B . 6 CONTRACT MINIMUM/MAXIMUM

(a) This is a firm-fixed price indefinite quantity contract. The minimum for the base period and each of the option periods shall be 10% of the estimated value of the period. The maximum for the base and each of the priced options shall be 300% of the estimated value of the period.

(b) The estimated value of a period is the absolute value of all positive and negative amounts in that period, including management services. For example, if there is an estimated ¥25 million in positives, ¥100 million in negatives and ¥50 million in management services in a period, the estimated value of the period is ¥175 million.

B . 7 INVOICES EXCLUSIVE OF TAXES OR

DUTIES

Invoices submitted in accordance with the terms and conditions of this contract shall be exclusive of all taxes or duties for which relief is available.

B . 8

TAX RELIEF SERVICES

(a) Unless otherwise provided in this contract, the contract price includes all applicable taxes and duties, except taxes and duties that the Government of the United States and the Government of Japan have agreed shall not be applicable to expenditures in Japan by or on behalf of the United States.

(b) The Status of Forces Agreement between the Japan and the United States and implementing the Japanese laws authorizes the United States exemption from certain Japanese taxes for materials, supplies, equipment and services procured for official purpose in Japan by the United States Armed Forces or by authorized agencies of the United States Armed Forces. Those taxes include (1) Consumption tax, (2) Gasoline tax and local road tax on gasoline, (3) Diesel oil tax, and (4) Liquefied petroleum gas tax.

(c) The contractor shall submit requests for gasoline or diesel oil tax exemption certificate to the Contracting Officer (CO). This request will show the actual amount of gasoline or diesel oil used exclusively for the performance of this contract, with documentary evidence and detailed item breakdown to support the accurate consumption of gasoline or diesel oil, or other necessary information and data as may be required. The CO will issue to the contractor a tax exemption certificate for the actual amount of gasoline or diesel oil used exclusively for the performance of this contract.

B . 9 STATEMENT OF SERVICES

(a) Background. DLA Disposition Services disposes of foreign excess personal property of the United States Department of Defense (DoD). DLA Disposition Services receives property that is no longer required for use in the DoD and makes a determination whether the property is usable or scrap.

If usable property is not needed for redistribution within the Federal Government, it may be donated to state and local Governments, sold to the general public, or processed for reclamation of specific metals and materials required for use by the DoD. Only material that has not been disposed of by these outlets or is determined to be scrap shall be subject to this contract.

(b) Purpose. The purpose of this solicitation is to award a contract for management services to include collecting, transporting, recycling, demilitarizing and disposing of scrap and recyclable material in an environmentally responsible and compliant manner. This solicitation does NOT involve disposal of hazardous materials (HM) or hazardous waste (HW) except HM/HW that may subsequently be generated by the contractor during contract performance from vehicle sanitation, vehicle parts/components, demilitarization (DEMIL), mutilation, electronic de-manufacturing (DEMAN) or otherwise generated by the contractor during the disposal processes.

(c) Objectives. The objectives of contracting for scrap services are to ensure compliant scrap disposal management; to decrease disposal costs; to maximize economic off-sets; to reduce the Government's capital investment (facilities and equipment costs) and infrastructure; and to reduce solid waste disposal through increased recycling and to move property efficiently.

(d) Site Visits. Offerors not familiar with the scrap accumulation points at DLA Disposition Services [formerly known as Defense Reutilization & Marketing Offices (DRMO)] Iwakuni, Misawa, Okinawa and Sagami are strongly encouraged to perform site visits. Site visits will help the offerors in determining the number and type of containers, labor, supplies and equipment that will be required to perform Scrap / Recycling services.

(e) Definitions. A list of definitions is provided in Section J, Attachment 2 titled, “Definitions.”

(f) Permits. The Government will not seek facility or equipment permits for regulatory compliance. T herefore, contractor-proposed changes to current operations that trigger permitting requirements within Government installations, will not be allowed.

CONTRACT INFORMATION

(a) Term of the Contract. The contract includes one (1) 18-month base period and two (2) 18-month option periods.

(b) Contract Type. The contract awarded from this solicitation will be a Firm Fixed Price, Indefinite Delivery, Indefinite Quantity, Service contract. Task Orders will be issued based upon the unit prices established in the contract price schedule.

(c) Pricing. There are four (4) price schedules; one schedule for each location at Iwakuni, Misawa, Okinawa, and Sagami. All of the schedules include the Base, 1st and 2nd option periods. Not all of the areas will have scrap generations for all of the CLINs.

(d) Contract Line Item Number (CLIN) 0001, 1001 and 2001: Management of Scrap Collection Site (See Section C-0.3(c))

(e) Contract Line Item Number (CLINs) 0043, 1043, 2043 and 0044, 1044, 2044:

(1) CLINs 0043_D, 1043_D, 2043_D, Demanufacturing (DEMAN): CLINs identified by a “D” in the sixth position require demanufacturing (DEMAN). This CLIN shall be ordered by the “pound”. The unit of issue of “pound” will represent a per pound rate. The contractor must be able to DEMAN property during normal operating hours at Government collection sites designated by the Contracting Officer. The Contractor is responsible to operate the DEMAN performance area and perform required COUNTING, SITE PREPARATION, Dismantling and reduction to scrap of usable items by either CUTTING, TEARING, SCRATCHING, CRUSHING, BREAKING, BUNCHING, SHEARING, BURNING, SMELTING, OR NEUTRALIZING THE ITEM TO THE POINT THAT

THERE ARE NO USABLE PARTS REMAINING and ensure a Mutilation Certificate is completed and signed by an approved certifier and verifier after the property is totally destroyed and provide written certification that mutilation of the property has been accomplished in accordance with DoD regulations.

Disposal of residual material (hazardous waste and / or solid waste) not listed under Category 1 or 2 CLINs is the responsibility of the contractor. Proper disposal documentation of residual material shall be provided to the Contacting Officer. Contractor employees performing the DEMAN of property are required to be in possession of all required permits and licenses (for example: torch cutting permit, shredder operator license, crane operator license, forklift operator license) and must comply with all national, international, prefectural and state laws. DEMAN work is intended at DLA Disposition Services at Sagami, Okinawa, Misawa, and Iwakuni and forward collection sites: D raughon Range (Misawa), Sasebo and Kawakami. Once DEMAN work is performed and certified, the contractor shall segregate scrap items into scrap containers and removal will be requested under the appropriate Category 1 or 2 CLINs unless otherwise specified. See Section C-6 titled, “Demilitarization (DEMIL) / Mutilation / Demanufacturing (DEMAN),” for further requirements.

All circuit cards and microprocessors removed from the DEMAN process shall be returned to the Government.

(2) CLINs 0044_B, 1044_B, 2044_B, Demilitarization (DEMIL) / Mutilation: CLINs identified by “B” in the sixth position require demilitarization (DEMIL) / Mutilation. This CLIN shall be ordered by the “pound”. The unit of issue of “pound” will represent a per pound rate. The contractor must be able to perform DEMIL / Mutilation of property during normal operating hours at Government collection sites designated by the Contracting Officer. Exception to this is the demilitarization of fired cartridges that require DEMIL by smelting (offsite). The contractor is responsible to operate the Demilitarization / Mutilation performance area and perform required COUNTING, SITE PREPARATION, DEMIL / Mutilation and reduction to scrap of usable items by either CUTTING, TEARING, SCRATCHING, CRUSHING, BREAKING, BUNCHING, SHEARING, BURNING, SMELTING, OR NEUTRALIZING THE ITEM TO THE POINT THAT THERE ARE NO

USABLE PARTS REMAINING and ensure a DEMIL / Mutilation Certificate is completed and signed by an approved certifier and verifier after the property is totally destroyed and provide written certification that DEMIL / Mutilation of the property has been accomplished in accordance with DoD regulations. (f) Contract Line Item Numbers (CLINs) 0002 - 0050, 1002 - 1050 and 2002 - 2050 unless otherwise specified, are grouped into one of two categories as described below.

(1) Category 1, Scrap material with an index: For CLINs 0002 – 0025, 1002 – 1025 and 2002 – 2025 the offeror must propose a percentage of the appropriate Shigen Shinpou index (% of Index - Column B) which shall be used to calculate an amount to be returned to the Government.

The amount to be returned to the Government shall be based on the total scrap weight removed from the Government facility.

Note: T he Index Price for Evals in Column C is the Shigen Shinpou index price for January 2011 and will only be used for price evaluation purposes. The actual index prices used during contract performance will vary from month to month and will be based on the each month’s Shigen Shinpou index prices.

EXAMPLE: Assume an offeror intends to bid 75% as the percent of index share (Column B) for CLIN 0002_A, Cardboard. If 100 Net Tons (NT) were removed and the relevant Shigen Shinpou index price for this material is ¥8,000 per NT, then the calculation would be as follows:

Column B * Column C = Column D (Index Adjusted Unit Price) which is in parenthesis “( )” and reflected in red, to indicate the amount the contractor owes the U.S. Government per unit measurement.

Column A * Column D = Colum E (Total Amount) which is in parenthesis “( )” and reflected in red, to indicate the total amount the contractor owes to the US Government.

The Contractor's Total Amount for Category 1 scrap will always be an Economic Benefit to the U.S. Government. The term “Economic Benefit” is also known as an “Offset” and may be equally interchanged in discussions or correspondence.

(2) Category 2, Scrap material without an index that holds a positive or negative market value: F or CLINs 0026 - 0050, 1026 – 1050 and 2026 – 2050 the offeror must propose either a Positive Fixed Unit Price (Column (B)) which shall be used to calculate an amount to be returned to the Government as an economic benefit (offset for positive market value material) or a Negative Fixed Unit Price (Column (C)), which shall be used to calculate an amount to be paid to the contractor as a disposal fee (includes containers, transportation, processing, recycling or disposal costs). The total amount shall be based on the total weight removed from the Government facility.

EXAMPLE: Assume an offeror intends to bid ¥10 as the Positive Fixed Unit Price (Column B) for CLIN 0029, Wood Scrap. If 1,000 lbs. were removed, the Fixed Total Price would be as follows:

In the example above, the fixed total price indicated in Column D is the amount the contractor owes the U.S. Government (also called an economic benefit or offset). The total amount is in parenthesis and reflected in red.

If the offeror was to bid a Negative Fixed Unit Price (Column C), the unit price in Column C would be reflected in black and without the parenthesis ( ). The Fixed Total Price in Column D would also be reflected in black and without the parenthesis ( ), to indicate the total amount the U.S. Government owes the contractor.

Note 1: Contractors are allowed to propose zero as a fixed unit price in any Category 2 CLINs.

Note 2: Contractors should input a negative value when proposing a positive fixed unit price in the electronic bidding sheet. The negative value will signify an amount the contractor owes the U.S.

Government per unit measurement.

Note 3: CLINs 0043 (Demanufacturing) and 0044 Demilitarization / mutilation have special handling requirements and are further described above in B.10(e)(1) and (2).

PRICE SCHEDULE FORMAT AND

COMPENSATION OF SERVICES

Section B, Schedule of Prices displays the CLIN, description and estimated quantity (weight) of each type of scrap material available for recycling and/or disposal. These quantities are forecasted eighteen (18) month future generations based on historical data. When possible and for informational purposes only, Government Scrap Classification codes (SCL) are listed for each scrap item within the Section B, Schedule of Prices/CLIN price schedule. Information describing the service or type of scrap material, collection/pickup area, and special handling requirements (demilitarization/mutilation and/or destruction, and demanufacturing) are contained in each Contract Line Item Number (CLIN) format as follows:

(a) The first four (4) positions are numeric and indicate Transport, Recycling and Disposal (e.g. “0002” is Cardboard and Mixed Paper disposal service).

(b)The fifth (5TH) position indicates the DLA Disposition Services site collection/pickup area (e.g. “S” is the Sagami area, “K” is the Okinawa area).

I = Kawakami K = Okinawa M = Misawa N = Draughon Range O = Sasebo S = Sagami W = Iwakuni

(c) The sixth (6TH) position indicates the level of service or special handling requirements as follows:

A = Scrap / Recyclable material (Category 1 or 2). No special handling requirements.

B = DEMIL \ Mutilation Scrap Material requiring demilitarization and/or destruction in accordance with Section C-6.

D = Electronic scrap requiring demanufacturing in accordance with Section C-6.

(d) For CLIN 0001 only, the sixth (6th) position differentiates the various levels of service.

A = Full Service B = Limited Service

(e) Index information for Category 1 CLINs: The Shigen Shinpou publication (index) will be used. Subscriptions for the publication may be obtained by contacting:

This publication, published the first week of each month, shall be used for pricing and invoicing purposes. T he specified high prices of the Shigen Shinpou Index will be used. It is the responsibility of the contractor to obtain the subscription and provide a copy to the Contracting Officer (CO) for verification purposes. The contractor shall e-mail the monthly index prices to the CO by the seventh day of each month. For example, the October index is due to the CO by October 7.

When a task order is issued for a particular month, it will reference the previous month’s index.

The index used in the task order will be replaced when the current month’s index is released. For example, a task order for November will be issued in late October and will reference October’s index prices since the November index has yet to be released. After the November index is released, a modification to the task order will be issued to replace the October index with the November index.

SECTION C

PERFORMANCE WORK STATEMENT

C. 0 GENERAL INFORMATION

C.0.1 General: The contractor shall provide all personnel, equipment, containers, tools, materials, supervision, vehicles and other items or services necessary to perform scrap removal, demilitarization (DEMIL) / mutilation and de-manufacturing (DEMAN) operations including disposal and recycling.

The contractor shall meet the standards including disposal and recycling as defined in this Performance Work Statement for four (4) DLA Disposition Services sites located at Iwakuni, Misawa, Okinawa and Sagami, Japan. Area of coverage will also include Forward Collection Sites Kawakami, Sasebo and Draughon Range (located near Misawa).

C.0.2 Schedules: The estimated quantities of DEMIL / mutilation / DEMAN and scrap disposal required are listed in Section B, Schedules of Prices.

C.0.3 Contractor Responsibilities:

(a) The contractor is responsible for performing all services necessary in connection with management of scrap collection sites, transportation, removal, recycling and disposal of scrap materials, including the provision and maintenance of containers. Required contractor services include all staff, equipment, management of scrap collection sites, documentation, provision and maintenance of containers, and coordination with the Contracting Officer (COR) on the placement of material into containers. Except for “oversized items,” such as vehicles and boilers and expended cartridge cases, all scrap property will be maintained in containers and will not be left stored on the ground or outside of containers overnight. The contractor shall provide a sufficient number of containers to efficiently remove full containers while at the same time ensure enough containers are available to prevent new generations of property from being stored on the ground or outside of containers overnight.

(b) The contractor is responsible for physically receiving scrap material from “DoD generating activities in Japan,” offloading generating activity conveyances, segregation, sorting, or movement of property it deems necessary to manage the scrap materials, and for placing the materials into contractor-provided containers. Segregation is the process of identifying the material for its basic material content. The basic material content is established by the DLA Disposition Services personnel.

This determination is based on the predominant composition by weight of an item in the best interest of the U.S. Government. Questionable items will be determined in conjunction with the CO, COR and contractor. The contractor personnel may further break down an item into its individual basic material contents and sort for better scrap grouping in appropriate Category 1 or 2 CLINs. This process is accomplished by the onsite contractor personnel at no additional cost to the U.S. Government.

(c) CLIN 0001, 1001 and 2001 Management of Scrap Collection Site(s): Includes all staff, equipment, coordination, waste management and documentation necessary to perform the services described below. The Government plans to issue task orders for management services during the entire period that the contract is in effect subject to adequate fund availability. However, prospective offerors are reminded that this is an Indefinite Delivery, Indefinite Quantity (IDIQ) type contract and the quantities of management services specified in the Schedule are estimates only and are not purchased by this contract on the date of award. In accordance with FAR 52.216-22, entitled “Indefinite Quantity (Oct 1995), the contractor’s performance shall be made only as authorized by orders issued in accordance with the Ordering clause.

These project services will be ordered in addition to the usual disposal/processing services for CLINs 0002 - 0050, 1002 - 1050 and 2002 - 2050. In addition to receiving the management of scrap collection site fee, the contractor shall be paid the weight-based (“per pound”) disposal fee for any materials it processes and return a “percent of index” fee to the Government (where applicable).

The Government will inform the contractor after award which Management of Scrap Collection Site CLIN, either “Full Service” or “Limited Service,” will be ordered at Okinawa and Sagami. In the event the Government decides to switch from Full Service to Limited Service, or vice versa, at either location after contract performance begins, the contractor will be notified at least 60 days in advance of the change.

(i) CLINs 0001KA, 1001KA, 2001KA and 0001SA, 1001SA, 2001SA (Full Service):

Contractor is responsible for performing all services necessary in connection with establishing and maintaining a scrap material collection site at locations specified in Section J, Attachment 3 titled, “DLA Disposition Services Sites and Operating Hours.” Contractor shall maintain a neat, clean collection site and shall operate the collection site in accordance with all host nation laws and any DoD requirements specified herein. Except for “oversized items,” such as vehicles and boilers, all scrap property shall be maintained in containers and should not be left stored on the ground or outside of containers overnight. The contractor shall maintain the containers so that material does not overflow, overhang the containers, or otherwise create unsafe conditions. Containers must be covered to prevent collection of rainwater and/or snow. CLINS requiring mutilation, demilitarization, and/or demanufacturing must be secured at all times. The contractor is responsible for receiving scrap material property from DoD generators, offloading generator conveyances, segregating, sorting, or moving of property it deems necessary to manage the scrap materials, and for placing the materials into containers. Contractor must staff each location so that it can receive turn-ins of material from DoD generators at DLA Disposition Services Okinawa and Sagami Monday through Friday during each site’s “operating hours.” Operating hours for each DLA Disposition Services site are specified in Section J, Attachment 3 titled, “DLA Disposition Service Sites and Operating Hours.” The contractor must be able to perform receipt of property Monday through Friday (except U.S. and Japanese

Holidays). Offerors must specify in their Transportation, Recycling and Disposal Plan (refer to Section L.39) how they will staff each site to provide the required services.

(ii) CLINs 0001KB, 1001KB, 2001KB; 0001SB, 1001SB, 2001SB; 0001MB, 1001MB, 2001MB; and 0001WB, 1001WB, 2001WB (Limited Service): Contractor is responsible for performing all services necessary in connection with establishing and maintaining a scrap material collection site at locations specified in Section J, Attachment 3 titled, “DLA Disposition Services Sites and Operating Hours.” Contractor shall maintain a neat, clean collection site and shall operate the collection site in accordance with all host nation laws and any DoD requirements specified herein.

Contractor must staff each location so that it can receive turn-ins of material from DoD generators at DLA Disposition Services Misawa, Iwakuni, Okinawa and Sagami Tuesday through Thursday during each sites “operating hours.”

Operating hours for each DLA Disposition Services site are specified in Section J, Attachment 3 titled, “DLA Disposition Services Sites and Operating Hours. The contractor must be able to perform receipt of property Tuesday through Thursday (except U.S. Holidays). Offerors must specify in their Transportation, Recycling and Disposal Plan (refer to Section L.39) how they will staff each site to provide the required services.

(d) When CLINs 0043_B, 1043_B, 2043_B or 0044_D, 1044_D, 2044_D are ordered, the contractor is responsible for the demilitarization/mutilation or de-manufacturing of special handling property as designated by the COR. All CLINs identified by a “B” in the sixth position of the CLIN require demilitarization (DEMIL) / mutilation. CLINs identified with a “D” in the sixth position require demanufacturing. The contractor must staff and equip each location so that it can DEMIL / mutilate or demanufacture material from DoD generating activities and DLA Disposition Services Sites in coordination with the COR during each site’s “operating hours.” Operating hours for each site are specified in Section J, Attachment 3 titled, “DLA Disposition Services Sites and Operating Hours.”

The contractor must be able to perform DEMIL / mutilation / demanufacturing of property Monday through Friday at all DLA Disposition Services Sites when CLINs requiring DEMIL / mutilation or demanufacturing are identified on a task order. The Government may order these services on a monthly basis as long as this contract is in effect. Contractor shall be responsible to staff and equip each site with the appropriate amount of personnel to provide the required services.

C.0.4 Permits: The contractor shall, without additional expense to the Government, be responsible for obtaining all necessary licenses and permits to conduct these services in accordance with all national, international, prefectural and state laws, ordinances and regulations that govern collection, transportation, processing, recycling, and disposal of scrap and demanufacturing (DEMAN) materials. The contractor is responsible to provide such licenses and permits as part of their proposal as specified in Section L.39 of this RFP. The contractor shall maintain all licenses and permits during the entire life of the contract.

All renewals and/or changes to licenses/permits shall be provided to the Contracting Officer within 5 calendar days of any renewals/changes.

C.0.5 Permits / Special Requirements: The Contractor is required to attend special training, seminar, instruction, class, etc. provided by the Government, to perform the work or gain access to the installation.

Some examples include but are not limited to: Pass and ID requirements, anti-terrorism/force protection training, Environmental Management System policies, fork lift, DEMIL and safety training.

C.0.6 Reports: Contractor shall prepare and submit all reports mandated by the Japanese government such as notifications, annual reports, “Annual Waste Balance Sheet,” required quantity forecasts, proof of recovery or recycling, scrap material logs, and five-year plans. The contractor must meet reporting requirements established by Japanese National and Prefectural law, International ordinances and regulations that govern collection, transportation, processing, recycling, and disposal of scrap, and other materials generated from the scrap and DEMAN processes. Contractor shall submit reports in accordance with Section C.7 titled, “Required Reports,” and as stated below:

The commodities listed in the report sample above are only examples. The contractor shall list all commodities that are actually sold, recycled or disposed. The report will reflect the final dispositions of all commodities on each task order. The report shall be submitted upon completion of each task order.

The COR shall certify the report for acceptance of services provided under the task order.

C.0.7 Contractor Identification: All contractor employees shall identify themselves as contractor personnel by introducing themselves or being introduced as contractor personnel and displaying distinguishing badges or other visible identification for meetings with Government personnel. In addition, all contractor personnel shall appropriately identify themselves as contractor employees in telephone conversations and in formal and informal written correspondence.

C.1 MANAGEMENT OF COLLECTION POINTS

This effort will start with the first working day of the basic contract period and will entail the establishment of the collection points, placement of contractor’s containers while performing in accordance with this contract.

C.1.1 Removal of Current Inventories: The contractor shall provide containers and remove current inventory of scrap materials and incoming generations, within 30 days of issuance of the first task order for this work. Upon completion of current inventory, the contractor is responsible to perform all other work in accordance with the performance periods identified within the contract and as specified in Section F-4 titled, “Period of Performance,” of this contract. Until time of award, DLA Disposition Services Sites in Japan will continue to dispose of scrap material through sales and service contracts.

A sample inventory (August 2010) for each site is listed in Section J, Attachment 5 titled, “DLA Disposition Services Inventory Snapshot.” Additional Workload History for Fiscal Year (FY) 2009 and FY 2010 are provided in Section J, Attachment 12 titled, “Workload History” for each DLA Disposition Services site. Because the current inventory is only a snapshot in time (August 2010), an updated inventory list will be provided upon request within ten (10) calendar days of the contract award date. The updated inventory list may not accurately represent future inventory quantities.

C.1.2 Design/Organize/Set up: The contractor shall establish efficient scrap collection points at each DLA Disposition Services sites as listed and described in Section J, Attachment 3 titled, “DLA Disposition Services Sites and Operating Hours,” and at forward collection sites as required.

Collection points should be designed to utilize current allocated space, establish optimal efficiencies in collecting, transporting, recycling and disposing of the scrap material in an environmentally compliant manner without triggering the requirement for the Government to obtain any new permits. The contractor will be given a 30-day commencement period after contract award to complete design and set up.

(i) The Government does not intend to construct permanent fixtures. The collection point should be tailored to the scrap material received and containers shall be sufficient for each type of scrap generated. The objective is to have adequate containers in place to begin performance of the contract effective 30 days after contract award. All additional containers must be in place by the close of business on the last day of the first work week of the contract performance period. All containers must be identified by an attached visible magnetic placard with the minimum overall dimensions 40 cm x 60 cm with 4 cm lettering and at a minimum the following information in English and host nation language: CLIN for applicable site (example _005WA, _013WA, etc...) and the Basic CLIN description.

Additional information may be added as specified by the COR.

(ii) At each DLA Disposition Services site, the scrap yard space utilized will be based on the past history of generations and may be reduced to reflect current requirements. The offeror shall submit a proposed planograph illustrating how they plan to utilize the scrap yard space, based on the information provided in Section J, Attachment 6 titled, “DLA Disposition Services Recycling Yard Layouts.” The proposed planograph must be included in the Transportation, Recycling and Disposal Plan (refer to Section L.39) While maintaining compliance, the Contractor decides how many and what type of containers will be used at each collection point in order to meet the contract requirements.

C.1.3 : Forward Collection Sites: Commencing 30 days after award, the contractor may be tasked to begin collection of materials at the following Forward Collection Sites: Kawakami, Sasebo and Draughon Range (located near Misawa). These sites have specific CLINs on the bid schedule that identify which CLINs to anticipate. See Section B.11 titled “Price Schedule Format and Compensation Services,” for additional information on site identification. Other sites may be designated after award of the contract and will be identified by the Contracting Officer. Additional forward collection sites and scrap materials not already identified may be added via modification and will include individual CLINs based on location and the types of materials/commodities anticipated. The contractor is required to load their conveyance at forward collection sites.

C.2 CONTAINER MANAGEMENT

C.2.1 Drop off, Pickup, and Loading: The contractor shall drop off containers, pickup, and load at the designated sites during the hours specified in Section J, Attachment 3 titled, “DLA Disposition Services Sites and Operating Hours” and in accordance with Section F.8 titled, “Container Placement.”

Contractor will ensure Japanese and installation safety requirements are met. Date and time for loading at the sites will be coordinated with the COR. Removal / exchange of containers will be determined by the COR and will be completed by the contractor within 48 hours after notification from the COR.

Containers must be covered at all times to prevent collection of rainwater and / or snow.

C.2.2 Weighing: Each conveyance shall be weighed by the contractor utilizing government scales at DLA Disposition Sites Iwakuni, Misawa, Okinawa and Sagami, before and after scrap material is loaded onto the contractor’s conveyance. An authorized government representative will witness the weighing on government scales. Weight tickets will be provided to the COR for the tare weight and loaded weight. The loaded and tare weight of each shipment shall be recorded on the shipping document.

The weight, agreed to by the contractor and the Government representative at the time of removal, shall be the basis for invoice payment calculations. At forward collection sites or locations other than established DLA Disposition Services sites, unless the government indicates a government scale is available and shall be used, the contractor shall have a portable scale that can weigh scrap material.

The portable scale must be certified by the Government of Japan (GOJ) as to proper weighing ability and must be approved by the Contracting Officer. The driver of the truck carrying the portable scales must keep the annual calibration certificate readily available for COR inspection. An authorized government representative will witness the weighing on government or other certified scales. Pallets, boxes, strapping, etc., which are not integral parts of the packaging and are not being removed by the contractor will not be included in the weight. Containers and pallets that are to be destroyed along with the scrap materials that they contain shall be included in the net weight.

C.2.3 Removal: Removal / exchange of containers will be determined by the contractor and shall be coordinated with the COR. Only items identified on a signed task order issued by the Contracting Officer are eligible for removal.

C.2.4 Transportation: The contractor shall provide all transportation services related to pick up, loading, marking, and any means used to secure the cargo on contractor-furnished conveyances. All transportation shall be in accordance with Japanese, international and host nation/prefecture solid waste transportation regulations. The Government shall purchase and prepare all manifests for scrap movement to the contractor for completion. In cases where scrap and DEMAN material are being transported from Okinawa to Mainland Japan, the regulations governed by the International Maritime of Dangerous Goods (IMDG) Code and other applicable regulations shall be utilized for shipment. While performing under this contract, the contractor is required to provide his drivers with the appropriate emergency action instructions and any other documentation as required by host nation and international transportation regulations, which ever may apply.

C.2.5 Spill Responsibilities: The contractor shall be responsible for all spills and leaks caused by the contractor’s performance of work. All materials used to control and clean up the spill will be supplied and maintained by the contractor at each DLA Disposition Services site and forward collection site where mutilation or demilitarization is performed. The contractor is not required to remediate pre-existing site contamination. Clean up involves spills and leaks from contractor operations in performance of this contract only. The contractor agrees to immediately clean up such spills or leaks as soon as the spill occurs. Cleanup will be in compliance with site spill plan provided by the COR and all applicable local, national, and international laws and regulations. The contractor shall dispose of all residue and debris generated from the spill at no additional cost to the US Government and in compliance with local and national laws governing solid and hazardous waste disposal.

C.2.5.1 Spill Reporting Requirements: The contractor is responsible for reporting any spills in accordance with host nation or local law or regulation. Contractor is responsible for reporting to the COR and CO all spills of special (or hazardous) wastes, regardless of quantity. Spills shall be reported by telephone to the COR immediately following the incident conveying to the COR, the item spilled, quantity spilled and the exact date, time, and location of the spill. In addition to the telephonic report, the Contractor shall provide a written report to the CO no later than two (2) calendar days after the telephonic report. When reporting a spill the following information shall be furnished:

(i) Item spilled;

(ii) Quantity spilled;

(iii) Exact date, time, and location of spill;

(iv) Initial actions taken and time actions were taken;

(v) Anticipated cleanup and disposal procedures; and

(vi) Persons contacted or present at the time of the spill

C.2.5.2 Spill Report: Upon completion of the spill cleanup and disposal of the spill residue, the contractor shall submit a summary report of the spill to the COR and CO. The report shall include cleanup and disposal procedures taken, outside assistance required (if any), personal injury involved, and the names and telephone numbers of all national, regional or local officials contacted.

C.3 RECYCLING AND DISPOSAL

C.3.1 Recycling: When economically feasible, the contractor shall recycle scrap material to the greatest extent possible. Scrap material shall be segregated, identified with magnetic signs and accounted for in accordance with the CLIN descriptions in Section B, Schedule of Prices/CLIN List.

The contractor shall report the volume and percentage of scrap material recycled for each scrap CLIN.

For reporting purposes under this contract, incineration shall not be included as recycling.

C.3.2 Disposal: The contractor shall be responsible for the proper disposal of all non-salable scrap materials. Disposal shall be in accordance with all U.S./Japanese environmental laws and regulations.

C.4 COMPLIANCE WITH LAWS

C.4.1 Compliance Terms and Conditions: The contractor shall be knowledgeable of and comply with all applicable portions of the most current Japanese Environmental Governing Standards (JEGS), the Home Appliance Recycling Law (Government of Japan), Article 3 of “Waste Management and Public Cleansing Law “ (Government of Japan) and all Japanese national, prefectural and local environmental laws and regulations governing the requirements of this contract. The contractor shall identify and obtain all licenses and pay all fees and other charges required with no reimbursement from the Government.

C.4.2 ENVIRONMENTAL MANAGEMENT SYSTEM (EMS):

C.4.2.1 Introduction: The DLA Disposition Services implemented EMS in accordance with E.O.

13148, ISO 14001:2004(E), DoD, and DLA requirements. An EMS is an overall management system that includes organizational structure, planning activities, responsibilities, practices, procedures, processes, and resources for developing, implementing, achieving, reviewing, and maintaining the environmental policy of an organization. The DLA Disposition Services EMS is designed to ensure that all personnel, including contract personnel, whose work activities can cause real or potential significant environmental impact are aware of how their work supports the EMS and are competent to perform their roles, responsibilities and authorities while supporting the DLA Disposition Services Mission. The DLA Disposition Services EMS program is explained in DRMS-I 6050-2, Environmental Management System (EMS) Core Instruction available online at: https://www.drms.dla.mil/gov/publications/4160.14/6050.2.pdf Site supplements detail information required by EMS at a local level such as local, state, and host environmental regulations as well as local emergency procedures and operating systems unique to the location. Site supplements also contain information concerning the local interaction between the DLA Disposition Services tenant appropriate facility and the DOD/DLA host facility EMS program.

C.4.2.2 EMS Requirement: Contractors and their personnel are required to be aware of EMS policies to perform work and/or gain access to an installation. FAR clause 52.223-5 (c)(7) and (c)(8), Pollution Prevention and Right-to-Know Information requires contractors to provide information needed by a facility to maintain an EMS per section 401 of E.O. 13148. Each DLA Disposition Services appropriate facility maintains EMS awareness posters that identify the DLA Disposition Services Environmental Management Representative (EMR) for specific guidance concerning an individual facilities’ EMS Program.

C.5 CUSTOMS

C.5.1 Customs Duty Tax and Clearances: Because the Government generates the scrap material, customs duty or tax may be required on all items. The Government will ensure timely notification to local customs offices. The contractor is responsible for coordinating and fulfilling any customs clearance requirement with the appropriate office for removals at no additional cost to the Government.

An approved copy of the customs clearance must be provided to the COR prior to removal of property from Government collection sites.

C.6 DEMILITARIZATION (DEMIL) / MUTILATION / DEMANUFACTURING (DEMAN)

C.6.1 CLINs 0043 _ B, 1043_B, 2043_B and 0044_D, 1044_D, 2044_D:

(a) The contractor is responsible to operate the demilitarization performance area and to perform required demilitarization / mutilation / demanufacturing. The contractor must ensure that all DEMIL, Mutilation and DEMAN required items are totally destroyed / mutilated and made unfit, so as to preclude restoration or repair to a usable condition by CUTTING, TEARING, SCRATCHING, CRUSHING, BREAKING, BUNCHING, SHEARING, BURNING, SMELTING, OR

NEUTRALIZING THE ITEM TO THE POINT THAT THERE ARE NO USABLE PARTS

REMAINING and ensure a DEMIL / Mutilation / DEMAN certificate is completed and signed by approved certifiers and verifiers. Employees performing the demilitarization are required to be in possession of all required permits (i.e. torch cutting permits, shredder operator license, etc.) and must comply with all U.S. and Japan regulations applicable. Employees performing demilitarization / mutilation or demanufacturing must complete all required training and be qualified DEMIL certifiers per U.S. Government requirements; see Sections C.0.5, C.16.6 and C.19.2. Certification will be completed immediately after the DEMIL / Mutilation / DEMAN is complete. Performance is not complete until the certificates are signed and dated.
