SPE7LX18R0076 - 0001

This Amendment 0001 is being issued to re-open Solicitation SPE7LX18R0076 and to add clause DFARS 252.225-7013 DUTY- FREE ENTRY (MAY 2016). This clause is added due to the increasing cost of tariffs. Duty is the same thing as the Tariff. The difference is Tariff is the percentage and Duty is the cost in dollars. Unless the supplies already have entered into the customs territory of the United States and the contractor already has paid the duty, Duty Free Entry (DFE) is normally available. The reason for authorizing DFE is to prevent supplier from incurring the cost of Duty as the supplier agrees to remove Duty from their quoted price to DLA.

DFARS 252.225-7013 DUTY-FREE ENTRY (MAY 2016)

The clause applies to solicitations and contracts for supplies that may be imported into the U.S. and for which duty-free entry may be authorized. Duty Free Entry may be authorized for all qualifying country supplies under the Buy American statute, eligible end products covered by trade agreements, and other foreign supplies for which duty will exceed $300 per shipment. Clause may be appropriate for use in solicitations and contracts for foreign material to APO/FPO addresses and FMS requisitions since shipments may enter U.S. customs territory for onward movement.

When authorized, Duty Free Entry generally applies to end items and components. Per the text of the clause, the supplier agrees they will NOT pass the cost of Duty on to the US Government when they claim Duty Free entry.

Suppliers should refer to the complete text of the clause for details on proper use of the clause and also paperwork preparation.
