DLA Document Services has a need to issue a sole source contract action to continue lease support for multi-functional devices (MFD) without using competitive procedures. An award for a new lease has been issued with deliveries taking place throughout May and June, the sole source contract will cover continued lease support starting May 1, 2018 through May 31, 2018 with an option for June 1, 2018 through June 30, 2018.
Continued MFD lease support for 1 month and 1 option month, to include full service maintenance, all consumable supplies (excluding paper), key operator training, networking functionality, security accreditation along with technical and network installation support.

The authority identified in #3 above applies because, although other vendors offer similar MFDs, consumables, and services; no other vendor can service the lease of another vendor without violating the lease terms. Additionally, no other vendor would be able to deliver new devices in time for a May 1, 2018 start date. The only way to ensure uninterrupted support to the Warfighter is to issue a contract to the current vendor.

Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available.

Although this contract requirement can only be fulfilled by one source, the Justification and Approval per FAR 13.501(a)(1)(iii) will be synopsized via the Government-wide Point of Entry, Federal Business Opportunities website. The follow on order for the devices was awarded utilizing full and open competition.
Market research indicates that an adequate competition pool exists for requirements of this type. The contract will only be in place for two months to allow new devices to be delivered that are replacing the existing MFDs.
Attempting to do a short-term contract via competitive procedures would result in unacceptable delays to achieve contract award and delivery/installation of new equipment; both of which would cripple the customer. The unacceptable delays would entail removal of the 230 devices currently in place, re-competing the short term rental, and delivery of the short term rental, during which the customers would be without devices. A two month contract will provide adequate time for the delivery and installation of new devices.
