*************************************************************************************Section 833 of the National Defense Authorization Act for Fiscal Year 2006 added language to 10 U.S. C. 2533a, requiring that all articles or items of "clothing,” including the materials and components thereof, purchased by the Department of Defense be grown, reprocessed, reused, or produced in the United States, other than sensor, electronics or other items added to, and not normally associated with, clothing (and the materials and components thereof).
Very Important: The vendor must certify their agreement to these terms by signing the certification located on Section K of this solicitation.
Very Important: Solicitation SPE1C117-R-0074 will be issued as a 100% SMALL BUSINESS SET-ASIDE. PLEASE NOTE: In accordance with DFARS 208.602-70, as implemented by Section 872 of the National Defense Authorization Act for Fiscal Year 2008, a federal supply class which has significant market share of greater than 5% as determined by DoD in consultation with the Office of Federal Procurement Policy must be acquired using competitive procedures.

LOW PRICE TECHNICALLY ACCEPTABLE (LPTA) ACQUISITION
1. In the past, most Best Value Clothing and Textile solicitations utilized Best Value Trade Off Procedures, however, this acquisition is utilizing Low Price Technically Acceptable (LPTA) Best Value Method. As such, no “trade off” applies and the Government intends to award to the low priced firm who is compliant with the terms of the solicitation, and deemed “Technically Acceptable”. Also, unlike previous acquisitions for this type of item, there will be no allowable re-submittals for PDM (Product Demonstration Model) and only firms with acceptable PDMs will be eligible for award.
PAGE 5 OF 78 PAGESCONTINUATION SHEET REFERENCE NO. OF DOCUMENT BEING CONTINUED:
Technical Acceptability is being defined herein as acceptable PDMs and compliance with all solicitation terms and conditions. All PDMs will be evaluated in accordance with the criteria outlined in the solicitation.
2. From among technically acceptable firms, the Government will then select the lowest price offeror and determine if that firm is responsible, complies with terms and conditions of the solicitation and an award to that firm is in the best interest of the Government. If the firm fits these criteria, award will be made to them. If not, the Government will review each subsequent technically acceptable low priced offer until one is identified that does meet the criteria, in which case award will be made to that firm.
3. The Government reserves the right to conduct negotiations with a competitive range group of offerors from among technically acceptable firms, based on price. If negotiations are conducted, award will be made to the lowest priced offeror (based on final proposal revision) that is technically acceptable, responsible and compliant with the solicitation terms and conditions.
The Government intends to make two (2) awards (Lot 1 – Towel, Bath, Brown [24x50 or 20x48 – any combination] and Lot 2 – Washcloth, Microfiber, Brown). However, the Government reserves the right to make one award for Lot 1 (Towels) and Lot 2 (Washcloth) if it is determined the same source is deemed the best value for both items. All materials are furnished by the Contractor.
THERE ARE FOUR (4) ONE YEAR OPTION TERMS FOR BOTH LOTS OF THIS SOLICITATION. YOU ARE REQUIRED TO OFFER ON THE OPTION YEARS AS WELL AS THE BASE ORDERING TERM FOR EITHER LOT 1, LOT 2 OR BOTH LOTS 1 &2. FAILURE TO DO SO WILL RESULT IN THE REJECTION OF YOUR ENTIRE
PROPOSAL.
Refer to Section “L & M”. Technical Proposals are required to be submitted since this is a LOW PRICED TECHNICALLY ACCEPTABLE (LPTA) BEST VALUE SOURCE SELECTION ACQUISITION. Failure to submit a technical proposal may result in the rejection of your entire offer.

BUSINESS SYSTEMS MODERNIZATION (BSM) DELIVERY TERMS AND EVALUATION
(a) This acquisition is being conducted under business systems modernization (BSM). Quotes/offers in response to this solicitation will be evaluated as specified in the solicitation.
(b) Delivery shall be quoted/offered in terms of a number of days after date of order (ADO). The number of delivery days requested in this solicitation is calculated based on the Government’s planned need and customer requirements.
Unless delivery is identified elsewhere in the solicitation as an evaluation factor, quoters/offerors are encouraged to conform their delivery terms as closely as possible to the delivery days requested.
