d. Efforts to Qualify Additional Suppliers for future procurements: The estimated cost to fully reverse engineer or redesign this item is $2.0 million and take 2 years to complete. It will take an additional year and $1 million for a new vendor to qualify their part for use on various BFVS Turrets. This total effort will cost $3.0 million and take 3.0 years to complete. Even if the U.S. Army had the $3.0 million in funding to fully reverse engineer or redesign this item and qualifying a new source, this cost would not be recovered through subsequent competition.
e. Market Research: On 20 February 2018, ARDEC-Rock Island conducted computer-based market research for this item and its use on the Bradley Vehicle did not yield any information about new production sources for this item. There are no other commercial or non-developmental items available to meet the Government's need or that could be modified to meet the Government's need that interfaces and functionswith the hardware and software in the various Bradley Turrets.
ARDEC-Rock Island engineers do not have access to FedBizOps, Competition Advocate's Shopping List (CASL) or the Advanced Procurement Planning List.
On 30 June 2017, a Sources Sought Synopsis (Notice 2017-315) was posted to FedBizOps. To date no additional contractors have expressed interest in submitting proposals for the procurement of these items.
3. Interested Sources: To date, no other sources have expressed a written interest in the acquisition of this item. Should potential sources respond to the synopsis in FedBizOpps, they will be evaluated by the appropriate engineering office as an alternate source.
4. The POC for this action is
5. Fair and Reasonable Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable DLA Land Warren will use the appropriate acquisition procedures and price and/or cost analysis to determine that the contract price is fair and reasonable. NSN: 1290-01-596-7196 has been determined a non-commercial item through market research. Due to the dollar value expected to exceed $750,000.00, Certified Cost or Pricing Data will be obtained in accordance with FAR 15.403-4(a)(1).
6. Contracting Officer Certification: I certify that this J&A is accurate and complete to the best of my knowledge and belief.
