4. The statutory authority permitting other than full and open competition is:

(x) 10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources.

5. If restricted to the only source(s) of supply, include source(s) and CAGE code:

Benchmade Knife Co. (041N2) part# 176BK-COMBO, 1768BKSN-COMBO, 375BK, and 375SN is currently the only ESA approved source for the NSN(s) listed in Section #3 above.

The use of the authority cited in other than 10. U.S.C. 2304(c)(1) above:

(x) AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.

The use of the authority cited is based on:

(x) AMSC Z. These parts are commercial/non-developmental/off-the-shelf items. Commercial item descriptions, commercial vendor catalog or price lists or commercial manuals assigned a technical manual number apply. If one source is available, AMCs 3, 4, or 5 are valid. The NSNs listed in Section #3 above are available only from the coded source Brenchmade Knife Co. (041N2).

At this time, only Benchmade Knife Company (041N2) has been identified as having the proper complete technical data and manufacturing expertise to supply these approved items to DLA and the using military services (per the approved manufacturer part list for this NSN in SAP, supplied by the Defense Logistics Information Service).

These items were determined commercial by the Contracting Officer and meet part one of the commercial item definition at FAR 2.101. Although commercially available, the Government does not currently possess, and Benchmade has not made public, adequate salient physical, functional, or performance characteristics for each NSN that an “equal” item must meet to be acceptable for award or for full & open competition under a “Brand Name or Equal” specification in accordance with FAR 52.211-6, Brand Name or Equal. Benchmade Knife Company has successfully provided these knives to DLA through its approved dealers going back to 2013.

These skeletonized tactical Benchmade knives are key for ground force self-defense and feature proprietary designs that allow the user to maintain dexterity while manipulating other objects without putting down the knives thereby reducing soldier’s defensive capabilities. The knives also include specialized jump rated sheaths with Tek-lok attachment systems that integrate into Molle compatible field gear and webbing while keeping a low profile. NSN 1095-01-609-1246 and 1095-01-609-1266 also include an additional exclusive skeletonized steel training dagger.

DLA Land and Maritime SAPD Product Specialist Ashley Roberts reviewed the project NSNs on 04/17/2019 and confirmed the accuracy of the PID, AMC/AMSC, approved sources, and associated NSN information prior to solicitation.

The approved source information for these NSNs are as follows:

The basis for the Government’s fair and reasonable price determination is anticipated to be PPI based price analysis and/or the analysis of other than cost or price data such as informal cost break-downs and/or material invoices with final negotiated pricing reviewed in comparison with recent past buy history and publically available commercial pricing.

8. Market Research/Efforts to Obtain Competition:

Alternatively, if it is necessary to limit the required sourcing to Benchmade Knife Company (041N2), the PSOR is requested to explain the specific characteristic or functions making the listed CAGE and Part Numbers essential to the Government’s requirements. In accordance with the requirement of DFARS PGI 206.303-2, the Contracting Officer reviewed the most recent procurement, SPE7LX16D0060, and is providing a copy of its J&A document to the approving authority to assist in determining whether the planned actions to remove any barriers to competition cited on the previous justification were completed.
