Notes: (1) The Government reserves the right to conduct additional surveillance/review of final payment information and/or delay all payments until after final payment and scrap tracking information is received if warranted due to performance problems.

(2) The 10-100% reduction for a failed APL is taken off of hte task order amount. The cumultive reduction for failed APLs cannot exceed 100% of the task order amount.

ATTACHMENT 2

DEFINITIONS

(a) Ammunition, Explosives and Dangerous Articles (AEDA). Any substance that, by its composition and chemical characteristics, alone or when combined with other substances(s), is or becomes an explosive or a propellant, or is hazardous or dangerous to personnel, animal, or plant life, structures, equipment, or the environment as a result of blast, fire, fragmentation, radiological or toxic effects.

(b) Certifier. A technically qualified Government representative (U.S. or foreign) appointed to sign the certification (there is a permanent waiver to allow contract labor to certify, and actually perform/supervise the required Demilitarization/mutilation/demanufacturing).

(c) Classified Item. An item which must be protected from unauthorized disclosure in the interest of national security. Items of this nature are assigned a security classification.

(d) Containers. Any portable device with lid in which a scrap material is stored, transported, disposed of or otherwise handled.

(e) Contracting Officer (CO). A person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings. The term includes certain authorized representatives of the contracting officer acting within the limits of their authority as delegated by the contracting officer. "Administrative contracting officer (ACO)'' refers to a contracting officer who is administering contracts”. Termination contracting officer (TCO)" refers to a contracting officer who is settling terminated contracts. A single contracting officer may be responsible for duties in any or all of these areas. Reference in this regulation to administrative contracting officer or termination contracting officer does not

(1) Require that a duty be performed at a particular office or activity or

(2) Restrict in any way a contracting officer in the performance of any duty properly assigned.

(f) Contracting Officer’s Representative (COR). Individual designated in accordance with subsection 201.602-2 of the Defense Federal Acquisition Regulation Supplement and authorized in writing by the contracting officer to perform specific technical or administrative functions. The CORs under this contract will be located at DLA DISPOSITION SERVICES Misawa, Sagami, Iwakuni and Okinawa. The CORs will be the contractor's primary points of contact for the duration of this contract. The COR is not authorized to make any commitments or changes that will affect price, quality, quantity, delivery, or any other term or condition of the contract.

(g) DLA DISPOSITION SERVICES Pacific. Located in Pearl Harbor, Hawaii, provides oversight of operations to the DLA DISPOSITION SERVICE Sites outside of the United States located in the Pacific.

(h) DLA DISPOSITION SERVICES Site. The field office that processes and disposes of U.S. Government property.

(i) Demanufacturing. To render specified unusable or obsolete Government-owned electrical and electronic equipment completely unusable by total disassembly, shredding or destroying it, recovery of hazardous components and proper disposal.

(j) Demilitarization (demil). A Government term used to define the requirement and the process of destroying Government surplus property. The purpose is to eliminate the offensive or defensive capability inherent in the equipment and prevent further use for its intended military purpose. Scrap materials received by the contractor may be coded as requiring demilitarization, or as requiring special handling under The Defense Material Disposition Manual DoD 4160.21-M and DoD 4160.22-M or Defense Logistics Agency Regulation (DLAR)

2030.1 Trade Security Control (TSC) Procedures.

(k) Government Personal Property. Property other than real property (buildings/lands) and records (files/documents) of the Federal Government.

(l) Hazardous Material (HM). Any material that is capable of posing an unreasonable risk to health, safety and property that is regulated under the appropriate host nation or European Union storage and transportation laws or regulations.

(m) Hazardous Waste (HW). Any wastes requiring special handling, manifesting or disposal as defined by host nation law, or EU regulations or directives.

(n) Incineration. A thermal treatment technology involving destruction by controlled burning at high temperatures at Government approved facilities.

(o) Mutilation. The act of making material unfit for its originally intended purposes by cutting, tearing, scratching, crushing, breaking, punching, shearing, burning, neutralizing, etc.

(p) Quality Assurance. A planned and systematic pattern of all actions necessary to provide confidence to the Government that adequate technical requirements are established;

products and services conform to established technical requirements; and satisfactory performance is achieved.

(q) Scrap. Material that has no value except for its basic material content.

(r) Segregating/Sorting. The process of identifying the material for its basic material content. The basic material content is established by the DLA DISPOSITION SERVICES personnel. This determination is based on the predominate material composition by weight of an item in the best interests of the U.S. Government. Questionable items will be determined in conjunction with the CO, COR and contractor. The contractor personnel may further break down an item into its individual basic material contents and sort for better scrap grouping. This process is accomplished by the onsite contractor personnel at no additional cost to the Government.

(s) Solid Waste. Includes garbage, refuse and other discarded materials including solid waste materials resulting from industrial, demilitarization/mutilation/demanufacturing processes, commercial, and agricultural operations, and from community activities. Mining and agricultural solid wastes, hazardous wastes, sledges, construction, demolition wastes and infectious wastes are not included in this category.

(t) Task Order. A contractual order for services or a call against an existing order.

(u) Verifier. A technically qualified U.S. Government representative (American Citizen) designated to the certification and actually witnessed the Demil/mutilation/demanufacturing or inspected the residue, and who has the expertise to determine adequacy of Demil/mutilation/demanufacturing.

Position Descriptions

Demil Coordinator The focal point for the DRMO Demil Program.

Perform the following duties:

• Review and ensure implementation of Demil directives and policies.

• Brief the DRMO Chief on any changes in Demil directives, policies and procedures.

• Initiate and work with DRMO employees to submit challenges to demil codes.

• Recommend the most cost-effective manner of accomplishing demil to the DRMO Chief.

• Oversee demilitarization of property to ensure compliance with Demil requirements.

• Assist contracting officer in meeting surveillance requirements for property sold with demil as a condition of sale and for property to be demilitarized by service contract.

• Prepare and submit on-site surveillance plans for demil accomplishment to DRMS-NOS for approval.

• Provide copies of sales referrals, general/specific demil instruction, locally written demil SOPs, etc. for all on-site demil accomplishment to DRMS-NOS for review.

• Ensure all employees involved with demil are trained.

• Review Resi “I” and “W” status reports for necessary action and provide recommendations through supervisory channels to the DRMO Chief.

Verifier Qualifications and description includes the following:

• Must be a technically qualified U.S.

Government representative (American citizen), designated by the responsible commander, who actually witnessed the demilitarization of the material or inspected the residue as provided above.

• Should at least be in the next higher management level of the certifying individual.

Certifier Qualifications and description includes the following:

• Must be a technically qualified

Government representative who actually witnessed the demilitarization of the material whether performed by Government or contractor personnel.

PMB Procedures

1. In accordance with reference (a) and (b), the following procedures are provided for the receipt of property requiring demilitarization at DRMO Sagami.

Step Actions

1 Property is received from Generator. Generating activity provides at least 4 copies of DD FORM 1348-1A. see note below

2 DRMO receiver verifies Demil Code against the physical description of the property, check for critical FSC/FSG, and quantity. Property will be returned to generator upon any unresolved discrepancies found.

3 Property is input into Daisy, DRMO receiver will determine proper DEMIL Code. If necessary, challenge the code when applicable. Any qualified employee can request Demil Code challenges.

4 DRMO receivers will NOT BACHLOT Demilitarization required property including MLI/CCLI and Critical FSGs/FSCs.

5 At ESD property will be input to account as either Demilitarization as Condition of Sale, or DRMO Demilitarization. Upon determination, the Demil Coordinator will give Demil Cards to Logistics Branch Chief who will assign a verifier to complete Appendix 4, Category and Paragraph for proper demil procedures. Demil Coordinator will give the completed Demil Cards to the Receiving Branch to pull property. (All cards will be signed for by receiving branch).

Note: If it is determined to sell property requiring demilitarization as a condition of sale, the DRMO Chief shall be notified for concurrence or non-concurrence. If concurred, surveillance plan must be prepared. In accordance with DRMS-I 4160.14, Volume IB, Supplement 4, for DRMO Chief’s approval. All regulations cited in reference (a) and (b) will be strictly adhered to at all times.

6 The Receiving Supervisor will receive the card(s) and listing from Demil Coordinator and shall process in the following manner.

1. Inventory cards against listing. Take corrective action, if any. Make two copies of the listing and keep one in the DEMIL/DOWNGRADE Binder. Forward one copy to the recycling supervisor.

2. The warehouse supervisor shall coordinate with the recycling supervisor dates and times demil required property is to be delivered to the recycling center. Copies of listing and demil cards MUST accompany the property.

Only items reaching ESD will be pulled, verified and sent to the recycling center. Items that are not demilitarized the same day shall be relocated to the recyclable security cage for demilitarization at a later date.

3. Once pulled and verified… the warehouseman shall initial and date the demilitarization cards and attach the card to the item. If there are any discrepancies found the warehouseman must immediately notify his supervisor.

Demil Center Procedures

Reference:

Position Title Duties and Responsibilities Warehouseman/Forklift operator Transport Demil required property to recycle center for demilitarization.

Recycle Center Staff Receives property and ensures the identification and quantity of the Demil-required property and Demil certification cards (see annex 1) are correct. He then notifies his supervisor with the new location of the items by annotating the list with the change of location to be completed by the supervisor. Note: Demil-required property should be separated and Demil Certification Cards verified on the Demil required property.

Recycle Center Supervisor

Notifies Demil Coordinator to arrange time for verifier and certifier to identify, inspect, verify and certify Demil-required property. Property will be opened and displayed for the Certifier and Verifier prior to Demil.

Note: Demil Coordinator will assign a certifier and verifier to witness the process and complete the demil certification cards within 48 hours of the demil of the item.

Verifier Ensure Certifier is present. Review Demil Certification Card(s) for property to be Demilled. Verify that NSN/QTY on Demil Card match the property. Ensure the correct Appendix number, category, and paragraph is annotated on the Demil Certification Card. Note:

Verifier should have the most current copy of the Defense Demilitarization Manual DoD 4160.21-M-1.

Certifier Ensure Verifier is present. Review Demil Certification Card(s) for property to be Demilled. Verify NSN/QTY on Demil Card match the property. Ensure the correct Appendix number, category, and paragraph is annotated on the Demil Certification Card. Perform independent count from verifier. Note: Certifier should have the most current copy of the Defense Demilitarization Manual DoD 4160.21-M-1.

Demil Center Staff performing Demil

Demil Center personnel must do the following:

• Ensure verifier and certifier has identified, inventoried, and verified property to be demilled.

• Ensure property is segregated with Demil Certification Cards on property to be demilled.

• Have the proper equipment and safety equipment.

• Make sure certifier is present while performing

• Perform demil as required.

• Upon completion of demil, ensure verifier and certifier inspect residue.

• Segregate residue and place certification card with Demilled property for verifier and certifier’s inspection.

Verifier Ensure certifier is present. Inspect Demilled property.

If no discrepancies are found, sign and date Demil Certification Card. Ensure Certifier signs card after his inspection. Note: Make sure certifier has signed card prior to you signing the card.

Certifier Ensure verifier is present. Inspect Demilled property. If no discrepancies are found, sign and date Demil Certification Card.

Demil Center Staff performing Demil

Notify supervisor of completion of demil and certification by verifier and certifier. Place debris in designated SCL pile(s) or as instructed by supervisor.

Recycle Center Supervisor

Execute certification of Demilled property. Note:

Certification will normally be made as soon as demil is accomplished, but it must be executed within 48 hours of demil completion. Demilitarized property must be dropped off the DAISY record within 3 days of the completion date.

Supplement 1 DEMIL Certification Card

A certification as quoted below shall be signed and dated by a technically qualified government representative, as designated by the responsible commander or agency chief, who actually witnessed the DEMIL of the material whether performed by government or contractor personnel. In cases where the witnessing of DEMIL would unnecessarily subject the witness to hazardous conditions or when the demilitarized material can be laid out to clearly display the residue from each item demilitarized; DEMIL may be certified through inspection of the residue. The certificate shall be executed for all items demilitarized.

SUBJECT: Off Site Demilitarization Plan for "Camouflage Screening and Liner Package Simple "Via "Japan Scrap Contract"

1. References:

2. Property Location: Okinawa, Japan

3. DEMIL Code: Camouflage Screening - DEMIL “D” verified as correct

4. Determination Statement: Demilitarization by the Japan Scrap Contract is the most economical method. The DRMO does not have the manpower to perform required Demilitarization. Due to continuous generations of Cammo Netting, this demilitarization plan is requested as permanent.

5. Method and degree:

a. Accomplished OFF Government premises only.

b. To be accomplished by Burning to the extent necessary to eliminate functional or military capabilities and to preclude restoration and for repair to a usable condition.

6. Equipment required: -- Furnace

7. Safety and Occupational Health: Employees performing surveillance have been briefed on applicable safety Procedures as outlined in DRMSI 4160.14, Section 1, Chapter 3, Paragraph 7, Safety and Occupational Health Instruction.

a. Operations will commence once the DRMO Area Manager / Demil Coordinator [or designee] has inspected the work area and equipment to be used and is satisfied that all safety equipment is in the place.

8. Demilitarization Work Plan:

a. The contractor can destroy approximately 6,000 lbs per day. It is estimated to take 12 work days to clear the current inventory of 72,000 lbs.

b. Demilitarization will be accomplished OFF Government premises. The contractor has the equipment required to perform the Demil. Initial movement of property is required since the property is located at DRMOs across Japan.

1. In transit security will be conducted by DRMO personnel accompanyirg the shipment from the Government installation to the contractor's facility.

2. Vehicles will be covered conveyance type.

3. Verifier (U.S. Citizen) / Certifier - Ensure that no property remains onboard the truck prior to the truck's departure from the contractor's facility.

4. In the event that Demilitarization action is not completed in one day the remaining property will be returned to the DRMO under escort of Certifier and Verifier (U.S.

Citizen).

c. Generations average about 100 nets per month. Once the current inventory is demilitarized, future destruction would be scheduled as needed and completed in 1 day.

9. Special Contractor Permit / License: No special permits are required to perform Demilitarization actions or in transporting subject material.

10. Surveillance: Demilitarization surveillance will be conducted by U.S. Government appointed Verifier (U.S. Citizen) and Certifier. These individuals possess the required qualifications and expertise to monitor Demilitarization actions according to DoD 4 160.21-M-1.

11. Surveillance Plan:

a. Verifier (U.S. Citizen) / Certifier - Discuss method and degree of Demilitarization performance and work plan with contractor.

12. Prior to removal of the property from the DRMO the Area Managa will contact the Demil Certifier, Verifier (US. Citizen) and the Contractor to ensure Demil procedures and terms are understood.

Processing of property will not proceed until the aforementioned individuals clearly understand their responsibilities.

13. Contractor - Begin Demilitarization actions in accordance with the agreed upon method and degrees once directed to do so by authorized U.S. Government representatives.

14. Verifier (U.S. Citizen) / Certifier - Survey 100% property being demilitarized and ensure that the material is being properly Demilitarized. Any residue of items not fully destroyed will require further processing until proper destruction is accomplished.

15. Verifier (U.S. Citizen) / Certifier / Contractor - Repeat steps a through c until Demilitarization actions are completed each day.

16. Verifier (U.S. Citizen) / Certifier / Contractor - At the end of the day, all property that has not been Demiled and/or remains uncertified will be put in a vehicle and escorted bad< to the DRMO, perform such verification checks as deemed needed and secure in the DRMO's Demil Area.

17. Certificates: Verifier (U.S. Citizen) / Certifier - Examine Demilitarization residue for proper Demilitarization of material. Once confirmed, then print name, sign, and the date applicable Demilitarization Cerificate(s).

18. Title: Title to property does not pass until the Demilitarization Certificates are signed.

19. Recommendation Statement: Method and degree recommended are in the best interest of the U.S.

Government as applies to economics, controls and financial return to the U.S. Government.

Identify RSC W on a weekly basis and provide listing to Operations Branch Chief for review.

Provide RSC W Listing to PMB Chief for 100% inventory.

Property Management Branch

Conduct 100% inventory for all RSC W Listing and provide results to Operations Branch Chief.

Review results of inventory. Direct the APO/RPO to prepare FLIPL(s) for any discrepancies. Review RSC W Listing and identify if the DEMIL property will require DEMIL by condition of sale or DEMIL by DRMO personnel. Direct the Property Disposal Clerk (PMB) to print out DEMIL Cards for movement of DEMIL required property without discrepancies to the Central DEMIL Center (CDC) for further action.

Sales Branch Prepare DEMIL property for sales as a condition of sale as directed by the Operations Branch Chief or Designee.

Print the DEMIL cards and provide them to the Property Management Branch for further action.

PMB Chief Warehouseman/Forklift operator

Receive the DEMIL carts and direct two of the Warehousemen/Forklift Operators to inventory and transport DEMIL required property to the CDC for

(CDC)

Receive property and ensure the identification and quantity of the DEMIL required property and DEMIL certification cards (see annex 1) are correct. Notify the supervisor with the new location of the items by annotating the list with the change of location to be completed by the supervisor. Note: Demil-required property should be separated and Demil Certification Cards verified on the Demil required property.

CDC Supervisor Notifies Demil Coordinator to arrange time for verifier and certifier to identify, inspect, verify and certify Demil-required property. Property will be opened and displayed for the Certifier and Verifier prior to Demil.

Note: Demil Coordinator will assign a certifier and verifier to witness the process and complete the DEMIL certification cards within 48 hours of the demil of the item.

Verifier Ensure Certifier is present. Review Demil Certification Card(s) for property to be Demilled. Verify that NSN/QTY on Demil Card match the property. Ensure the correct Appendix number, category, and paragraph is annotated on the Demil Certification Card. Note:

Verifier should have the most current copy of the Defense Demilitarization Manual DoD 4160.21-M-1.

Certifier Ensure Verifier is present. Review Demil Certification Card(s) for property to be Demilled. Verify NSN/QTY on

Demil Card match the property. Ensure the correct Appendix number, category, and paragraph is annotated on the Demil Certification Card. Perform independent count from verifier. Note: Certifier should have the most current copy of the Defense Demilitarization Manual DoD 4160.21-M-1.

Demil Center personnel must do the following:

• Ensure verifier and certifier has identified, inventoried, and verified property to be demilled.

• Ensure property is segregated with Demil Certification Cards on property to be demilled.

• Have the proper equipment and safety equipment.

• Make sure certifier is present while performing demilitarization.

• Perform demil as required.

• Upon completion of demil, ensure verifier and certifier inspect residue.

• Segregate residue and place certification card with Demilled property for verifier and certifier’s inspection.

Verifier Ensure certifier is present. Inspect Demilled property.

If no discrepancies are found, sign and date Demil Certification Card. Ensure Certifier signs card after his inspection. Note: Make sure certifier has signed card prior to you signing the card.

Certifier Ensure verifier is present. Inspect Demilled property. If no discrepancies are found, sign and date Demil Certification Card.

Demil Center Staff performing Demil

Notify supervisor of completion of demil and certification by verifier and certifier. Place debris in designated SCL pile(s) or as instructed by supervisor.

CDC Supervisor Execute certification of Demilled property. Note:

Certification will normally be made as soon as demil is accomplished, but it must be executed within 48 hours of demil completion. Demilitarized property must be dropped off the DAISY record within 3 days of the completion date.

Annex 1

DEMIL Certification Card

A certification as quoted below shall be signed and dated by a technically qualified government representative, as designated by the responsible commander or agency chief, who actually witnessed the DEMIL of the material whether performed by government or contractor personnel. In cases where the witnessing of DEMIL would unnecessarily subject the witness to hazardous conditions or when the demilitarized material can be laid out to clearly display the residue from each item demilitarized; DEMIL may be certified through inspection of the residue.
