PART A – SPECIAL PROVISIONS
1.0 GENERAL
PROJECT DESCRIPTION
The County Commissioners of Charles County request bids for the construction of Phase 1 of Sub cell 4b at Charles County’s
Landfill No.2. Phase 1 work entails the construction of Sub cell 4B, leachate transmission piping to the existing leachate influent wet well, and other incidentals. A vicinity map showing the approximate limits of the project is shown in Section 7.0. The drawings depict three construction phases of construction- Sub cell 4A, Sub cell 4B, and Sub cell 4C. Currently, Sub cell 4A has been constructed. Thus, Sub cell 4B must tie into the Sub cell 4A system. The Record As Built drawings are provided per
Attachment F - Flora Survey Record Drawings and Attachment G – Asbuilt Drawings.
PROJECT BACKGROUND
The project site is located of Billingsley Road approximately 8 miles northeast of La Plata in Charles County, Maryland. The site sits on 114.3 acres and the property is known as the Charles County Landfill No.2. The area for Sub cell 4B is 5.7 acres.
DRAWINGS AND SPECIFICATIONS
All work shall be performed in accordance with the project drawings and specifications provided in Section 6.0. The specifications and drawings in are for bidding purposes only. The plans and specifications are subject to revision based on possible permit review requirements. Furthermore, the work shall follow the Charles County Government Department of
Planning and Growth Management Standards & Specifications for Construction and all other local, state, and federal ordinances, codes, guidelines, and regulations applicable to the work being performed under this contract.
TIME OF COMPLETION
The date by which the work to be performed under this contract is to be completed shall constitute the contract completion date. The Contractor shall be given a total of one hundred sixty (160) consecutive calendar days from the Notice-to-Proceed date plus any contract time extensions approved by the County in which to complete all work to a point of substantial completion. The project shall be considered substantially complete once MDE has approved the construction and authorized the placement of refuse in the cell.
All bidders shall consider the following weather information which can be expected at the landfill. Weather related time extensions will only be granted if the number of precipitation days and the total monthly precipitation exceeds the values in the table.

The days of precipitation per months was derived from NOAA data and the average precipitation per month is a combination of NOAA and U.S. Climate Data.
INVOICES
The Contractor shall submit monthly invoices on the County’s standard invoice form for payment of work perform. Fourteen
(14) days prior to submitting the 1st monthly invoice, the Contractor shall submit a Schedule of Values to the County for review and approval. The Schedule of Values shall contain a cost breakdown of the construction items shown on the Bid Form and shall be consistent with the activities identified on the approved project schedule. Payment of invoices by the County shall be in accordance with the General Provisions contained herein.
Each month the County will pay to the Contractor the Contract value of work satisfactorily performed during the preceding calendar month, less 5% of the estimated amount until final completion and acceptance of the work. The retainage shall be held for the one (1) year warranty period per Section 2.9.5 Release of Retainage. Reduction of the retainage of less than 5% shall be at the sole discretion of the County.
LIQUIDATED DAMAGES
Time is of the essence for the completion of this project. In accordance with the General Provisions, the County shall, at its discretion, assess liquidated damages in the amount as determined by the County to be the actual cost incurred by the County as a result of the project being extended beyond the contract completion date as defined in Section 1.4 Time of Completion of these Special Provisions. The amount of liquidated damages shall not exceed $1000 per day.
WORKING HOURS
The Contractor may request to work weekends and on holidays with an advanced notice of 48 hours and upon approval by the County. Also, the Contractor will be allowed to work extended hours with a 48-hour advanced notice and upon approval by the County.
2.0 SCOPE OF SERVICES
The Scope of Services for this project includes all direct and incidental work necessary to perform the work identified in this solicitation. The Contractor shall not commence work under the Scope of Services prior to receiving a written notice from the
County. The notice will only be in the form of an official Notice-to-Proceed (NTP) letter from Charles County Department of
Public Works. Any other form of authorization for the start of work on this project does not constitute approval by the County.
There will be no separate payment for work performed under the Scope of Services. Costs associated with the Scope of
Services shall be considered incidental to construction of the project and therefore included in lump sum price for the Base
Bid Items of the Bid Form.
PRE-CONSTRUCTION SURVEY
Prior to mobilizing to the site, the Contractor shall conduct a site video inspection of the project area and photograph key refurbishment areas, i.e. driveways, fences, signs, etc., in order to establish irrefutable evidence of pre-construction conditions.
A copy of the pre-construction site video and photographs shall be provided to the County in a digital format acceptable by the
County prior to commencing work.
PROJECT COORDINATION
The Contractor shall coordinate with all County Departments, MDE, SMECO, Verizon, Washington Gas, Comcast, and any other utility company or entity having jurisdiction over, or a vested stake or interest in, or that could or may be affected by this project. The Contractor is required to notify the affected party prior to starting and completing the project. The Contractor shall maintain reasonable access to allow these parties to perform their duties as it relates to their respective jurisdiction, facilities, and property.
PROJECT SCHEDULE
Upon receiving the Notice of Award (NOA) letter from the County, the Contractor shall begin developing a project schedule to be submitted to the County for review and acceptance at or before the project Pre-Construction meeting. The schedule shall be prepared utilizing the Critical Path Method (CPM). The schedule shall breakdown each bid item task into manageable and measurable subtasks. The schedule shall be monitored through the duration of the contract and shall be updated prior to each progress meeting, with copies provided by the Contractor for each meeting attendee for review and discussion. The schedule shall be prepared in a manner that front loads concentrated work efforts that reserves time to deal with unforeseen difficulties, and still meet the allotted time for completion.
PROJECT SIGN
The County will provide project information sign(s) after issuance of the Notice-To-Proceed (NTP). Signs sizes are approximately 5'x8' or 6'x10', or a combination of both. Wood posts, supports, and mounting hardware will not be provided by the County. The Contractor shall retrieve the sign from the County’s office located at 10430 Audie Lane, La Plata, Maryland
20646.
Before work starts, the Contractor shall install the project information sign(s), adequately supported by a minimum of two 4" x 4" wood posts and supports to withstand normal wind loads. The County and the Contractor will coordinate suitable location(s) for the project sign(s). The project sign(s) shall be located to ensure suitable visibility, and to provide adequate sight distance for traffic when placed at or near intersections. Lights, flags, or other devices will not be permitted for attachment to the signs or posts.
The Contractor shall be responsible for the maintenance, repair, and upkeep of signs for the duration of project. Signs shall be cleaned as necessary to maintain readability. The condition of signs when furnished to Contractor will be documented by the
County and will be used as a reference to determine damage other than normal wear and tear. If any damage, beyond normal wear, occurs to the sign during shipment to and from the site, or during construction, it shall be replaced by the County at the
Contractor’s expense.
Upon completion of the project, the Contractor will remove and deliver sign(s) to the County to the location from which they were retrieved. The Contractor is responsible for coordinating delivery with the County.
PROJECT MEETINGS
To keep the project progressing at an efficient rate, and to facilitate the County in providing prompt direction, the Contractor shall be prepared to meet with the County and/or other agency representatives on a bi-weekly basis throughout the duration of the contract. Meetings shall be required until construction is substantially complete. At a minimum, the Contractor shall expect the following meetings:
2.5.1 Project Kick-Off Meeting (Office/Virtual)
Prior to the start of construction, the Contractor shall attend a project pre-construction meeting at the County or virtually via
Microsoft Teams. Following County execution of the Contract, the designated County Project Manager will contact the
Contractor to establish the date of the Notice to Proceed, and to schedule the kick-off meeting and to obtain any additional agenda items to be added to the list below. The kick-off meeting shall be held no later than seven (7) days after contract execution. The preliminary schedule shall be provided to the County at least 48 hours in advance of the scheduled meeting.
The County will chair the meeting while the Contractor shall be responsible for keeping a record of the meeting and providing type written meeting notes to all attendees within seven (7) days following the meeting. The agenda will generally include the following topics:

2.5.2 Pre-Construction Meeting (On-Site)
The Contractor shall coordinate with the County, all applicable regulatory agencies and utility companies to schedule a pre-construction site meeting prior to start of work. The purpose of the site meeting is to provide an opportunity to discuss the effects the construction will have on each company’s area of jurisdiction. It is expected that the pre-construction meeting will take place on the same day, following the project kick-off meeting at the County office.
2.5.3 Construction Progress Meetings
The Contractor shall coordinate, chair, and record bi-weekly construction progress meetings. The progress meetings will be held at the County or virtually via Microsoft Teams. The Contractor shall develop, in coordination with the County, a template for the agenda for the bi-weekly progress meetings. The contractor shall be represented by the project superintendent and project manager. The Contractor shall schedule the attendance of subcontractors and/or equipment suppliers as may be necessary from time to time to resolve issues that may arise. The Contractor shall prepare minutes of the meeting and distribute to all participants.
The agenda and updated progressed schedule shall be provided to the County at least 48 hours prior to the scheduled meeting.
The Contractor shall maintain a written record of the progress meetings and provide type written meeting notes to all attendees within seven (7) days following each progress meeting.
2.5.4 Field Coordination Meeting
The Contractor shall attend, when necessary, any field coordination meetings required by the County, or any regulatory agency or utility company as required to discuss issues related to the performance of work identified in these Special Provisions;
including but not limited to, the Army Corps of Engineers, the Department of Natural Resources, the Maryland Department of the Environment (MDE), the Water Management Administration (WMA), Maryland State Highway Administration (SHA), Charles County Development Services Division, Washington Gas, SMECO, Verizon, etc.
SHOP DRAWINGS, CATALOGS, AND SAMPLES:
Where shop drawings, catalogs, schedules, samples and related material are specified to be submitted, and whenever required by the County to be submitted, the Contractor shall submit to the County prior to incorporation into the work. The shop and diagram drawings and schedules must show completely all the work to be done, and any error or omission in the construction work because of incomplete or erroneous shop drawings, diagram drawings, and schedules shall be corrected by the Contractor at his own expense, even though the work is in place. Unless specifically requested as an exception by the Contractor, and approved by the County in writing, the approval by the County of any shop drawings, catalog, schedule, sample, and related material is limited to compliance with the contract drawings and contract specifications, and such approval by the County will not relieve the Contractor of the responsibility for errors or for failure properly to coordinate all elements of the project affected by the submitted material. All submittals shall be clearly identified.
AS-BUILT DRAWING
As the work progresses, the Contractor shall record all as-built information of the construction and have the as-built information readily available to the County for inspection. At the completion of work, and prior to substantial completion inspection, the
Contractor shall submit two (2) redline drawings to the County for review and comment/approval. If comments are returned, the Contractor shall address all comments and resubmit redline drawings for review and approval.
Upon approval of the redline drawings by the County, the Contractor shall submit As-Built Drawings, signed and sealed by a Professional Engineer or surveyor licensed in the State of Maryland.
Requirements for the submission and approval of As-Built drawings are in Section 6.0. Final Inspection will not be held until the redlined drawings have been submitted by the Contractor and approved by the County.
CLOSEOUT DOCUMENTS
Upon completion of all work related to this project, the Contractor shall complete and submit to the County the closeout documents provided in Attachment C of this ITB. If required, the Contractor shall make any modifications to the information provided with the closeout documents at no additional cost to the County.
CLOSEOUT PROCEDURES
Closeout procedures will be as follows:
2.9.1 Substantial Completion Certification and Punch List
The County will issue a Certificate of Substantial Completion once MDE has approved the construction; redline As-Built drawings and draft O&M manuals have been approved; and the project can be placed into service for the beneficial use of the
County. The Certificate of Substantial Completion shall be included in the project punch list.
2.9.2 Warranty Period
The issue date of the Certificate of Substantial Completion shall signify the start of the warranty period for the project. The duration of the warranty period shall be 1 year or 365 consecutive calendar days.
2.9.3 Final Completion Certification
The County will issue a Certificate of Final Completion upon verification of completion of all punch list items, and upon receipt and approval of the final As-Built drawings and final O&M manuals.
2.9.4 Final Progress Payment
The County will make the final progress payment to the Contractor upon completion of the following items:
• Issuance of Certificate of Final Completion
• Submission of Close Out documents
• Demobilization, site restoration, and cleanup
2.9.5 Release of Retainage
The County will release retainage upon proof, or submission of a 1-Year Maintenance Bond. Proof of maintenance bond shall be via specific language in the performance bond or letter from the bonding company. In the absence of a maintenance bond, the County will hold the retainage for the duration of the 1-year bonding period. The County may allow for a partial release of retainage at the Contractor’s request and approval by the County.
PERMITS
The County is in the final stage of obtaining permits from the Maryland Department of the Environment (MDE) and Charles
County Development Services (CPIS) along with approval from the Charles Soil Conservation District for the expansion of the
Landfill. Permits will be provided to bidders via an addendum if they are received prior to the posting of the last bid addendum.
Work shall not commence until the said permits and approval are obtained.
LANDFILL HOLIDAY SCHEDULE
The following holidays are observed by the County Landfill:
1. New Year’s Day

4. Labor Day
5. Thanksgiving Day
6. Memorial Day
7. Christmas Day
3.0 PROJECT SUBMITTAL REQUIREMENTS
(TO BE PERFORMED AFTER BID SUBMISSION BY SUCCESSFUL BIDDER)
The following list of requirements shall be submitted during the course of this project:
a. General
i. Description of work of contractor proposed alternatives.
ii. Request for Information (RFI) for clarification of the Contract Drawings or Specifications
b. Schedule of values
c. Construction schedule
d. Survey and layout data
e. Shop drawings

GENERAL
a. Description of work of contractor proposed alternatives.
i. If the Contractor proposes alternative materials, sequencing of construction or any other item contrary to the
Contract Documents, the Contractor shall provide in writing justification of the proposed change including documentation of cost (increase or savings), details, the effect on the project schedule and pros and con points of implementing any proposed alternative.
b. Request for Information (RFI) for clarification of the Contract Drawings or Specifications
i. If the Contractor is uncertain of the meaning of any item in the Contract Documents and needs clarification as to the meaning, intent or further details, the Contractor shall in writing request a clarification no later than seven (7) days in advance of the implementation of the item into the work so as not to have an effect on the project schedule.
The request shall include a detailed description of the item in question and/or detail sketches to augment the request for information.
c. Two (2) Week Look Ahead Schedules
i. The Contractor shall prepare and submit a two (2) week look ahead schedule each Friday by 12:00 p.m. (Eastern
Time) to communicate the upcoming activities to the project team. The schedule shall clearly list all construction, inspection, and testing activities, and all other relevant items.
SCHEDULE OF VALUES
A schedule of values of the various parts of the work to be done under lump sum items shall be agreed upon by the Contractor and the Engineer. Forty-eight (48) hours prior to the kickoff meeting, the Contractor shall submit for approval a detailed proposed breakdown into construction categories of his lump sum price bid. This breakdown shall add up to the full 100% value of the lump sum price and all parts of it shall be covered by the performance bond. The approved breakdown shall be used for the purpose of arriving at a basis for monthly estimates. The schedule of value shall be tied to the cost loaded construction schedule.
CONSTRUCTION SCHEDULE
a. The Contractor shall submit the project schedule at least forty-eight (48) hours prior to the pre-construction meeting. The schedule shall be prepared utilizing the Critical Path Method (CPM) and cost loaded.
b. The general schedule will be discussed at the preconstruction meeting and copies made available to all interested parties.
No construction shall be permitted until the construction schedule has been accepted. The schedule shall breakdown each bid item task into manageable and measurable subtasks.
c. The schedule shall include separate tasks for submittal preparation and review, material fabrication and deliveries, testing, surveying, and inspections. Figure three (3) workdays for each MDE inspection. At a minimum, MDE will inspect the subgrade, the subbase clay layer, the geomembrane, the drainage layer, and the final project. Submission of testing and surveying reports shall be predecessor to all MDE inspections.
d. The schedule shall be monitored throughout the duration of the contract and shall be updated with copies provided by the
Contractor for each meeting attendee for review and discussion. The Contractor shall update the schedule on a monthly basis and submit the updates schedule to the Engineer along with the monthly pay request for progress meetings.
e. Any schedule revisions need to be reviewed and accepted by the owner.
SURVEY & LAYOUT DATA
a. The Contractor shall furnish the Engineer at least five (5) days prior to the start of construction two record copies of line and grade stake out data. The furnishing of such record data, despite any action or lack thereof on the part of the Engineer relative to the data furnished, shall in no way release the Contractor from his responsibility for the completeness and accuracy of stake out work necessary for construction.
b. All survey and stake out work shall be done by qualified persons. The Contractor is responsible for stake out of all facilities required by this contract within the prices bid.
c. Any benchmarks destroyed through or as a direct result of the Contractor's construction operations shall be replaced and/or restored at his expense with no additional cost to the Owner.
d. Work done by the Contractor without his having first established proper line and grade, or work done by him to incorrect line and grade, may be ordered removed and replaced at no increase in contract price.
SHOP DRAWINGS
a. The Contractor shall submit to the Engineer layout drawings for the installation and erection of the work and shop drawings for all fabricated or manufactured articles to be used in the work. The Contractor shall upload shop drawings as pdf files to the project’s SharePoint site for the Owner’s and Engineer’s review.
b. Detailed shop drawings shall include as many of the following as applicable: drawing, detail, section, sub-part, paragraph, sub-paragraph, sub-sub-paragraph to specifically identifying where the submitted equipment can be found in the Contract Documents; detailed materials lists and dimensional drawings, data, and literature for fabricated materials or equipment to be incorporated in the work. Include method for mounting for equipment and any alternations required due to removal, replacement or repair of existing equipment. Include all specific data that may be required for ascertaining the excellence and character of the equipment and the space occupied. Shop drawings shall be submitted to the Engineer for review for general compliance with the Contract Documents before fabrication. The Contractor shall obtain and check manufacturers shop drawings, certified prints and other pertinent data for conformance with all requirements with the Drawings and Specifications and in ample time to permit satisfactory progress of the work. After a completion of such check and verification by the Contractor, the Contractor shall sign or stamp such drawings, which stamp shall state as follows:

c. All data, drawings, and correspondence from subcontractors, manufacturers, or suppliers shall be uploaded to the
Project’s SharePoint site. The Engineer shall review only such data and details as are transmitted to him by the
Contractor. All correspondence from the Contractor to the Engineer shall refer to the appropriate section of these specifications containing the subject matter of the inquiry. The initial submittal review time is ten (10) working days and the resubmittal review time is 5 working days.
d. The Engineer's review of layout and shop drawings will be only to verify general compliance with Contract Documents.
Figure dimensions and other detail will not be checked. Any notation made on shop drawings by the Engineer shall be for the Contractor's guidance but shall not relieve the Contractor from his responsibility to re-check, verify and resolve items so noted. The Engineers review of shop drawings shall not relieve the Contractor from responsibility for errors or omissions thereon. Whether or not called to the attention of the Contractor by the Engineer.
e. The Contractor's attention is specifically directed to the fact that no work shall be fabricated, nor equipment or materials ordered, nor any construction performed prior to approval by the Engineer of shop drawings applicable thereto.
Construction performed in violation of this requirement will be neither approved nor certified for payment until applicable shop drawings have been submitted and approved. If any equipment or materials are ordered by the Contractor prior to submission and approval of shop drawings, he does so at his own risk.
f. The Engineer shall review at no charge shop drawings originally submitted and one resubmittal. Additional reviews resulting from improper submittal, lack of requested information, or disapproval shall be billed to the Contractor by the
Engineer per the County’s review fee schedule. The Contractor shall notify the Engineer in writing at the time of submission of any deviation in submittals from the requirements of the Contract Documents.
CERTIFICATES OF COMPLIANCE
Any certificates required for demonstrating proof of compliance of materials with the Specifications shall be uploaded to the
Project’s SharePoint site. Each certificate shall be signed by an authorized officer of the manufacturing company and shall contain the name and address of the Contractor, the project name and location, the quantity and date or dates of shipment or delivery to which the certificates apply. Copies of laboratory test reports submitted with certificates shall contain the name and address of the testing laboratory and the date or dates of the tests to which the report applies. Certification shall not be construed of relieving the Contractor from furnishing satisfactory material, if, after tests are performed on selected samples, the material is found not be meet the specific requirements.
SAMPLES
a. The number and type of samples submitted shall be specified in the section to which they apply.
b. Samples shall be physical samples to illustrate the materials and workmanship. They shall be submitted in sufficient size and quantity to clearly illustrate the functional characteristics of the product or material, with integrally related parts and attachment devices, and the full range of color to be provided.
c. All samples shall have been checked by and stamped with the approval of the Contractor, identified clearly as to material, manufacturer and any pertinent catalog numbers indicating the intended use.
DELIVERY TICKETS OF MATERIALS INCORPORATED INTO THE PROJECT
One copy of all delivery tickets for materials brought on site to be incorporated into the project shall be provided to the Engineer at the time of the material delivery.
CONSTRUCTION PHOTOGRAPHS
3.9.1 Photography Required
a. Take a comprehensive photographic and video survey of the existing facility and site(s) before beginning operations to be used to document the condition of the facilities prior to beginning work.
b. Video tape preconstruction and final construction.
c. Take photographs at one-month intervals during construction. Photographs of any month need only to show the new work for that month.
d. JPEG Files (if applicable) and video files become property of the Owner.
3.9.2 Costs of Photography
a. Contractor to pay all costs associated with photography, video files and JPEG files.
b. Should Contractor fail to deliver photographs on schedule, Owner will hire the photograph work and deduct cost from payments due the Contractor.
3.9.3 Delivery of Prints and Video Files
a. Before construction begins, upload files to Project’s SharePoint site.
b. Upload files to the Project’s SharePoint site on a monthly basis with monthly pay requests.
c. All uploaded files shall be labeled clearly and concisely.

RECORDS OF TESTING
a. The Contractor shall maintain records of all testing performed during the life of the project.
b. Records shall indicate the line, date of testing, persons involved in the testing and the results.
c. At the end of the project, or more frequently if requested, all testing records shall be uploaded to the Project’s SharePoint site.
OPERATION & MAINTENANCE MANUALS
a. While work is in progress, but prior to the 50 percent completion, the Contractor shall upload a searchable pdf of the manufacturer’s installation instructions, operations manual, and literature specific to the equipment to the Project’s
SharePoint site. The purpose of this submittal is,
i. to allow the Engineer and Owner to study the manual, and
ii. to allow the Engineer to review the manual for content consistent with submittal requirements and the Charles
County Standard Specifications (GP 5.04.8). The Engineer will review and will either approve or disapprove the manual with comments and will return one marked copy to the Contractor. If the manual is disapproved, Contractor shall upload the revision.
b. The Engineer’s review of operation and maintenance manuals shall not relieve the Contractor from responsibility for errors and omissions thereon, whether called to the attention of the Contractor by the Engineer. The Engineer shall review at no charge operations and maintenance manuals originally submitted and one resubmittal. Additional reviews and handling resulting from improper submittal, lack of requested information, or disapproval shall be billed to the
Contractor by the Engineer per the County’s review fee schedule. Only approved versions of manuals shall be incorporated into the complete project manual described in the paragraphs below.
c. Prior to the 80 percent completion, the Contractor shall upload a searchable and a fully linked and tabbed PDF version of a complete, project instruction manual in preliminary draft form to the Project’s SharePoint site. All comments generated by the Engineer during the review of the preliminary draft manual must be adequately addressed prior to submission of the final draft manual. The final draft manual must be received by the Engineer prior to scheduling the
Substantial Completion Acceptance inspection and issuance of Substantial Completion Acceptance. Upon approval of the final draft manual the contractor shall submit 3 hard copies and one (1) searchable and fully linked and tabbed PDF version of the final O&M Manual prior to the Final Acceptance inspection and the Final Certificate of Acceptance.
d. Project manuals should include a complete set of all approved shop drawing submittals for the Project. A table of contents shall be prepared indicating the submittal number and submittal description. All submittals shall be indexed by a reinforced divider with a typed tab indicating the submittal number.
e. Operating and maintenance information on all products. The data shall consist of catalogs, brochures, bulletins, charts, installation guides, schedules, equipment numbers, wiring diagrams and assembly drawings which shall describe location, operation, maintenance, lubrication, operating weight, lubrication charts showing manufacturing recommended lubricants for each rotating or reciprocating unit, recommended spare parts inventory and ordering information, and other necessary information for the Owner to establish a complete maintenance program.
f. Project operation and maintenance manuals shall be bound within a three-ring type plastic coated binder. Maximum size shall be 8-1/2" x 11" x 3". Multiple binders shall be labeled and organized into volumes. Each book or volume shall be titled to indicate its particular book or volume number and the total number of volumes per set (i.e., volume 2 of 12). The Contractor shall plan manual contents and shall “break” the data between volumes at reasonable locations so no loss in continuity of data presentation occurs. Each volume shall be labeled and organized into sections. Each section shall be for only one product. Section dividers shall be clearly labeled with tabs and custom embossed lettering.
Each binder shall be D-ring type with clear plastic pockets for full length and width of spline and cover, and sheet lifters.
Provide and insert custom, full insertion label for spine and cover. Coordinate with Owner for design of labels. Illegible data due to any cause, including poor copy quality or reduction, will not be accepted.
g. As a minimum the Contractor furnished O&M Manual shall include the following information:
i. Title page giving name and location of facility, Project Number, Contract number, General Contractor (name, address, and phone number), and design engineer (name address and phone number) and date.
ii. Tabbed index dividers with the name, address and phone number of the equipment manufacturer, supplier, subcontractors, installer, and authorized representative for parts and service.
iii. Manufacturer’s cuts and dimensional drawings. A list of spare parts including part numbers and other information needed to order parts.
iv. Principles of operation and routine maintenance instructions.
v. Piping and interconnecting drawings
vi. Complete parts list with parts assembly drawing, names and addresses of spare parts suppliers, and a list of recommended spare parts to be kept in stock. In addition, a complete listing of spare parts included in the original equipment purchase order and turned over to Charles County shall be included.
vii. Written warranties. Wherever a written warranty does not extend to the length of time covered under the
Contractors one year guarantee period, a written certification shall accompany each copy of a standard warranty, signed by the Contractor acknowledging the one-year warranty period as stated in this contract in lieu of any conflicts in the manufacturer’s standard warranty.
RECORD DRAWINGS
The Contractor shall keep one copy of the drawings at the site, in good order and provide mark-up to show all changes made during construction. These record drawings shall be updated monthly and available to the Engineer and shall be delivered to him upon completion of the contract. Record drawings shall contain stationing of all valves, bends, and fittings or dimensions from structures. They shall also contain all as-built elevations. Prior to substantial completion certification by the County, correct redlined as-built drawings are delivered to the Engineer and approved by the County.
4.0 TEMPORARY FACILITIES AND CONTROLS
GENERAL TEMPORARY FACILITIES
a. The Contractor shall furnish and maintain, during construction of the project, adequate facilities at the site for the use of the Owner, Engineer and himself as set forth below. Upon completion of the project, or as directed by the Engineer, the
Contractor shall remove all such temporary structures and facilities from the site and leave the premises in the condition required by the Contract.
b. The Contractor and his subcontractors may maintain temporary facilities on the site in addition to those specified as may be necessary for the proper conduct of the work. These shall be located so as to cause no interference to any Contract work.
TEMPORARY SANITARY FACILITIES
a. Construct or provide portable toilet facilities to provide natural light and ventilation, or artificial light and mechanical ventilation.
b. Provide adequate temporary outside toilet facilities for the use of people working at site.
c. Maintain toilets clean and in sanitary condition. Provide toilet tissue in a suitable holder.
d. Remove temporary toilets when suitable facilities are available within the building or when construction is complete.
TEMPORARY WATER SERVICE
a. Permanent-type connections may be made by the Contractor for his use if piping is returned to its original condition at completion.
b. Take positive measures to preclude cross-connections and backflow.
c. The Owner will assume the cost of water consumed for sanitary facilities if responsible care and restraint is exercised by the Contractor in their use.
TEMPORARY ELECTRICAL SERVICE
The Contractor shall make all necessary arrangements for temporary electricity for construction purposes, and furnish at his own expense all temporary wiring, lamps, and accessories required for the completion of the work. Costs for electrical service shall be paid by the contractor.
TEMPORARY HEATING
a. The Contractor will provide safe, clean temporary heating for the work of each trade for the entire project duration when required for proper installation of materials and working conditions, except as noted below.
b. The Contractor shall pay costs of equipment, maintenance and fuel for all temporary heating operations.
c. Open fires are not permitted.
d. Methods of temporary heating shall be approved by the Owner and all governing agencies having legal jurisdiction.
EXISTING UTILITIES
Prior to the closeout of the Project, the Contractor shall remove all temporary connections and return all sources to their original conditions prior to commencement of the work.
TEMPORARY APPROACHES
The Contractor shall provide all necessary temporary approaches and exits as required to properly execute the work, and as indicated on the Drawings.
The Contractor shall keep streets, drives, walks, and corridors, adjacent to and on the site, clean of all dirt, debris and litter caused by construction operations for this project. A clean-up shall be accomplished at the end of a days’ work.
DUST CONTROL
The Contractor at his expense shall maintain periodic wetting of the haul roads etc. for dust control and maintain access to the work areas for inspection. At any time, the Engineer deems that dust is excessive due to hauling and construction activity, the
Contractor will provide the equipment, manpower and material necessary to abate the issue.
5.0 SCOPE OF WORK
The Contractor shall not commence construction activities on this project prior to receiving a written notice from the County.
This notice will only be in the form of an official NTP letter from the County. Any other form of authorization for the start of work on this project does not constitute approval by the County.
The Scope of Work for this project includes but is not limited to the furnishing of all coordination, scheduling, supervision, labor, tools and equipment, materials and supplies, incidentals and appurtenances, and mobilization/demobilization, protection of adjacent properties and restoration of any area disturbed as required for the construction and full function of Sub cell 4B
(Phase 1) as shown on the project drawings and specifications provided in Section 4.0. All work under this contract shall comply with all applicable Sections of the Charles County Government Department of Planning and Growth Management
Standards and Specifications for Construction, Charles County Standard Detail Manual and all other applicable requirements of the County, the Maryland Department of the Environment (MDE) and any other regulatory agency having jurisdiction to control, limit or otherwise regulate the performance of the work.
The Construction Specifications located in Section 4.0 are hereby included in the Scope of Work. Prices provided by the bidder on their submitted Bid Form shall be based on the corresponding bid items as further described in the Scope of Work Section under General Requirements of the Construction Specifications located in Section 4.0.
The Bid Form establishes the lump sum price or unit price to be paid for each bid item. The Bidder agrees that the prices represent a true measure of the labor, materials, and services required to provide the specified item, including allowances for overhead, profit, and bonding for each type and unit of work provided.

5.1.1 Bid Item A4B: Excavation and Stockpiling Clarification
NOTE: The County has accomplished some excavation of the site prior to award of the contract which could reduce the total cubic yards to be excavated and stockpiled by the Contractor. For Bidding purposes use the quantities on the Bid Sheet. The quantities shall be paid per the CY of excavation required on the site.

PART B – GENERAL PROVISIONS
1.0 GENERAL PROVISIONS
Any provision specified in this section and addressed elsewhere in the solicitation; ATTACHMENT A, Part A – SPECIAL
PROVISIONS shall supersede.
DEFINITIONS
BID: Response submitted to this solicitation, and shall be synonymous with the terms “offer”, “proposal”, “quote’, etc.
BID BOND: The security to be furnished by the bidder as a guaranty of good faith to enter into a contract with the COUNTY for the proposed work if such work is awarded to him.
BIDDER: The person or persons, partnership, firm or corporation submitting a quote/bid/proposal for the work contemplated.
COMMISSIONERS: The County Commissioners of Charles County.
COUNTY: The County Commissioners of Charles County, Maryland.
CONTRACT: The written agreement executed by the County Commissioners of Charles County and the successful bidder, covering the performance of the work and the furnishing of materials required in the construction of the project. The contract shall include instructions to bidders, proposal, general specifications, special provisions, drawings, performance bond, extra work orders and any other written instructions pertaining to the method and manner of performing the work.
CONTINGENT ITEM: Any item listed on the plans or called for in the Special Provisions and included in the Bid merely for the purpose of obtaining a contract price in case it may be needed.
CONTRACTING OFFICER: The Director of the Using Department and includes a duly appointed successor or authorized representative.
CONTRACTING AUTHORITY: The County Commissioners of Charles County.
CONTRACTOR: The person or persons, partnership, firm or corporation who enters into a contract awarded to him by the
COUNTY.
DEPARTMENT: The authorized division or agency of Charles County Government responsible for the service or work for which the contract will be written.
DAYS: Calendar Days
DRAWINGS: All drawings or reproductions there of pertaining to the construction of the work which are approved by the
CONTRACTING OFFICER.
EXTRA WORK: A written order to the CONTRACTOR and signed by the CONTRACTING OFFICER, ordering a change in or an addition to the work from that originally shown by the drawings and specifications.
GENERAL PROVISIONS: All requirements and provisions contained in this document.
OWNER: The entity holding title or having vested interest in the property and rights associated with the property.
PAYMENT BOND: The approved form of security executed by the CONTRACTOR and his surety, guaranteeing payment of all labor, materials, supplies, and rental of equipment reasonably required and used or consumed in the performance of the contract.
PERFORMANCE BOND: The approved form of security executed by the CONTRACTOR and his surety, guaranteeing complete execution of the contract.
PROPOSAL: The written offer submitted by the bidder in the required manner to perform the work contemplated.
SPECIAL PROVISIONS: Statements modifying or changing the requirements or provisions of the General Specifications or adding new requirements or provisions thereto.
SPECIFICATIONS: The General Provisions, Special Provisions, and all written or printed agreements and instructions pertaining to the performance of the work and to the quantity and quality of the materials to be furnished under the contract.
INDEMNIFICATION CLAUSE
The Contractor shall protect, hold free and harmless, defend and indemnify Charles County, including its officers, agents, and employees from all liability, penalties, costs, losses, damages, expenses, causes of action, claims or judgments, including attorney’s fees, resulting from injury to, or death of, any person or damage to property of any kind, which injury, death or damage arises out of, or is any way connected with the performance of the work under this contract. This agreement shall apply to any acts or omissions, negligent conduct, whether active or passive, including acts or omissions of contractor’s agents or employees; except that this agreement shall not be applicable to injury, death or damage to the property arising from the sole negligence of Charles County, it’s officers, agents and employees.
GOVERNING LAW
This Contract shall be governed by and construed only in accordance with the laws of the State of Maryland.
PAYMENT OF TAXES
The firm awarded the contract resulting from this solicitation shall be responsible for paying all Maryland sales tax, and any other applicable taxes, on items purchased by the Contractor in the pursuit of this contract. The County tax exempt status cannot be transferred to the Contractor.
SPECIFICATIONS AND DRAWINGS
The CONTRACTOR shall keep on the work site a copy of the drawings and specifications and shall at all times give the
CONTRACTING OFFICER access thereto. Anything mentioned in the specifications and not shown on the drawings or shown on the drawings and not mentioned in the specifications, shall be of like effect as if shown or mentioned in both. In case of difference between drawings and specifications, the matter shall be promptly submitted to the CONTRACTING OFFICER, who shall promptly make a determination in writing. Any adjustment by the CONTRACTOR without such a determination shall be at its own risk and expense. The CONTRACTING OFFICER shall furnish from time to time such detailed drawings and other information as he may consider necessary, unless otherwise provided.
CHANGES
A. The CONTRACTING OFFICER may, at any time, without notice to the sureties, by written order designated or indicated to be a change order, make any change in the work within the general scope of the contract, including but not limited to changes:
(1) In the specifications (including drawings and design);
(2) In the method or manner of performance of the work;
(3) In the COUNTY furnished facilities, equipment, materials, services, or site; or
(4) Directing acceleration in the performance of the work.
