SOLICITATION SPE7MX-18-R-X031

1. The Defense Logistics Agency, DLA Land and Maritime is the contracting activity.
2. The action being approved is the acquisition of the following supplies based on other than full and open competition: Audio Frequency Amplifier, Battery Charger, and Storage Battery for a naval vessel.
3. The supplies required to meet the using activity's needs are as follows:

Weapon system: Line Item 0001 (Amplifier, Audio Fre), Line Item 0002 (Charger, Battery) and Line Item 0003 (Battery, Storage) all support the Navy’s Ohio Class SSBN (Trident).

4. The statutory authority permitting other than full and open competition is 10 U.S.C.
2304(c)(1) - Available from only one or a limited number of sources.
Brief narrative supporting the situation and weapon system: Scott Technologies, Inc. (15927) dba Scott Safety) is the approved source and manufacturer of record for these NSNs which support the Trident submarine (Ohio Class SSBN). Although the supplier confirmed in an email dated April 5, 2018 that CAGE U1754 (Scott Safety Limited in the United Kingdom) is still a valid CAGE for NSN 5996-01-564-6557, the AMPL (Approved Manufacturer’s Parts List) shows this CAGE as a blocked source. Steps are currently being taken to correct that, and both Scott Safety CAGES (15927 and U1754) will be included on the email list for notification.
Procurement history, going back to 2013, shows the Government has only purchased NSN

5996-01-564-6557 from CAGE 15927 (Scott Technologies, Inc.) Past buy history indicates that both CAGE 1RCC8 (Pointer Technologies) and CAGE 15927 received awards for NSNs 6130- 01-502-2066 and 6140-01-502-2053. An April 27, 2017 email from Pointer Technologies indicates they are no longer a distributor for the part and states the part can be acquired from Scott Technologies.
5. If restricted to the only source of supply include source name and CAGE code: The approved source of supply is Scott Technologies, Inc. (CAGE 15927). Any company offering products other than the aforementioned approved source would need to get part numbers approved. In a memo dated October 18, 2017, Product Specialist confirmed the AMC/AMSC codes as listed in the table on Page 1. The approved source is uniquely qualified to supply the NSNs coded AMSC D because it is the only source with the data rights necessary to manufacture these NSNs. The approved source is uniquely qualified to supply the NSN coded AMSC Z because the approved source has material available for this item; the Government knows of no other sources, nor is technical data available.

[X] AMSC Z. This part is a commercial/non-developmental/off-the-shelf item. Commercial item descriptions, commercial vendor catalog or price lists or commercial manuals assigned a technical manual number apply. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 and 2 are valid.
[X] AMSC D. The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
[X] The acquisition will be synopsized at least two weeks prior to solicitation.
[ X ] Dealers of the manufacturers will be solicited.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable. Although this acquisition meets the threshold requirement for Certified Cost or Pricing Data, the contracting officer has determined that this item is commercial. In accordance with FAR 15.403-1(b)(3), the applicable clauses were not incorporated into the solicitation. A price analysis will be conducted using commercial market pricing, historical government pricing, the Producer Price Index (PPI) and learning curve analysis. Other than cost or pricing data will be requested if needed.
8. Describe the market research conducted and the results:

Names of vendors contacted and that responded: Scott Technologies, Inc. completed and returned the market survey. Pointer Technologies provided an email statement saying they no longer distribute the charger and battery.
Scott Technologies was asked to respond to a market survey sent out on April 25, 2017. Scott Technologies submitted a market survey response on May 1, 2017. Procurement history shows Scott Technologies has provided these NSNs since at least these dates: 2013 for 5996-01-564- 6557; and 2016 for 6130-01-502-2066 and 6140-01-502-2053.
Techniques used to conduct survey:
A Market Research form was sent by email to the above-stated vendor.
The vendor was contacted electronically.
A sources sought was posted on FedBizOpps on April 25, 2017 with a response date of May 2, 2017. The sources sought posting resulted in no additional companies expressing interest in making a proposal on this acquisition.
Reviewed previous buys.
No additional sources were found.
Types of information requested: The market survey requested vendor(s) state if phased delivery would be required, state if the item is commercial, indicate the amount of option years they would be willing to accept; asked what components/raw materials impact pricing, whether they could provide the required marking for packaging, and if FOB Destination would be acceptable if required. The Market Survey addressed fixed pricing; however, the contractor had the option to decline fixed pricing.
Summary of information received:
Scott Technologies:
Scott Technologies (15927), a domestic, large-business manufacturing source, is interested in providing a proposal for a long-term contract for these items.

Information received regarding the commerciality of the item: On the market survey, Scott Technologies indicated these items are commercial. The buyer researched SAP and the material master, and obtained unredacted invoices from the supplier showing commercial sales, as well as, GSA schedule information. Additionally, assistance was obtained from BP and the DCMA Commercial Items Group for a commerciality recommendation. The Contracting Officer has determined these three NSNs are commercial products.
9. Additional facts supporting other than full and open competition are:
[X] Based upon the technical certification on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
10. A listing of sources, if any, indicating an interest in the acquisition is: Scott Technologies, Inc. (CAGE 15927).
11. The following actions will be taken to identify additional sources:
