The AN/AVR-2B (V) LDS system is a laser warning system that informs and assists U.S. Army aircrews in the detection and verification of impending threats from laser aided weapon systems, including Surface-to-Air Missiles, Air-to-Air Missiles, Anti-Aircraft Artillery, and small-arms weapon systems. The AN/AVR-2B (V) LDS system is designed to work through its interface with the AN/APR-39A Radar Signal Detecting Set on the aircraft’s Multi-Function Display unit.

The AN/AVR-2B (V) LDS is an improved version of the AN/AVR-2A (V) LDS, the previous generation system, and is backward compatible with the AN/AVR-2A (V) LDS.

Brief narrative supporting the situation and weapon system: This Justification and Approval supports a solicitation using other than full and open competition procedures for a one-year, Firm-Fixed-Price (FFP), Indefinite-Delivery, Indefinite-Quantity (IDIQ) supply contract to procure the eleven parts listed above. The Government requires spare parts that are form, fit, and functionally compatible with the sensor unit assembly and signal comparator modules, part of the

DLA Land & Maritime Justification for Other Than Full & Open Competition (May 2018)

AN/AVR-2B (V) LDS System, to ensure successful operation and installation on aircraft platforms using this system. The Government does not currently possess the detailed technical data that describes all required form, fit, and function characteristics of these parts. Goodrich, CAGE 8F963, the Original Equipment Manager (OEM), located at 100 Wooster Heights, Danbury, CT, is the sole manufacturer of the AN/AVR-2B (V) LDS system. Goodrich controls the technical data necessary to produce spare parts that are compatible with this system and is therefore the only known manufacturer with the comprehensive knowledge and expertise to produce these required items

5. If restricted to the only source(s) of supply, include source(s) and CAGE code: Goodrich Corporation, UTC Aerospace Systems Division, CAGE Code: 8F963

The use of the authority cited below:

[ X ] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.

[ X ] AMC 4. Acquire, for the first time, directly from the manufacturer.

The use of the authority cited is based on:

[ X] AMSC R. The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

[X] The acquisition was synopsized on Federal Business Opportunities on February 16, 2018 and amended on April 9, 2018 and August 31, 2018. The first amendment was to inform responsible sources of the standards at FAR 5.207(c)(16)(ii). The original synopsis was for a 5-year IDIQ with a contract maximum contract value The second synopsis amendment was to give notice that the Government intends to issue an award for a 1-year IDIQ with a maximum contract value of $

7. The Contracting Officer: I hereby determine that the anticipated cost to the Government will be fair and reasonable. The contracted prices on SPRBL1-13-D-0020 were determined to be fair and reasonable based on certified cost and pricing data pursuant to FAR 15.404-1(a)(3). This one year IDIQ will use the year five prices of SPRBL1-13-D-0020. Additionally, based on price analysis, utilizing the year five prices of SPRBL1-13-D-0020 is determined fair and reasonable pursuant to FAR 15.404-1(b)(2)(ii)(B).

8. Market Research/Efforts to Obtain Competition:

The technical experts within the Integrated Logistics Support Center (ILSC) published two SSA on the FBO. The first notice was posted on 11 July 2017 and the second on 18 September 2017.

Two (2) vendors responded to the second SSA published on FBO: Goodrich and Seven Outsource. Goodrich, the manufacturer, expressed interest in providing the parts and has the technical data to produce the AN/AVR-2B (V) LDS spares to meet the Government‘s requirements. The Engineer followed up with Seven Outsource but they did not respond when

DLA Land & Maritime Justification for Other Than Full & Open Competition (May 2018) asked to provide test results or purchase order showing that they manufactured the items in the past. Seven Outsource appears to be a recruiting agency operating as RFPMart Solutions Private Limited and RFPMart LLC. The Seven Outsource website states they are a “RFPMart Solutions Company.” A name search of the Commercial and Government Entity Program and SAM showed no results for a CAGE code for this entity.

The Contract Specialist conducted searches of WebFLIS, Army i2Log, Federal Procurement Data System (FPDS), ILS Mart, historical acquisition history, and interested sources. Per WebFLIS, Army i2Log, FPDS, and ILS Mart, Goodrich has historically supplied these parts. The Contract Specialist posted a SSA to FBO on 18 September 2017. In a phone call to Goodrich, verbal confirmation was received on their interest in the follow-on contract. Gregory Beach, the Contracts Manager, informed the Contract Specialist, Goodrich is aware of the follow-on action and that they intend to respond to the solicitation. The Contract Specialist also sent a follow-up email to Seven Outsource for the information requested by the Engineer but no response was received.

On 22 February 2018, Environment of Care Solutions LLC responded to the synopsis stating an interest in submitting a proposal for the solicitation should it be competed. The Contract Specialist followed up with a request for a capability statement, manufacturing history, and Company’s CAGE Code. Environment of Care Solutions LLC did not respond to the request for additional information.

Additionally, only the OEM contacted the Contract Specialist in reference to the amendment of the synopsis posted to FBO.
