52.212-2 Evaluation - Commercial Items NOV 2021
ADDENDUM TO 52.212-2
Solicitation provision 52.212-2, Evaluation – Commercial Items, is tailored as follows: Paragraph (a), (b), and (c) are deleted and hereby replaced as follows:
(a) Basis of Award: This is a best value source selection conducted in accordance with Federal Acquisition Regulation (FAR) 13.106-2, Evaluation of Quotations or Offers, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS).
Award will be made to a single offeror who is deemed responsible in accordance with the FAR, whose offer conforms to the solicitation requirements, and is determined to be the overall best value to the Government. The offer selected as the best value may be other than the lowest priced offer. The Government reserves the right to negotiate with offerors if so desired.
(b) Evaluation Criteria: Each offer will be evaluated by Government Subject matter experts. Three evaluation factors will be used: Technical, Past Performance, and Price.
(1) Technical: The offeror’s technical approach will be outlined in their staffing plan and confirmed in their Statement of Understanding. Staffing solutions that demonstrate greater capabilities and/or experience will be more highly rated. The Technical Factor will receive one of the ratings defined below:
Rating Description
Very Good The offer indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is very low.
Sufficient The offer meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is low.
Marginal The offer has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is moderate.
(2) Past Performance: The Government will evaluate the offeror’s record of past and current performance to ascertain the probability of successfully performing the required efforts of the PWS.
(i) The Past Performance Factor will evaluate the risk and likelihood that based on the extent and recent/relevant performance, the offeror, will timely and successfully perform to the standards in the
PWS.
(ii) In assessing the relevance of previous performance to the TOR PWS requirements, the Government will consider the degree to which the offeror’s historical performance under other projects proposed or identified are similar to the performance approaches to be employed in the scope contained in this TOR and the quality of that performance. The Government will consider the role of the contractor in the past performance in addition to the similarity of scope in determining the relevance of the performance as a factor in assessing performance confidence. The evaluation will be conducted using Government databases including CPARS.
Rating Description
Substantial Confidence
Based on the offeror’s performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Limit Confidence
Based on the offeror's performance record, the Government has a lower expectation that the offeror will successfully perform the required effort.
(3) Price: The Price Factor evaluation will be conducted on the basis of fixed-price. The proposed fixed-price will be evaluated for reasonableness.
(i) Price Reasonableness: The Government will evaluate the reasonableness of the offeror's proposed price, in accordance with the definition in FAR 31.201-3. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business. Offers with prices that are unreasonably high, unrealistically low, unbalanced, or do not support the technical solution may be eliminated from competition on the basis that the offeror may not understand the requirement and represents too great a risk. If only one offer is received, the contracting officer may follow the procedures at DFARS 215.371-3 in order to establish a fair and reasonable price.
(ii) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement in accordance with FAR provision 52.217-5. The Government may determine that an offer is unacceptable if the option prices are unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). As part of the price evaluation, the Government will evaluate the Option to Extend Services under FAR Clause 52.217-8 by adding one-half of the offeror’s final option period price to the offeror’s total price. Thus, the offeror’s total price for the purpose of the evaluation will include the base period, total of options, and one-half of the last year option to determine the price basis. Offerors are required only to price the base and each option.
Offerors shall not submit a price for the potential one-half year extension of services period. The Government will use the offeror’s final option year price in order to determine the FAR 52.217-8 pricing.
