The use of the authority cited below:
[X] AMC 1. Suitable for competitive acquisition for the second or subsequent time.
The use of the authority cited is based on:
[X] AMSC R. The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.
Ibis Tek (1SC69) and Cadillac Gage Textron dba Textron Systems (10237) are the only known sources that have the data necessary to manufacture these items. On January 31, 2019, DLA Land and Maritime SAPD Product Specialist confirmed that the AMSC of R for both NSNs are correct and validated the manufacturers and part numbers. They also stated we do not have a complete, unrestricted data package at this date and all means to obtain a technical data package adequate for manufacture of these items have been exhausted.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
[x] The acquisition will be synopsized on or about April 15, 2019.
[x] Dealers of the manufacturers will be solicited.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable. In the event adequate competition is not received, cost or pricing data in accordance with FAR 15.403-4 will be requested for the purpose of an audit. In addition to any audits completed, the contracting officer will use price analysis and buy history to determine that the contract award prices are fair and reasonable. In the event manufacturer competition is received, this will be used along with price analysis and buy history to determine that the contract award prices are fair and reasonable.
8. Market Research/Efforts to Obtain Competition:
Initial market research was conducted by the Sourcing Strategy Branch- ZAA. On 9/10/18, the Sourcing Strategy Specialists (SSS) sent out the market survey to Textron Sytems (10237) and Ibis Tek (1SC69). The market survey asked information such as willingness to quote a three-year base period and priced option years, provide stock delivery, state if the items are quantity sensitive, state if the items are commercial, preference for zones, asked if they could provide packaging requirements, asked information regarding FOB and zones.
Follow-ups were sent on 11/17/18.
On 4/11/19, a source sought notice was issued on Fed Biz Ops for a period for seven days. This notice stated that these items are purchased in accordance with approved CAGE and part numbers and there is no technical data available; however, if there is a company that can manufacture these items, the Government is requesting they submit their information with a completed market survey. As of 4/18/19, there were no responses to this notice.
Market Research Responses:
1. Textron Systems (10237) - [large business manufacturer] - responded on 11/26/18, that Cadillac Gage Textron has now entered into an exclusive distributorship agreement with Brighton Cromwell.
2. Ibis Tek (1SC69) - [small business manufacturer] - responded on 11/21/18, indicating an interest in offering on a LTC.
. Indicated item is not commercial.
3. Brighton Cromwell (3NNX8) - [small business dealer offering Textron part] - responded on 12/7/18, with a completed market questionnaire, but no spreadsheet. Indicated they would be interested in offering on a LTC. Item is not commercial.
9. Additional facts supporting other than full and open competition are:
[X] Based upon the technical certification on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government. A tech certification dated 1/31/19, is placed in the contract file.
10. A listing of sources, if any, indicating an interest in the acquisition is:
Ibis Tek (1SC69) and Brighton Cromwell (3NNX8)
11. The following actions are being taken to identify additional sources:
[X] The solicitation contains Procurement Note L04- Offers for Part Numbered Items.
12. The buyer searched the previous awards listed in the contract history in Records Management in EProcurement for previous J&A’s, as required by DFARS PGI 206.304, and was able to locate the previous J&A for contract SPE7MX18D0075; is attached.
