The use of the authority cited is based on:
[X] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. 8. I hereby determine that the anticipated cost to the Government will be fair and reasonable.
Price analysis will be conducted for this acquisition to deem the prices fair and reasonable as required by FAR 15.403-4. The price analysis will consist of utilizing the historical prices and adjusting them based on the PPI Index. The price will be adjusted utilizing learning curves to determine the Government low and high targets for this acquisition.
9. Market Research/Efforts to Obtain Competition:
A Sources Sought was posted on FedBizOps on February 26, 2018, one response was received from
In addition to the sources sought, market surveys were sent to 4 distributors as well as the approved source Donaldson Company.
Brighton Cromwell (3NNX8) and Drive Line (0GE52) expressed interest in a 1 year contract. Kampi Components stated that they were no longer able to obtain quotations from The Donaldson Company as they are not an authorized dealer. The Donaldson Company responded to market research inquiries and stated that they could only offer their distributors stable pricing for one year, they also stated that they preferred to provide the product via their distributors.
Techniques used to conduct survey [X] Market Research was e-mailed to previous buy history providers and the approved source. Phone calls were also made in instances where emails were not returned.
Information received regarding the commerciality of the item(s):
The Approved Source, Donaldson Company stated that this item is not commercial as the products were designed specifically for the Government vehicle that they go on, so they are not COTs, they are built to order. Donaldson also stated that this NSN is not built on the same production lines as their other commercial items. The DCMA Commercial Item Group as well as the BP Pricing Office were contacted to assist with determining commerciality.
Both offices compiled two reports that stated this NSN is not a commercial. This NSN was deemed noncommercial as the part is not available for sale in the public marketplace and the inability to gather contractor information about the part numbers. The DCMA Engineering Analysis Report states that the non-commerciality finding can be reexamined if Donaldson is willing to provide detailed specifications to review for, fit, and function.
10. Additional facts supporting other than full and open competition are:
[X] Based upon the technical certification on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
