The following have been modified:

252.212‐2 EVALUATION – COMMERCIAL ITEMS (OCT 2014)

(a) The Government intends to evaluate offers and award a contract using the procedures of FAR Part 12 and FAR Part 13. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) Technical capability of the item offered meets the Government requirement

(ii) Price

(iii) Past Performance: Supplier Performance Risk System (SPRS) and Federal Awardee Performance and Integrity Information System (FAPIIS) will be reviewed to determine vendor responsibility

The relative order of importance of the evaluation factors are in descending order of importance.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(c) EVALUATION.

(1) TECHNICAL CAPABILITY FACTOR. For technical evaluation purposes, the offeror shall submit to the address shown in the Solicitation’s Offeror Instructions:

(i) a garment sample corresponding to each Solicitation Item Number, i.e., one (1) sample garment for Item No. 0001, one (1) sample garment for Item No. 0002, and one (1) sample item for Item No. 0003.

(ii) a manufacturer's specification sheet for each garment, and

(iii) a listing of what colors are available for each garment.

Samples will be evaluated by the Government's Technical Evaluation Board to determine if the garments meet the specifications described in the Solicitation’s Item Number descriptions and as detailed below.

Solicitation Item Numbers will be evaluated as either Acceptable or Unacceptable according to the following criteria:

The samples and specification sheets will be evaluated as either ACCEPTABLE (Pass) or UNACCEPTABLE (Fail). A rating of UNACCEPTABLE on any element shall render the overall quotation TECHNICALLY UNACCEPTABLE and the vendor will no longer be considered for further competition or award.

(2) PRICE FACTOR. The vendor's proposed price will be evaluated on the basis of price reasonableness in accordance with FAR Subpart 13.106‐2. The evaluation will include, but is not limited to:

(i) Comparison with pricing from other offers and with independent cost estimates; and

(ii) Completeness of pricing information related to what is requested in solicitation.

Vendors responding to this solicitation are advised that, prior to award, the Government may request vendors submit additional information to support price reasonableness, such as copies of paid invoices for the same or similar items, price lists with effective dates, etc. Failure to submit the requested information may result in disqualification of the submitted quote.

(3) Past Performance: To determine vendor responsibility, the Government will review offeror past performance using the Supplier Performance Risk System (SPRS) and the Federal Awardee Performance and Integrity Information System (FAPIIS).

(4) SELECTION. Using the procedures of FAR Part 12 and FAR Part 13, the Government will:

(i) select the vendor(s) whose quotation(s) is/are most advantageous to the Government, considering price and technical capability when compared to other quotations.

(ii) reserve the right to award on initial quotes.

(iii) reserve the right to award to multiple vendors.

(iv) reserve the right to not award an order if an award is not in the best interest of the

Government.

(v) email or otherwise furnish a written order in response to the successful vendor(s)' quotation(s). The Contracting Officer may ask the vendor(s) to provide written acceptance of an order.
