About this file
This document is a Justification for Other Than Full and Open Competition (FAR 6.302-1) for an Indefinite Delivery Contract issued by the Defense Logistics Agency (DLA) Land and Maritime. The solicitation (SPE7LX25RX021) is for a Connecting Link, Rigid (NSN 3040013874048) associated with the Floating Causeway weapon system, with an annual demand quantity of 9,339 units. The contract will have a 5-year base period with no option periods, and is restricted to specific approved sources including Spencer Industries, Inc., Peck & Hale LLC, and Kondor Technologies, Inc.
The justification cites 10 U.S.C. 3204(a)(1) as the statutory authority, specifically noting AMSC C classification, which requires engineering source approval to maintain part quality. Market research was conducted through a Sources Sought Notice, emails to potential vendors, and internet searches, which yielded limited responses. Nexgen Composites LLC was the only additional company expressing interest. The solicitation will be synopsized for 5 days, posted on the DLA Internet Bid Board System for 10 days, and includes provisions for vendors to submit alternate offers. The total contract value is not explicitly disclosed, but a price analysis will be conducted to ensure fair and reasonable pricing.

5. The Government requires spare parts that are form, fit, and functionally interchangeable with those currently used on the supported end item or weapon system. The acquisition is restricted to the following source(s) of supply, which are the only source(s) known to have the capability of furnishing the required supplies and the only source(s) currently approved by the design control activity.
Spencer Industries, Inc. (21530) SPN00464
The use of the authority at 10 U.S.C. 3204(a)(1) is based on:
[ x ] AMC 1. Suitable for competitive acquisition for the second or subsequent time.
The following AMSC descriptions are available in DFARS PGI 217.7506 Part 2.
[ x ] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.
On 4 March 2025 the Product Specialist of record certified the accuracy of the approved source(s) and applicable AMC/AMSC codes. A copy of the certificate is attached. On 2 April 2025 the Product Specialist of record certified the accuracy of the approved source(s) and applicable AMC/AMSC codes after the Product Specialist removed Charleston Marine Containers Inc. (09PD1) as a source on 19 March 2025.
6. The following efforts are being taken to ensure that offers are solicited from as many sources as practicable:
[ x ] The acquisition will be synopsized on or about 1 April 2025 for a period of five days.
[ x ] Dealers of the approved source(s) will be solicited.
[ x ] The solicitation will be posted to the DLA Internet Bid Board System for a minimum of 10 days.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

Certified cost or pricing data, when required by FAR 15.403-4, and data other than certified cost or pricing data, will be requested and obtained as necessary to establish a fair and reasonable price, and a cost analysis may be performed on the data submitted.
