JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION

DLA Land & Maritime Justification for Other Than Full & Open Competition (May 2018)

[ X ] AMSC R. The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.

Meritor Industrial Products, LLC (CAGE 3D6E9) and Meritor Heavy Vehicle Systems, LLC (CAGE 78500) are uniquely qualified because they are the only known sources with the data or rights to the data necessary to manufacture the item. Product Specialist certified that the supporting data, including the AMC/AMSC codes and approved sources, are accurate and complete. He also indicated that it has been determined that it is uneconomical for the Government to purchase the data rights and that all means to obtain a technical data package for manufacture of this NSN have been exhausted. The Product Specialist’s certification is Attachment #2.

Efforts to ensure that offers are solicited from as many sources as practicable are:

a. The acquisition was synopsized on 06/21/2020 for a period of 15 days.

b. The manufacturers listed above will be solicited.

c. At the conclusion of the synopsized period the solicitation will be posted to the DLA Internet Bid Board System (DIBBS) for a period of 15 days.

7. The cost to the government is anticipated to be fair and reasonable. The Certified Cost or Pricing Data clause will not be in the solicitation because the contract award amount is less than the TINA Threshold, $2 million in accordance to FAR 15.403-4. A price analysis will be conducted using historical government pricing, the Producer Price Index (PPI) and learning curve analysis. Based upon the above techniques, the Contracting Officer hereby determines that the anticipated cost to the Government will be fair and reasonable.

8. Market Research/Efforts to Obtain Competition:

a. The acquisition is synopsized on 06/21/2020 for a period of 15 days.

The results of the market surveys are detailed below. A Sources Sought notice was posted on the Beta SAM website on 05/21/2020 and no one responded.
