1. STATEMENT OF WORK (SOW)

1.0 BACKGROUND

The DLA Disposition Services has the responsibility of disposing and reutilizing excess United States Department of Defense (DoD) property at locations throughout the world. A core mission responsibility of DLA Disposition Services is the reutilization and redistribution of excess military equipment to units located throughout the world. DLA Disposition Services is a Primary Level Field Activity (PLFA) of the Defense Logistics Agency (DLA). Disposition Services is headquartered in Battle Creek, Michigan.

1.1 SCOPE OF WORK AND TASKS

DLA Disposition Services Tucson has a requirement for Grounds Maintenance Services

1.2 CLIN 0001/002/003/004 /DLA Disposition Services Tucson Grounds Maintenance Services (BID Schedule attached 3.0)

A. DESCRIPTION OF WORK: The contractor shall provide all equipment, materials, tools, personnel, labor, supervision, and management necessary to ensure grounds maintenance is performed at DLA Disposition Services Tucson, AZ, in a manner that will maintain healthy grass and professional appearance, in accordance with this Performance Work Statement (PWS). The contractor shall accomplish all grounds maintenance tasks identified in this PWS and appendices A and B, in order to meet the requirements and the Services Summary. A map of the area maintained are provided in Appendix A, Area Maps and Site Plans. Specific ground area measurements are established in Appendix B, Ground Maintenance Estimated Quantities. All work performed by the contractor shall be in accordance with all applicable laws, regulations, standards, instructions, and commercial practices.

1.3 SITE VISITS

The facility where work will be performed is available for any potential offeror to visit. A site visit is strongly suggested for any potential offeror. The facility is available between the hours of 6:00 a.m. and 2:00 p.m., Monday through Friday at DLA Disposition Services Tucson excluding Federal Holidays. To coordinate a site visit contact:

1.4 GOVERNMENT RESPONSIBILITY

Provide access to yard during normal working hours of 0700-1200 Monday through Friday excluding Federal Holidays at DLA Disposition Services Tucson for inspection and execution of contract when awarded and provide a representative on-site at DLA Disposition Services Tucson when contractor commences work.

1.5 PERIOD OF PERFORMANCE

All work shall be complete 30 business days from date of award.

1.6 SAFETY

The contractor shall perform all operations in a prudent, conscientious, safe and professional manner. At a minimum, the contractor’s personnel and equipment shall comply with applicable DOT, federal, state, local and host installation laws, safety regulations and procedures, and contractor shall ensure that its agents, employees, and subcontractors perform in a safe manner. The contractor shall ensure all personnel involved in performing on this contract are trained for the level of expertise required for proper performance on this project. Personal protective equipment shall be provided by the contractor and must be appropriate for the task. The Contractor agrees that his personnel and equipment are subject to safety inspections by Government personnel on a Government installation or when moving any Government owned property.

1.7 SAFE WORK CONDITIONS

Contractor Responsibility - The contractor shall assume full responsibility and liability for compliance with all applicable local, state and federal, regulations pertaining to the health and safety of personnel and environmental management during the execution of work.

All work shall be completed and performed in accordance with the best practices of the trade and in compliance with all-applicable federal, state and local codes.

1.8 PERMITS

The contractor shall be responsible for obtaining any necessary licenses, permits if applicable, and for complying with any applicable State/Federal laws, codes and regulations in connection with the execution of the work.

1.9 CLEANUP OF SPILLS OR LEAKS

The contractor is solely responsible for any and all spills or leaks during the performance of this contract that occur as a result of or are contributed to by the actions of its agents, employees, or subcontractors. The contractor agrees to clean up such spills or leaks in a manner that complies with applicable environmental and Safety laws and regulations, Federal, and local laws and regulations. This cleanup is at no cost to the Government. The contractor shall immediately notify the on-site government representative if a spill occurs.

1.10 INDEMNIFICATION

The Government assumes no liability for any damage to the property of the Contractor, to the property of any person, or public property or for personnel injuries, illness, disabilities or death to the Contractor, Contractor’s employees, and any other person subject to the Contractor’s control or any other person including members of the general public; caused in whole or in part by, (a) the Contractor’s breach of any term or provision of this contract; or, (b) any negligent or willful act or omission of the Contractor, its employees or subcontractors in the performance of this contract. The Contractor also agrees to hold the Government harmless and indemnify the Government for any and all costs, including those that arise from violation of environmental regulations, Department of Transportation (DOT), or any similar state enforcement programs under which the government incurs environmental clean-up or response costs, judgments, action, debt, liability costs and attorney’s fees or any other requests for monies or any other type of relief arising from or incident to the processing, transporting, and disposal of any subsequent operation performed upon, exposure to or contact with any component, part, constituent or ingredient of this item, material or substance, whether intentional or accidental.

1.11 DLA DISPOSITION SERVICES ENVIRONMENTAL MANAGEMENT SYSTEM (EMS)

DLA Disposition Services implemented EMS in accordance with ISO 14001:2004(E), DOD and DLA requirements at all DLA Disposition Services appropriate facilities. An EMS is an overall management system that includes organizational structure, planning activities, responsibilities, practices, procedures, processes and resources for developing, implementing, achieving, reviewing and maintaining the environmental policy of an organization. The DLA Disposition Services EMS is designed to ensure that all personnel, including contract personnel, whose work activities can cause real or potential significant environmental impact, are aware of how their work supports the EMS and are competent to perform their roles, responsibilities and authorities while supporting the DLA Disposition Services mission. The DLA Disposition Services EMS program is explained in DRMS-I 6050.2, Environmental Management System (EMS) Core Instruction. Site supplements detail information required by EMS at a local level such as local, state and host environmental regulations as well as local emergency procedures and operating procedures unique to the location. Site supplements also contain information concerning the local interaction between the DLA Disposition Services tenant appropriate facility and the DOD/DLA host facility EMS program. Contractors and their personnel are required to be aware that each DLA Disposition Services appropriate facility has an EMS and to be aware of EMS policies to perform work and/or gain access to an installation. Each DLA Disposition Services appropriate facility maintains EMS awareness posters that identify the DLA Disposition Services Environmental Management Representative (EMR) and Host facility EMR for specific guidance concerning an individual facilities’ EMS program. Contractors may request current copies of EMS information identified in this paragraph by sending an e-mail request to DRMSEMR@dla.mil.

1.13 INVOICING AND PAYMENT – SERVICES

(a) The contractor shall be paid upon submission of a proper invoice for services performed and accepted. Invoice must be certified by the government representative. Once the invoice has been accepted /certified / signed, the invoice shall be forwarded via e-mail to DESBattleCreekInvoices@dla.mil. After receipt processing, DES-WRF will facsimile the contractor’s invoice to DFAS-Columbus for subsequent payment. To ensure payment, invoices must include the information required by Federal Acquisition Regulation (FAR) 52.212-4(g). FAR Clause may be accessed on the Internet at http://farsite.hill.af.mil

(b) All payments will be made in accordance with the clause entitled: PROMPT PAYMENT, FAR 52.232-25 (OCT 2003).

1.14 QUOTE SUBMISSION

Offers submitted in response to this Request for Quote (RFQ) shall be in the English language and in terms of United States Dollars (USD). Offerors are required to submit completion of all CLINs on the bid schedule; and completed FAR 52.212-3 with their quote package. Copies of the Federal Acquisition Regulation (FAR) clauses may be accessed on the Internet at http://farsite.hill.af.mil.

2.0 EXECUTION OF WORK: The Contractor shall perform, at least at the minimum standard indicated, the following work. All dates, quantities, and formulations are approximations. Specific dates, quantities, and formulations will be in accordance with the standards established in the Contractor's monthly schedule; in allowance of weather, ceremonial events, and other considerations.

A. PRUNING:

(1) Shrubs: Plants will be informally pruned, unless designated to be formally sheared, according to standard horticultural procedure to maintain proper size while retaining the natural characteristics of the plants. Because of space limitations and growth habit, some shrubs may require more than one pruning a year. Individual plants shall be pruned by selectively thinning as much as twenty-five (25) percent of the existing old wood, including branches that are dead, damaged, diseased, or infested. Throughout the year, any damaged or unhealthy branches shall be removed. Bushes along the front of building 7818 should be pruned below the windows on the building.

(2) Scheduling: General pruning shall be done during the dormant season, January and February

(3) Nonplanted Areas: Parking lots, sidewalks, gravel areas, etc. shall be weeded on the average of once every month, or as necessary, to maintain a weed-free environment.

(4) Fences: Fences shall be treated on the average of four (4) times every year (approximately April, June, August and October), or as necessary, to maintain a six (6) inch bare strip on both sides. Perimeter security fences, shall also be maintained with an eight (8) foot wide access clear of brush and trees.
