JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION - SPE7LX-16-R-0196

DLA Land and Maritime Justification & Approval for Other than Full and Open Competition (J&A) (April 2014)

SPE7LX16R0196

ORIGINAL

1. The Defense Logistics Agency, DLA Land and Maritime, is the contracting activity.

2. The action being approved is the acquisition of an item of supply on other than a full and open competition basis.

This DLA Land and Maritime acquisition is for a Federal Acquisition Regulation (FAR) Part 12, Corporate Indefinite Quantity Contract (IQC) for DLA-managed consumables identified in Section B of the solicitation. This Acquisition was generated with 25 National Stock Numbers (NSNs), but was reduced to 21 to remove items that don’t met the requirements for Long Term Contracts (LTC)s. This acquisition is being pursued to provide continued and/or improved supply availability, to preclude backorders, reduce administrative and production lead times (ALT and PLT), decrease potential contract administration actions, and obtain reduced and stable unit pricing.

DLA Land and Maritime intends to enter into a Fixed-Price with Annual Price Adjustments, Indefinite Quantity Contract (IQC) issued under FAR Part 12 with a 3-year BASE period and two 1-year option periods that may be exercised at the discretion of the Government, for a total contract period of five years, if both options are exercised.

3. The supplies required to meet the using activity's needs are described as follows:

This solicitation is necessary in order for Defense Logistics Agency (DLA) to provide gaskets and electronic shielding gaskets for avionics and antennas on aircraft used by the U.S. Military including the C-130 Hercules, C/KC-135 Stratolifter, A-10 Thunderbolt, EA-6B Prowler, F/A- 18, C-17A Airlifter, E-3B AWACS, HH-60 Helicopter, UH-60 Blackhawk, HH/UH-1 Iroquois Helicopter, AH-64A Apache Helicopter, and MH-60R Helicopter.

Techniques used to conduct survey: Email, phone calls, posting Sources Sought notice on FedBizOps, and research of past procurements in Records Management.

Types of information requested: The Market Survey incorporated a request for contractors to consider a 3-year BASE period in lieu of the one-year base and were asked questions regarding business size and type of business (manufacturer vs dealer), Electronic Data Interchange (EDI) capability, option years (pricing and desirability), cost or pricing data, commerciality, Freight on Board (F.O.B.) preferences, packaging, and delivery questions.

A. Summary of information received:

See Attachment# 1 for a summary of market research.

DLA Land and Maritime Justification & Approval for Other than Full and Open Competition (J&A) (April 2014)

SPE7LX16R0196

All NSNs are now under the First Destination Transportation (FDT) program, and as a result the F.O.B. will be at Origin (Government managed freight). The Inspection/Acceptance will be Destination for all NSNs in this initiative. The vendors(s) are to be EDI or electronic mail capable.

Information received regarding the commerciality of the item(s):

Market research determined that all NSNs in this initiative are Commercial Items. They are made from the same raw materials and are available for purchase to the general public direct from the factory. Additionally, nine NSNs (CLINs 0001, 0002, 0003, 0008, 0011, 0012, 0014, and 0015) were previously solicited commercially under FAR Part 12 on solicitation SPM7MX-11-R-0125 and awarded on contract SPM7MX-12-0146.

The original equipment manufacturer (OEM) Aviation Devices and Electronic Components, LLC (1NPE1) provided unredacted commercial invoices to the Sourcing Strategy Specialist (SSS) on 6/23/2015 for CLINS: 0001, 0002, 0004 - 0006, 0009 - 0011, 0016 - 0020 (See Attachment# 2). The Contract Specialist sent a request to Aviation Devices and Electronic Components, LLC for additional invoices to support the remaining NSNs. A response was received on 8/11/2016 with commercial invoices for CLINS: 0003, 0007, 0015, and 0021 (See Attachment# 2). The information provided by Aviation Devices and Electronic Components, LLC, is proof that these items are of a type customarily used by non-governmental entities for use on commercial aircraft and have been sold to the general public which meets the definition provided under FAR 2.101 (1)(i) for Commercial item.

Aviation Devices and Electronic Components, LLC could not provide commercial invoices on the remaining CLINS: 0008, 0012, 0013, and 0014. It stated that these items have no recent commercial sales but they are made from the same material and shaped in the required specifications as needed. Additional research was preformed and information was found in the AV-DEC website (Attachment# 3) indicating that all the Gaskets that have a part number that starts with the letters “AG” (CLINS: 0003 - 0010, 0013 - 0016, 0020, and 0021) are known as HI-TAK Polyurethane Conductive Gaskets. Gaskets that have a part number that starts with the letters “SG” (CLINS: 0001, 0002, and 0012) are known as HI-TAK Conductive Specialty Gaskets. They are also made from the same raw materials as the “AG” Gaskets. Items from either part number series are used on military and commercial aircraft for corrosion prevention, improved avionics reliability, and antenna repair/scrap cost avoidance. They are also available for sale to the general public and can bought direct from Aviation Devices and Electronic Components, LLC. Based on the information collected from the Aviation Devices and Electronic Components website, the above CLINS are determined to be commercial with minor modification that does not significantly alter the unit for military use per FAR 2.101 (b)(3)(ii)

Based on the information provided above and attached, the Contracting Officer made the determination that these items meet the commercial item definition in FAR 2.101 and determines these items to be commercial. As a result, the items in this initiative will be solicited utilizing FAR 12 “Acquisition of Commercial Items.”

SPE7LX16R0196

9. Additional facts supporting other than full and open competition are:

Based upon the technical certification on file in DLA Land and Maritime-VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

Forecast information is available to all potential sources for both sole source and competitive items. The DLA Supplier Requirements Visibility Application (SRVA) is a database that is available via the DLA Internet Bid Board System (DIBBS). SRVA provides potential sources the opportunity to search for information on DLA’s anticipated requirements based on updated monthly forecasts. Essentially it provides 24 months of sole source and competitive projected purchase order quantities. Potential alternate sources for current sole source items can easily see DLA’s forecasted procurements and can contact the Value Management Unit to become approved sources for sole source and code and part number items. The DLA Land and Maritime Value Management Unit continually seeks out sole source, limited competition over-priced, low reliability and hard to buy items to improve their value and support posture. The DLA Land & Maritime internet website contains information for all potential sources on how to challenge prices, how to submit a Value Engineering Change proposal, a link to the Department of Defense (DoD) Value Engineering program and the necessary contact information for both the DLA Value Engineering program and the DoD Value Engineering Program.

10. A listing of sources, if any, indicating an interest in the acquisition is: (If none, so state) Aviation Devices and Electronic Components (1NPE1)

11. This item is subject to the following methods of locating additional sources:
