NOTICE TO OFFERORS
1. Issuing Office:

2. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subpart 12.6 – Streamlined Procedures for Evaluation and Solicitation for Commercial Items. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This is a Request for Quote (RFQ) and the RFQ number is
SP330020Q0063.
3. This notice incorporates provisions and clauses in effect through Federal Acquisition Circular (FAC) 2020-05 effective 27 February 2020 and Defense Federal Acquisition Regulation Supplement (DFARS) DFARS Publication Notice (DPN) 20200114 effective 14 January 2020 and Defense Logistics Acquisition Directive (DLAD) Current to Revision 5 and PROCLTR 20- 04 effective 23 March 2020. 4. This Request for Quotation (RFQ) is being issued to establish a Fixed Price (FFP) to perform physical examination testing for new hire candidates at DLA Distribution Warner Robins, Georgia. The services shall be performed in accordance with the Performance Work Statement (PWS) provided as Attachment 1. The Government intends to award one (1) contract as a result of this RFQ and will be issued on a Standard Form (SF) 1449. This acquisition is not a Defense Priorities and Allocations System (DPAS) rated procurement.
5. This RFQ is being solicited 100% Set Aside for Small Business Concerns. The North American Industry Classification System (NAICS) code for this project is 621111 and the size standard is $12.0 M. The Product or Service Code (PSC) for this acquisition is Q403.
6. Period of Performance shall be on or about as follows:
Base Year: June 1, 2020 through May 31, 2021 Option Year One (If exercised): June 1, 2021 through May 31, 2022 Option Year Two (If exercised): June 1, 2022 through May 31, 2023
7. ESTIMATED QUANTITIES: The quantities shown in the Schedule of Supplies/Services are estimated only.
They represent the Government’s best-known estimate for each line item. Payment will only be for the actual quantities provided to the Government at the price specified. If the Government requirements do not result in the quantities estimated; such event shall not constitute the basis for an equitable price adjustment under the contract.
8. 9. INVOICING AND PAYMENT: Invoicing and Payment will be made via Wide Area Work Flow. See
DFARS Clause 252.232-7006.
10. MARK CONTRACT NUMBER ON ALL CORRESPONDENCE: Contractor must mark the contract or purchase order number on all paperwork and shipments. The order number must appear on the exterior of the shipment. Failure to follow these instructions will hold up payment to you and could result in the return of merchandise at your expense.

Question(s) must be received by 10:00 AM EST on 14 April 2020. Answers to questions will be posted to the FEDBIZOPPS website via an amendment to the solicitation.
12. The Government is not soliciting for the “same old way” of doing business. The Government encourages quotes that will achieve savings through innovative processes. Furthermore, DLA Distribution personnel are working to eliminate unnecessary requirements and negotiating for a reduction in supplies/material prices. Therefore, your assistance is requested in reducing prices and improving our buying process.
13. This requirement is subject to the Service Contract Act. Wage Determination No. 2015-4505 Revision No.
14 dated 12/23/2019, provided as Attachment 3. Pursuant to FAR 52.222-42, Statement of Equivalent Rates for Federal Hires, the following data is provided for informational purposes only and is not a Wage Determination. The Wage Grade equivalent to this position is as follows:
Scheduler (Drug and Alcohol Testing) = WG-08 $22.92/hour
14. INSURANCE: Reference FAR Clause 52.228-5 Insurance-Work on a Government Installation located in this solicitation. The minimum amount/kind of insurance is shown below:
Workers’ Compensation and Employer’s Liability - $100,000 (except in states with exclusive or monopolistic funds that do not permit workers’ compensation to be written by private carriers.)
General Liability- $500,000 per occurrence Automobile Liability – Property damage $20,000 per occurrence, Bodily injury $200,000 per person and
$500,000 per occurrence
When requested by the Contracting Officer, the Contractor shall provide a copy of all subcontractors’ proofs of required insurance no later than five (5) days before each subcontractor commences work on the Government installation.
15. SUBMISSION OF SERVICE/DELIVERY SLIPS: Service verification slips must be delivered to the
Contracting Officer’s Representative (COR) following each on-site visit. Verification slips shall include the contract number, person’s name who performed the service, date of time of performance, duration of service, and the tasks performed. All verification slips must be signed by an authorized person for whom the service was performed. Failure to comply will result in a delay in payment.
16. ILLEGAL ITEMS NOT AUTHORIZED ON FEDERAL INSTALLATION: Illegal drugs, guns or other contraband are not authorized on this Federal installation. It is the contractor’s responsibility to ensure that its employees working on-site at this installation are U. S. citizens or legal aliens with no outstanding warrants.
This installation is manned by a DoD Police Force who possesses apprehension authority, which includes holding suspects for local authorities. The local authorities can issue a citation that charges the individual with a specific offense and requires the individual to appear before a Federal Magistrate. This agency processes illegal aliens in accordance with INS instructions.
17. MANAGEMENT OF CONTRACTOR EMPLOYEES: The Contractor personnel are employees of the Contractor and under the administrative control and supervision of the Contractor. The Contractor, through its mailto:alexander.ramirez@dla.mil personnel, shall perform the tasks prescribed in the Performance Work Statement. The Contractor shall select, supervise, and exercise control and direction over its employees under this contract. The Contractor shall not supervise, direct, or control the activities of the Government personnel or the employee of any other contractor, except any subcontractor employed by the Contractor on this contract. The Government shall not exercise any supervision or control over the Contractor in the performance of contractual services under this contract. The Contractor is accountable to the Government for the actions of its personnel.
18. ORGANIZATIONAL CONFLICT OF INTEREST: The contractor shall be ineligible from participation as a contractor, subcontractor, or consultant in any procurement arising or resulting from any of the services provided to DLA on this contract. This restriction includes providing services to any potential bidders on such procurements. The contractor shall not incorporate its product or services in any Performance Work Statement or specification unless directed to do so in writing by the Contracting Officer.
If the contractor, in the performance of this contract, obtains access to information such as plans, policies, reports, studies, financial data, internal data, or any other non-public information or information by the Privacy Act, the contractor agrees not to release such information without prior written approval from the Contracting Officer. The use of such information for personal gain is prohibited.
In addition, the contractor agrees that to the extent it receives or is given access to proprietary data, or other confidential or privileged technical, business, or financial information under this contract, it shall treat such information in accordance with any restrictions imposed on such information.

Offerors shall quote Firm Fixed Unit Prices for all line items shown on CLIN 0001 through CLIN 0003. All unit prices should be quoted as FOB DESTINATION pricing. ESTIMATED QUANTITIES: The quantities shown in the Schedule of Supplies/Services are estimated only. They represent the Government’s best-known estimate for each line item. Payment will be made only for the actual quantities provided to the Government at the price specified. (d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

FAR 52.217-8 – Option To Extend Services (Nov 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed six (6) months. The Contracting Officer may exercise the option by written notice to the Contractor within thirty (30) days.

DFARS 252.232-7006 Wide Area Workflow Payment Instructions (DEC 2018)
(a) Definitions. As used in this clause—
• “Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
• “Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
• “Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.
• “Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall—
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and
(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.
(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/
(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.
(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (AUG 2019)
(a) Definitions. As used in this provision--Covered telecommunications equipment or services, Critical technology, and Substantial or essential component have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing--
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

DLAD 52.233-9001 Disputes – Agreement to Use Alternative Dispute Resolution (ADR) (DEC 2016)
(a) The parties agree to negotiate with each other to try to resolve any disputes that may arise. If unassisted negotiations are unsuccessful, the parties will use alternative dispute resolution (ADR) techniques to try to resolve the dispute. FILE I – Technical Capability
The offeror shall provide the following information (including any descriptive literature) which demonstrates that the offeror clearly and fully understands and meets the minimum technical requirements necessary to perform physical examination testing for new hire candidates according to the requirements of this solicitation.
The offeror shall submit a current medical license in good standing with the State of Georgia and have a minimum of 3 years work experience in occupational medicine.
The offeror shall demonstrate a working knowledge of Federal Occupational Safety and Health Administration (OSHA) Code of Federal Regulations (CFR), be able to evaluate and interpret test results, and possess experience in conducting conditional pre-employment assessments and making specific oral/written recommendations based on test outcomes.
The offeror shall demonstrate knowledge of medical requirements/standards associated with specific position descriptions and have the ability to assess Government personnel for employment in accordance with DOD standards of fitness.
The offeror shall demonstrate the designated facility is located within a 40-mile one-way range from DLA Distribution Warner Robins, Georgia.
FILE II – Past Performance
The offeror shall describe its background, knowledge and experience related to the performance of the physical examination testing in this solicitation. Of particular emphasis is performance that was executed in accordance with the same or similar scope and magnitude that is described in this solicitation. Past performance information is used in determining the level of confidence the Government has for successful performance based upon the offeror’s actions under previously awarded, recent and relevant contracts.
The Government shall only consider recent and relevant past performance data. To be considered recent the contracts should have been performed within past five (5) years from date of issuance of this RFQ. To be considered relevant, the offeror must demonstrate past execution of similar contracts in terms of scope, complexity, magnitude of effort, and schedule. The offeror must demonstrate through past performance an ability to perform the work described in the solicitation. This is done by demonstrating that it has successfully executed recent contracts of similar scope and magnitude within the past five (5) years (The Government recommends submission of at least three contracts, but will evaluate any and all submitted). Offerors shall provide contract numbers for any government contracts completed within the past five years. If subcontractor experience is provided as part of the most relevant contracts provided, it will be given weight relative to the percentage of effort being provided by that particular subcontractor in the offer submitted. The references will be evaluated in the aggregate in order to allow offerors who may not have the entire scope, magnitude, and complexity of the requirement under one individual contract to still be considered relevant if experience with the full scope, magnitude, and complexity of the requirement can be demonstrated within the allotted number of references as described above.
If an offeror or its subcontractor determines it has no past performance data, it shall provide the following statement in lieu of the information requested below: “(Insert offeror or subcontractor’s name) has determined that it possesses no past performance information in accordance with the solicitation.”
To be compliant with this factor offerors shall provide the following information for both the offeror and proposed subcontractors:
