JUSTIFICATION FOR OTHER THAN

FULL AND OPEN COMPETITION

DLA Land Warren is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."

PART I - Description of Item Required:

a. NOUN: LDCS Control Box

b. QUANTITY: 31

d. PN: 10810053

e. VEHICLE SYSTEM: Assault Breacher Vehicle (ABV)

f. ESTIMATED UNIT PRICE: $7320.66

g. ESTIMATED VALUE: $226,940.46

ESTIMATED OPTION VALUE: $226,940.46

ESTIMATED TOTAL VALUE: $453,880.92

h. PRON NUMBER: EH56E160EH

i. TYPE OF FUNDS: AWCF

j. TYPE OF CONTRACT: Firm Fixed Price

k. AMC 4. Acquire, for the first time, directly from the actual manufacturer.

l. AMSC H. The Government physically does not have in its possession sufficient, accurate, or legible data to purchase this part from other than the current source(s). This code is applicable only to parts under immediate buy requirements and only for as long thereafter as the deficiency is under review for resolution and appropriate recoding. This code is only assigned at the conclusion of limited screening, and it remains assigned until the full screening process resolves physical

SPRDL1 16 R 0140 P a g e | 2 data questions and results in assignment of a different AMSC. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.

PART II - Technical Information and Certification

1. The US Army Tank-automotive and Armaments Command requires the acquisition of the above item. The only approved source for the above item is:

a. Contractor(s) Name: URS Federal Technical Services INC.

Cage: 29674

NSN: 2590015598995

MFR P/N: 10810053

2. Reasons the item is not suitable for full and open competition:

a. Status of the Acquisition Data:

The TDP and its proprietary rights are not owned by the Government and as such, the data required to produce a competitive TDP are not currently available.

b. Efforts to Increase Competition or Qualify a New Source in Relation to this Procurement:

The quantity of parts in this PRON as compared to the cost of developing a new TDP as well as an alternate contractor of the associated components, testing and tooling, does not justify itself. An alternate contractor would need a detailed TDP and detailed manufacturing information that would need to be generated utilizing reverse engineering methodology through the use of considerable Government resources. The cost of such resources would not be recoverable through low volume subsequent competition. Additionally, the engineering estimate for the time of developing an alternative source includes the TDP development, reverse engineering, manufacturing tooling, testing and qualification is estimated to take approximately 2-3 years, which would render ABV LDCS equipment unusable for that period of time and will prevent the commander from being able to: lift the LDCS cover, launch the MICLIC Rocket and detonate the explosive charge from the inside of the vehicle which is detrimental to the mission of the ABV.

c. Demonstration of Approved Contractor's Unique Qualifications:

The approved source, URS, demonstrated the ability to establish and maintain the processing required to successfully produce a finished item. The approved source has produced and qualified the Linear Demolition Charge System (LDCS)

SPRDL1 16 R 0140 P a g e | 3 in the past for both the USMC and Army Assault Breacher Vehicle and passed all Reliability and Interoperability testing conducted by the USMC and Army.

d. Efforts to Qualify Additional Suppliers for future procurements:

At this time there are no current planned efforts to qualify additional sources due to the fact that technical data and funding to conduct testing requirements are unavailable.

e. Market Research:

This item does not appear on the Competition Advocate’s Shopping List (CASL) or the Advanced Procurement Planning List (APPL). A request for a Sources Sought Synopsis was sent to the Source Development Office on Jan 9th 2015 to see if there is any interest from perspective qualified sources. To date no additional sources have expressed interest in this item.
