Text2: DLA Document Services Tinker AFB has a need to issue a sole source contract to Nuance Communications, Inc. for Notable Solutions Output Manager Software and Xerox LCDS used to accomplish conversation of Mainframe output of digital input to various output requirements.
Text3: The estimated value of this sole source contract is XXXXXXXX which includes the base year and four option periods. This sole source contract action is for maintenance on Notable Solutions Output Manager Software System and Xerox LCDS. DLA has purchased a license for this software and this requirement will be for upkeep of this software. This system has been in use within DLA for over 3 years, and it is an ever evolving system.
Text4: The statutory authority permitting the use of other than full and open competition is 41 U.S.C. 1901.
Text5: Notable Solutions is a proprietary software created and operated by Notable Solutions Output Manager and owned by Nuance Communications, Inc. There are no other sources that can provide this software. DLA Document Services Tinker AFB already owns the license for this software but Nuance Communications has not released their rights for the proprietary data. This requirement will be for the upkeep of the Notable Solutions software and license. This software has been in use within Document Services for over three years and the maintenance is required because it is an ever evolving system and has years of configuration changes logged. This software takes the place of software that used to be installed on each printer, this receives files from DISA and converts them to PDFs, however there are many configurations to make that happen. The Government does not own the proprietary rights to the software that would enable it to provide competition to other vendors for the annual maintenance and support of the Notable Solutions Software.
Text6: Until the Government purchases the proprietary data for this software it will be unable to solicit other offerors. The Justification and Approval will be synopsized via the Government-wide Point of Entry, Federal Business Opportunities (FBO) website in-accordance-with FAR 13.501(a)(1).
Text7: The solicitation was posted to FBO and no other sources provided a response or capability statement. The Government conducted additional market research and did not find any authorized resellers of the Notable Solutions Software.
Text8: The purchase of the proprietary data from Nuance for the Notable Solutions Software would be cost prohibitive and Nuance would have to agree to sell this data to the Government, which it has not done at this time. Because the Government requires the updates delivered via service packs, which include fixes to product usage issues; and upgrades delivered via minor and major releases this maintenance is required in order for the system to function properly. The Notable Solutions Software has been approved to operate in DOD/DLA/DLA Document Services Information Assurance environment.
Text9: No other sources have expressed interest in this requirement and no authorized resellers have been found during Market Research.
Text10: The Government will continue to review this requirement and evaluate the possibility of obtaining of Notable Solutions from authorized resellers. Any future requirements will be posted to FBO.
