Rosebud Agency Mission, South Dakota

Bureau of Indian Affairs Quarters Units 101 and 103 Hazardous Materials Survey Service

Scope of Work

BACKGROUND

The Rosebud Agency is located at Mission, South Dakota. The two quarters units have been declared excess property by the Bureau of Indian Affairs (BIA), Rosebud Agency. The project location is Rosebud, South Dakota 15 Miles Southwest of Mission, South Dakota. West on US Highway 18 to BIA Highway 1 West. Upon completion, these 2 quarters units are to be transferred to the Rosebud Sioux Tribe for their use.

This Scope of Work is for the determination of hazardous materials that may have been used for the initial construction of the two quarters units. This survey is necessary for the transfer of ownership to the Rosebud Sioux Tribe and or for demolition. The following General Scope of Work outlines the Tasks and additional criteria involved to accomplish this service.

GENERAL SCOPE OF WORK

The intent of this project is to obtain environmental services to perform an environmental survey to determine if the two quarters units contain asbestos, lead paint, mold, or other hazardous materials. The Contractor shall provide all plant, labor, materials, equipment, and personnel necessary to complete the environmental survey and all testing services. The Contractor shall survey the two units to identify all hazardous materials that may be present, perform all testing needed, prepare a written report of the findings complete with a recommendation for the abatement of the hazardous materials.

At a minimum the work shall include the following.

• Perform an environmental survey of the structures to determine if hazardous materials are present.

• Perform all necessary testing to identify hazardous materials.

• Prepare a written report summarizing the findings

• Provide recommendations for the removal of all identified hazardous materials.

• Provide EPA/State certified personnel including industrial hygienists and others as pertains to the type of work being performed.

• Key personnel in each discipline shall participate in an on-site pre-bid meeting with Great

Plains Region – Division of Facilities (GPR-DF) staff.

• All services shall be completed by firms that offer environmental services and analytical support. All individuals performing the work shall hold certifications and or licenses necessary to perform this type of work in the State of South Dakota.

• All laboratory analyses performed shall be according to EPA, NIOSH, OSHA, FDA and or other approved methods.

• The survey and testing shall all be performed in a manner which that meets industry standards.

The scope of work for this project is divided into Two (3) sections as follows:

Task 1 – Project Management, Quality Control, and Data Collection Task 2 - Field Investigation, Material Testing & Report Task 3 – Industrial Hygienist Services (Option Item)

The completion date for Tasks 1 is a total of 45 calendar days upon receipt of the Notice to Proceed. Task 2 shall be completed within 90 days upon receipt of the Notice to Proceed. Task 3 will be an option item that the BIA may choose to exercise.

TASK 1 - PROJECT MANAGEMENT, QUALITY CONTROL, & DATA COLLECTION

The Contractor shall designate a point of contact for coordination of this project. This individual shall have overall responsibility for the performance of the work to ensure the work is progressing on schedule and within budget.

The Contractor shall maintain communication records, cost-tracking information monthly, project budget summary sheet, project log, all project related conversations, meeting notes, and quality assurance audits and make these available to the BIA as requested. Invoices shall be in a format meeting the needs of the BIA.

The Contractor shall prepare a project schedule noting the submittal points for each task and other critical phases. The proposed schedule will incorporate a timeline beginning at the notice to proceed and ending with the completion and submission of all reports and recommendations.

A project kick-off meeting shall be held within 10 calendar days of notice to proceed by teleconference. The purpose of the meeting is to gather existing data, establish goals, objectives, and criteria for the project and to develop alternative approaches as needed.

Task 1 Deliverables: Kick-off meeting memorandum, Project Schedule, field investigation, material testing and written environmental report with recommendations.

TASK 2 - FIELD INVESTIGATIONS

The contractor will conduct site investigation, fact finding and gathering, analysis, documentation, and coordination of data with the BIA.

The BIA will provide any and all records to the contractor to assist with the contractor’s field investigation. The contractor shall visit the project site to investigate the BIA furnished information.

This information is the best available, but the BIA does not guarantee its accuracy or completeness; it is the contractor’s responsibility to verify the completeness, accuracy, and acceptability for use in compiling reports. All work necessary to gather additional information is the contractor’s responsibility and included in the fixed fee cost proposal.

The contractor shall review any BIA provided site maps.

Identify, sample, and test for asbestos containing materials, lead based paint, and other regulated hazardous materials that will be/or has the potential to be disturbed/impacted by the proposed construction.

All additional services (i.e., surveys, soil borings, asbestos surveys, water flow testing, or lead surveys), necessary for a complete the report as outlined in this contract are included in the fixed fee cost proposal unless specifically excluded by the contract.

TASK 3 – INDUSTRIAL HYGIENIST (IH) SERVICES DURING CONSTRUCTION

The BIA will provide day-to-day on-site contact with the Construction Contractor and coordination between the BIA and the Assessment contractor during the Construction Period.

The Construction Period will commence with the award of the Construction Contract(s) and will terminate with the acceptance of the facility by the BIA. The Assessment contractor shall not provide administration of the construction contract. The contractor shall act in an advisory capacity to the Contracting Officer.

The assessment contractor shall not be the representative of the Contracting Officer on the construction site and shall make no such representation to the construction contractor without the specific written approval of the Contracting Officer. The assessment contractor shall have no authority to approve any construction means or methods of work of the Construction Contractor unless it violates EPA Policy regarding the proper containment and air monitoring during remediation activities.

The contractor shall participate in the pre-construction conference. The purpose of this meeting is to clearly establish an understanding of the roles during construction.

During removal of hazardous material (Lead Based Paint, Asbestos, mold, and etc.) from each unit, the Industrial Hygienist (IH) will provide remediation quality control, testing and inspections to include:

• Report directly to the owner or designated representative

• Document the contractor's work practices

• Conduct general air monitoring both inside and outside the asbestos containment work area during asbestos remediation activities

• Monitor work practices, methods, and procedures to assure compliance with the specifications, approved work plans, or other applicable standards

IH will have the authority to require changes in work practices where he/she deems current practices are not appropriate.

The Industrial Hygienist (IH) shall document the contractor's work practices and to conduct general air monitoring both inside and outside the asbestos containment work area during asbestos remediation activities. The IH/technician will report to the owner or designated representative. The on-site IH will be a ND certified air monitoring professional and an EPA tribal lead risk assessor enrolled in the AIHA asbestos registry and identified as proficient.

The IH shall also monitor work practices, methods, and procedures to assure compliance with these specifications, approved work plans, or other applicable standards. The owner's representative and/or IH will have the authority to require changes in work practices where he/she deems current practices are not appropriate.

Abatement activity shall not be allowed without either the IH or owner's representative on-site.

The owner plans to have QA services available for one shift per day, five days per week. The owner will be flexible and provide QA services for longer or different hours so long as the contractor can demonstrate to the owner's satisfaction that it is in the owner's best interest to do so.
