X ORIGINAL

1. The Defense Logistics Agency, DLA Land and Maritime is the contracting activity.

2. The action being approved is the acquisition of the following supplies based on other than full and open competition: Battery, Nonrecharge.

3. The supplies required to meet the using activity's needs are as follows:

Identify end item, weapon system, or class of item:

Weapon systems: Line Item 0001 (Battery, Nonrecharge) supports the Stratofortress, B-52.

ESTIMATED ANNUAL VALUE:

ESTIMATED TOTAL VALUE (3-yr base, 2 option years):

MAXIMUM CONTRACT VALUE: : (ADV x 7.5 (multiplier)

4. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.

Brief narrative supporting the situation and weapon system: Companies listed in the table on Page 1 are the only approved sources of record for NSN 6135-01-340-8836 (which supports the Stratofortress, B-52). Procurement history shows the Government purchased NSN 6135-01- 340-8836 from two different vendors since 2013 (multiple vendors submitted offers).

5. If restricted to the only source of supply, include source name and CAGE code: There are multiple sources of supply. (Please see table on Page 1.) Any company offering products other than the aforementioned approved sources would need to get its part numbers approved. On July 17, 2020, a product specialist confirmed the AMSC code as listed in the table on Page 1.

The technical codes indicate these are the only approved sources and are uniquely qualified to supply the NSNs coded AMSC C because acquisition of this part is restricted to source(s) receiving engineering source approval by the design control activity or to maintain product quality.

Source Selection Information – See FAR 2.101 and 3.104 -- For Official Use Only Page 2 of 4

The use of the authority cited below (see table on Page 1 for AMC breakout for this NSN):

[X] AMC 1. Suitable for competitive acquisition for the second or subsequent time.

The use of the authority cited below (see table on Page 1 for AMSC breakout for this NSN):

[X] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity’s procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity’s procedures, AMCs 1 or 2 are valid.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

[X] The acquisition will be synopsized at least two weeks prior to solicitation.

[X] Dealers of the manufacturers will be solicited.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable. Certified cost or pricing data, per FAR 15.403-4(a)(1) will not be required as the acquisition is estimated to fall below the $2 million threshold currently in place. The buyer will utilize price analysis based upon previous buy price history, Producer Price Index (PPI) and learning curve analysis to establish Government Targets. By using the above techniques, the Contracting Officer anticipates that the costs to the Government will be fair and reasonable. This requirement will include a three-year base with two, one-year option periods. Other than cost or pricing data will be requested if needed.

8. Describe the market research conducted and the results:

A sources sought was posted on FedBizOpps on July 9, 2020 and closed on July 16, 2020. One company indicated an interest in submitting a proposal and asked to be added to the bidder’s list for the solicitation.

There are three approved sources for this code and part-numbered item: Battery Specialties (CAGE 6W468), General Dynamics OTS (Aerospace) (CAGE 21562) and Steller, Inc. (CAGE 0EHC8). A CAGE search of these vendors was conducted in SAM. An effort was made to update the market survey information on file because the most recent market survey received from Battery Specialties is from July 16, 2018. The vendors were asked to complete market surveys (per an email dated July 9, 2020), but none were received. Follow-up did not improve results. The email address for two of the vendors (Steller, Inc., CAGE 0EHC8 and Battery Specialties, CAGE 6W468) returned as invalid; there are no records for CAGE 0EHC8 in SAM.

Source Selection Information – See FAR 2.101 and 3.104 -- For Official Use Only Page 3 of 4

The 2018 market survey information from Battery Specialties (CAGE 6W468) is as follows: Battery Specialties indicated it is a small business manufacturer and confirmed they actually manufacturer this part. The vendor stated they are interested in a long-term contract

Battery Specialties indicated this item is not commercial.

Previous acquisitions were determined non-commercial.

A search of the internet was done and there is no clear evidence that this item is sold to other than the military.

• Item is not commercially price listed.

• There are no known commercial applications.

NSN is not coded with an AMSC code of “Z”.

The Acquisition Specialist searched the GSA Schedule for NSN 6135-01-340-8836 on

July 28, 2020 for the approved part numbers and sources, and no information was found. The one battery that popped up in an NSN search was for an item produced by an unapproved source. This information was insufficient to prove commerciality of the approved parts.

Reviewed previous buys, including the results of prior market surveys as summarized in the Acquisition Plan of a prior LTC (SPM7LX13D0087).

No additional sources were found.

9. Additional facts supporting other than full and open competition are:

[X] Based upon the technical certification on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

10. A listing of additional sources, if any, indicating an interest in the acquisition is:

Research into prior procurements show that long-term contract (LTC) SPM7LX13D0087 received offers from two (2) vendors (one was received late from an approved source and was not considered). Multiple offers offering product of the approved sources is anticipated. Previous offerors will be included in the mailing list.

11. The following actions will be taken to identify additional sources:

[X] The solicitation contains the DLAD Procurement Notes L04 Offers for Part Numbered Items and M06 Evaluation of Offers for Part Numbered Items.

[X] Past awardees will be contacted to ensure their awareness that the solicitation has posted to

DIBBS.

12. SPM7LX13D0087 is the most recent LTC, and there was no J&A on file for this procurement.
