Project# CM16048004 was temporarily put on hold due to a mandatory technical review of the NSN. Buyer received updated data pull information dated February 11, 2019, and made the following adjustments to the existing Justification:

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.

2. The action being approved is the acquisition of supplies on other than full and open competition basis.

3. The supplies required to meet the using activity’s needs are described as follows:

4. The statutory authority permitting other than full and open competition is:

[X] 10 U.S.C. 2304(c)(1) - Available from only one or a limited number of sources. This NSN has an Acquisition Method Code/Acquisition Method Suffix Code(s) (AMC/AMSC) of 3/C. L3 Technologies, Inc. dba Randtron Antenna Systems (50643) is the Sole Source for this item. L3 is the only known firm that possesses the technical data, drawings, and specifications necessary to fulfill the Government’s requirements and no other responsible source can supply this item to satisfy agency needs.

5. If restricted to the only source(s) of supply, include source(s) and CAGE code: L3 Technologies, Inc. dba Randtron Antenna Systems (50643).

The use of the authority cited below:

[X] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.

The use of the authority cited is based on:

[X] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

Price analysis will be conducted for this acquisition to deem the prices fair and reasonable in accordance with FAR 15.404-1. The price analysis will consist of utilizing the historical prices and adjusting them based on the PPI Index. The price will be adjusted utilizing learning curves to determine the Government low and high targets for this acquisition. The offeror(s) may be requested to submit information other than cost and pricing data to determine price reasonableness. Certified Cost and Pricing Data is not required as the acquisition is below the Truth in Negotiations Act (TINA) threshold.

8. Market Research/Efforts to Obtain Competition:

An initial Sources Sought was posted on FBO on July 19, 2017; no responses were received. An updated Sources Sought notice was posted on FBO on November 29, 2018, which also yielded no responses.

An analysis was performed of the information in Haystack to review the procurement history and whether any similar items may be available for comparison for the price analysis or to allow for enhanced competition. The information in Haystack indicated that this is a sole source part provided by L3 Technologies and does not indicate that it was previously sourced to any other vendors. No similar items were found in Haystack.

Buyer contacted Small Business Office on October 24, 2018, for assistance to locate small business sources. The SBO responded on November 5, 2018, that additional Small Business sources were unable to be located.

In addition, a market survey was sent to L3 Technologies on February 17, 2016, and a response received from

, Applications Engineer, Business Development, Randtron Antenna Systems, on March 1, 2016.

Buyer sent email, and L3 Technologies confirmed, on October 25, 2018, that information is still current and correct. Approved Code and P/N is as follows: 50643 / 21675-3. See details below.

Summary of Market Survey Information Sent:

Types of information requested: The market survey requested that companies provide answers to general questions regarding their company size and status, the existence of a parent company, and EDI capability. Long Term Contract related questions asked included: whether the company is interested in an LTC, if a three-year base period with two one year options is acceptable, whether Firm Fixed Price is acceptable, and whether the item is listed on a GSA Schedule. The Market Survey requested whether the offerors would be able to provide Cost and Pricing Data. Other questions asked included: whether it would be beneficial to combine NSNs, whether the product is commercial, whether prices were published, whether prices would be included for transportation charges if the item requires FOB Destination, and whether the government would see any savings. Delivery questions were asked regarding phased delivery and maximum quantity.

Summary of Market Survey Information Received:

L3 is a large manufacturing company that is interested in a contract, .

L3 indicated on the survey that the item is not commercial IAW FAR 2.101(b).

Information received regarding the commerciality of the item:

L3 Technologies indicated that the item is not commercial, were not able to provide published catalogs/prices, and indicated that item is not available to the public. On October 25, 2018, buyer sent email to Product Specialist to inquire about commerciality of the NSN. Product Specialist indicated that item contains classified technologies and a DD254 applies. Due to part of the item being classified, Product Specialist cannot provide specifics as requested.

The item is used on the Stratolifter Aircraft, which is considered a Government only vehicle and exclusive to this weapon system.

9. Additional facts supporting other than full and open competition are:

[X] Based upon the technical certification, dated July 24, 2018, on file in DLA Land and Maritime – VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

10. A listing of sources, if any, indicating an interest in the acquisition is: L3 Technologies, Inc. dba Randtron Antenna Systems (50643).
