The use of the authority cited in other than 10. U.S.C. 2304(c)(2) above:

The use of the authority cited is based on:
The NSNs 6110-01-552-4505 and 6110-01-592-8676 are available only from the coded sources indicated in the chart above as the Government does not possess the necessary technical data, production knowledge, and legal rights to the data to facilitate full and open competition to produce the required NSNs.
The Government’s lack of data and/or data rights serves as these source’s unique qualification requiring the use of other than full and open competition because these sources are the only sources that possess the data or data rights to produce these ESA approved items.
The data found in item #3 above notates an AMSC code for the NSNs detailing the level of information the Government does possess. DLA Land and Maritime SAPD Product Specialist Danny Carroll reviewed and confirmed the accuracy of the PID, AMC/AMSC, approved sources, and associated NSN data prior to solicitation. The approved source information for this NSN is as follows:

Project NSN 6110-01-552-4505 has an AMC/AMSC of 1/R which indicated that it requires that the technical data or the rights to use the data in order to purchase the item from additional sources are not owned by the Government and it has been determined that it is uneconomical to purchase the rights.
Project NSN 6110-01-592-8676 has an AMC/AMSC of 1/C which indicates that it requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source require acquisition of the part from the approved source.
The approved sources shown in the chart above retain the data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. Only these approved sources possess the rights to the technical data/drawings and/or the data itself necessary to produce the required items.
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
(x) The acquisition will be synopsized 15 days prior to solicitation issue.
(x) Dealers of the manufacturer will be solicited.
(x) Other. (Explain) Sources Sought Notice posted to FedBizOps on 07/27/2017 and closed 08/03/2017.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.
The basis for the Government’s fair and reasonable price determination is anticipated to be PPI based price analysis and/or the analysis of other than cost or price data such as informal cost break-downs and/or material invoices with final negotiated pricing reviewed in comparison with recent past buy history. The Contracting Officer has determined these items to be of a type sold commercially.
8. Market Research/Efforts to Obtain Competition:
Describe the market research conducted and the results.
Other market research efforts include: A review of the purchase history, coordination with the DLA Land and Maritime Small Business Office. A Sources Sought was posted 07/27/2017 to FEDBIZOPS by the Market Research Team (ZAA) and closed 08/03/2017 with no responses received.
Market Survey [10 U.S.C. 2304(f)(3)(D)]:
A market survey was conducted on/during: 02/21/2017 to 11/14/2017.
Names of vendors sent market surveys: Control Solutions and BAE Systems Names of vendors providing survey responses: Control Solutions Names of vendors non-responsive or declined to provide survey responses: BAE Systems declined stating their supplier would respond directly to the solicitation. No responses or documentation is available that show a survey was sent by the Market Research Team (ZAA) to Navistar. Navistar also did not respond to the Sources Sought Notice. Buyer review of the Past history shows no participation by BAE or Navistar in the previous acquisitions.
Techniques used to conduct survey: _______Formal Market Survey, email and telephone.

9. Additional facts supporting other than full and open competition are:
(x) Based upon the technical certification on file in DLA Land and Maritime-VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
10. A listing of sources, if any, indicating an interest in the acquisition is:
Control Solutions (4B8D1)
11. The following actions are being taken to identify additional sources:
(x) The solicitation contains DLAD Procurement Notes L04, “Offers for Part Numbered Items” and M06, “Evaluation of Offers for Part Numbered Items".
**On 10/19/2017 the Acquisition Specialist was advised by Dan Krist of DLA Land & Maritime Value Management (VEE) that there are no Value Engineering projects on-going at this time for the NSNs contained on this project and there are no additional new approved sources.
I/A/W the recent DFARS/DFARS PGI 206.303-2 changes dated 4/20/2015 concerning “Additional J&A requirements for noncompetitive follow-on acquisitions”, a copy of the previous J&A document associated with SPM7LX12D9018 is included with this J&A to assist the approval authority.
Market Research / Survey Summary
Market Survey Results: The market research for this project was conducted by the Sourcing Strategy Branch Market Survey Team (ZAA) with the Sourcing Strategy Specialists (SSS) attempting to conduct formal market surveys with several approved sources BAE Systems (076M6) and Control Solutions (4B8D1). BAE Systems responded that it would not participate in the survey or respond to the solicitation. While Navistar (338X5) is listed as coded source for NSN 6110-01-592-8676, ZAA Branch market survey attempts show no Navistar response and ZBB review of the past history showed no Navistar participation in past item procurements. Control Solutions indicated to the Acquisition Specialist that they sell these items directly to end item manufacturers such as BAE and Navistar for inclusion in their end-item weapon systems. Only Control Solutions provided a survey response to ZAA and is summarized as follows.
1. Control Solutions (4B8D1) is a manufacturer located in Aurora, Illinois and a division of Corinthian/CSI Holdings, Inc, (7DM15) with over 4,000 total employees. Initial survey response was received from Contracts Administration Director on 3/2/2017, however she left Control Solutions thereafter. ZBB Branch conducted clarification and follow-up with of Control Solutions and discussions were completed on 11/14/2017 indicating the following key information.
i. Interested in a Long Term Contract
ii. Items are considered commercial and all components are COTS.
iii. Is a manufacturing division of large corporation with 4000+ employees.
iv.
