LIMITED SOURCE JUSTIFICATION
1. Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Hospital Supply Division, is the contracting activity.
2. This justification is for the acquisition· of the Medtronic/Covidien Valley Lab VLFT1 OGEN Energy Platform System. This requirement will be competed between three Medical Equipment ECAT contract holders, American Medical Depot (SPE2DH18D0012 which expires on September 19, 2023), Beacon Point Associates (SPE2DH19O0010 which expires on February 4, 2024) and Proaim America (SPE2DH17D0025) which expires on August 31, 2022.-
3. The Brooke Army Medical Center (BAMC), Ft. Sam Houston, Texas has a requirement as follows:
4.
Item Description: · Model/Part Number:
Quantity:
Unit Price:
Total Dollar Value:
Valley Lab FT1 0 Energy Platform System
VLFT10GEN
$13,000.00 $806,000.00.
a) The authority under the Multiple Award Schedule program-waiving the competition requirements is FAR 8.405-6(a)(1)(i)(B) as the following circumstance apply: only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are uniqu~ or highly specialized. The Valley Lab FT1 0 Energy Platform System identified above is the only product that will meet the technical requirements of BAMC. This unit offers dual cautery, runs with or without a foot pedal, and does basic monopolar and bipolar functions in addition to the ability to perform advanced vessel sealing. To create the same specifications of this one unit would require multiple products. This becomes an issue when discussing the limited space in an operating room. BAMC is currently replacing their existing Valley Lab Force Triad energy platform systems whh the Valley Lab FT1 0 energy platform system. These units are used in every type of surgery performed at BAMC. BAMC currently has thirteen (13) of the Valley Lab FT10 units in use and this requirement will replace the remaining Force Triad models.
b) BAMC's minimum requirements for an energy_ platform system are as follows:
i. Shall be equipped with tissue sensing technology in order to have consistent tissue effect regardless of hand-piece used, including advanced vessel sealing, monopolar cautery, and bipolar cautery.
ii. Shall be able to'run dual cautery simultaneously.
iii. Shall be.able to allow use of bipolar cautery without the use .of a foot pedal.
iv. Shall be able to provide bipolar cable compensation that allows reading of the cable length and width in _ord~r to have a consistent electrosurgical output.
• 5. DLA Troop Support has determined the S stem to be fair and reasonable negotiated. An RFQ will also be sent to American Medical Depot and Proaim America to ensure that fair opportunity is offered to all Medical Equipment ECAT vendors who offer Medtronic/Covidien products even though the subject item is not currently on their contracts.
6, Market research in the ECAT system found that Beacon Point is currently the only Medical Equipment ECAT contract holder for the Valley Lab FT 1 O energy platform system, and no other systems are available in ECAT that meet these minimum requirements. No other product offers these same specifications. In the absences of the FT 10 multiple products would be required to perform the same tasks. Due to the limited space in the OR, having multiple products to perform these tasks is simply not acceptable. Along with Beacon Point, American Medical Depot and Proaim America are the only other known Medical Equipment ECAT vendors that offer Medtronio/Covidien products. The customer conducted market research from 9/1/2018 to 12/31/2018. This research included a sources sought utilizing the Internet, ECAT and GSA Advantage. Olympus, Ethicon, ConMed and Medtronic were contacted for technical literature and brochures .
The Valley Lab FT1 O energy platform system is the only device on the market that is a_ble to meet all of the minimum requirements outlined by the Army.
7. ECA T vendors have the opportunity to add products that fall within the scope of the. E;CA T contract at any time; however, currently there are no other known ECA T vendors that would be able to offer a similar or equivalent product that can meet the requirements of the US Army.
8. In addition to the Services, DLA Troop Support will attempt to locate other acceptable sources inside and outside the ECA T program for future requirements as they arise; however, any new item would need to meet the Services' rigorous requirements. ·
9. As the Contracting Officer, I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief.
