1.0 Statement of Work

1.1 Scope:

USDA APHIS Plant Protection and Quarantine (PPQ) is looking to establish a five-year Indefinite quantity contract for the procurement of 8 funnel and 12 funnel, wet collection method, Wood Boring multi-funnel traps as well as replacement parts for the funnels.

Replacement parts include all funnels, collection cups, plastic pins, and tops.

1.2 Background:

Semiochemical lures when combined with a variety of traps, including multi-funnel traps have been shown to be an effective monitoring tool for non-indigenous bark and wood-boring beetles. The various trap and lure combinations have enabled the USDA to better contain and monitor potential infestations of these insects. Bark beetles and other wood-boring insects are some of the most serious exotic plant pests threatening forest and environmental resources.

The USDA APHIS PPQ has been tasked by congress with detecting, monitoring and managing these insects. The impact of these insects, should they become established, would have irreversible impacts on natural resources, hinder trade and increase costs of productions.

Ultimately, an eradication and/or control would likely be in the millions of dollars if these insects were to go undetected in our environment.

1.3 Objective:

The requested traps are needed to detect and monitor many existing and potential exotic pest infestations. Without these traps, defining infestations might not be possible and the ultimate cost to the USDA and cooperators of an eradication program could exceed millions of dollars should these lures not be available.

1.4 Shipping/Delivery:

FOB destination to:

USDA APHIS PPQ

Bldg 6420, Moore Air Base 22675 N. Moorefield Rd Edinburg, TX 78541

Containers and closures shall comply with the Interstate Commerce Commission regulations, Uniform Freight Classification rules, or regulations of other carriers as applicable to the mode of transportation.

1.5 Period of Performance:

Base year and four (12 Month) option years

Base Year: 07/07/2023-07/06/2024 Option Year 1: 07/07/2024-07/06/2025

Option Year 2: 07/07/2025-07/06/2026 Option Year 3: 07/07/2026-07/06/2027 Option Year 4: 07/07/2027-07/06/2028

1.6 Package Marking/Labeling:

Each package must be identified on the shipping containers with:

a. Manufacturer’s name

b. Product Name

c. Quantity per container

d. Procurement Number

1.7 Packaging:

1) The individual traps must be packaged so upon removing from packaging there is minimal assembly required of the traps.

2) Packages are evenly packed with the same number of traps per box not to exceed 5 complete traps per.

3) No repackaging of shipments will be required to complete a trap. For example, if the manufacture chooses 5 traps per box, they must contain 5 replicas of all the parts needed for assembly.

4) Each shipment will include a packing slip identifying the following:

a. Manufacturer

b. Contract Number

c. Quantity Shipped

1.8 Shipping:

Material shall be packed for shipment in such a manner that shall insure acceptance by common carriers and safe delivery at destination. Containers and closures shall comply with the Interstate Commerce Commission regulations, Uniform Freight Classification rules, or regulations of other carriers as applicable to the mode of transportation.

1.9 Specifications:

APHIS, through peer reviewed literature, understands that the certain traps in conjunction with semiochemicals can be used to target invasive wood boring insects. The USDA is seeking to purchase 8 and 12 funnel, wet option, Multi- Funnel traps, also known as Lindgren Funnel Traps.

The traps shall:

• Be made of UV protected plastic.

• Have a hemispheric plastic canopy meeting the following conditions:

o protect against rain entering the trap o Provide a mechanism to attach the trap in a vertical position

• Contain 8 or 12 uniform funnels attached to the canopy and each other by strong plastic pins or “legs” which are replaceable and removable.

• Contain a sturdy eyebolt hanger (for easy storage)

• Contain interchangeable parts

• Include a collection vessel that:

o Fits into the bottom funnel by twist –tight motion o Has a drain hole about ¾ of the distance above bottom of the collection cup, the drain hole will be covered by a fine mesh.

o Is able to hold liquid along with insects

• APHIS must be able to place separate orders for all interchangeable parts to include:

o Collection Cups o Funnels (middle and end) o Tops o Plastic pins or “legs”

1.10 Acceptance Criteria:

The order will be accepted at:

USDA APHIS PPQ

Bldg 6420, Moore Air Base 22675 N. Moorefield Rd Edinburg, TX 78541

The acceptance will focus on the following factor:

• Condition of shipping containers upon arrival – those with obvious defects from the shipping process will be rejected. Additional, products must be sent to offset this loss at no expense to the government.

• Apparent similarity of traps components

• Overall readiness of the traps to be deployed

1.11 Sampling and Testing

As part of the USDA APHIS Quality Assurance Surveillance Program (QASP) the government reserves the right to conduct quality testing. The USDA APHIS may perform such testing addressing the following areas:

• Durability of the plastic used

• Ability of parts to be interchangeable

• Assembly time of traps upon receipt.

If a company is found to have provided products that fall outside the prescribed specifications, the company will provide working replacements for these products at no cost to the government.

At the request of the company, APHIS will provide representative samples of the failed products and may be required to arrange for transportation and pay for shipping costs.

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule.

Such orders may be issued from July 7th, 2023 through July 6th, 2028.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract.

In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) A delivery order or task order is considered "issued" when—

(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;

(2) If sent by fax, the Government transmits the order to the Contractor's fax number; or

(3) If sent electronically, the Government either—

(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or

(ii) Distributes the delivery order or task order via email to the Contractor's email address.

FAR 52.216-19 Order Limitations (Oct 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than 200 8-unit or 12-unit traps, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor --

(1) Any order in excess of 2,000 8-unit or 2,500 12-unit traps; or

(2) Any order for a combination of items in excess of 10,000 8-unit or 12,500 12-unit traps; or

(3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in subparagraph (b)(1) or (2) of this section.

(c) Notwithstanding the order maximum of 10,000 8-unit or 12,500 12-unit traps (paragraph (b)(2) of this section), the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b)(1), unless that order (or orders) is returned to the ordering office within 10 business days after issuance, with written notice stating the Contractor’s inability to perform and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from other sources.

FAR 52.216-22 Indefinite Quantity (Oct 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum."

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after July 6th, 2028.

FAR 52.217-2 Cancellation Under Multi-year Contracts (Oct 1997)

(a) "Cancellation," as used in this clause, means that the Government is canceling its requirements for all supplies or services in program years subsequent to that in which notice of cancellation is provided. Cancellation shall occur by the date or within the time period specified in the Schedule, unless a later date is agreed to, if the Contracting Officer-

(1) Notifies the Contractor that funds are not available for contract performance for any subsequent program year; or

(2) Fails to notify the Contractor that funds are available for performance of the succeeding program year requirement.

(b) Except for cancellation under this clause or termination under the Default clause, any reduction by the Contracting Officer in the requirements of this contract shall be considered a termination under the Termination for Convenience of the Government clause.

(c) If cancellation under this clause occurs, the Contractor will be paid a cancellation charge not over the cancellation ceiling specified in the Schedule as applicable at the time of cancellation.

(d) The cancellation charge will cover only-

(1) Costs-

(i) Incurred by the Contractor and/or subcontractor;

(ii) Reasonably necessary for performance of the contract; and

(iii) That would have been equitably amortized over the entire multi-year contract period but, because of the cancellation, are not so amortized; and

(2) A reasonable profit or fee on the costs.

(e) The cancellation charge shall be computed and the claim made for it as if the claim were being made under the Termination for Convenience of the Government clause of this contract. The Contractor shall submit the claim promptly but no later than 1 year from the date-

(1) Of notification of the nonavailability of funds; or

(2) Specified in the Schedule by which notification of the availability of additional funds for the next succeeding program year is required to be issued, whichever is earlier, unless extensions in writing are granted by the Contracting Officer.

(f) The Contractor’s claim may include-

(1) Reasonable nonrecurring costs (see subpart 15.4 of the Federal Acquisition Regulation) which are applicable to and normally would have been amortized in all supplies or services which are multi-year requirements;

(2) Allocable portions of the costs of facilities acquired or established for the conduct of the work, to the extent that it is impracticable for the Contractor to use the facilities in its commercial work, and if the costs are not charged to the contract through overhead or otherwise depreciated;

(3) Costs incurred for the assembly, training, and transportation to and from the job site of a specialized work force; and

(4) Costs not amortized solely because the cancellation had precluded anticipated benefits of Contractor or subcontractor learning.

(g) The claim shall not include-

(1) Labor, material, or other expenses incurred by the Contractor or subcontractors for performance of the canceled work;

(2) Any cost already paid to the Contractor;

(3) Anticipated profit or unearned fee on the canceled work; or

(4) For service contracts, the remaining useful commercial life of facilities.

"Useful commercial life" means the commercial utility of the facilities rather than their physical life with due consideration given to such factors as location of facilities, their specialized nature, and obsolescence.

(h) This contract may include an Option clause with the period for exercising the option limited to the date in the contract for notification that funds are available for the next succeeding program year. If so, the Contractor agrees not to include in option quantities any costs of a startup or nonrecurring nature that have been fully set forth in the contract. The Contractor further agrees that the option quantities will reflect only those recurring costs and a reasonable profit or fee necessary to furnish the additional option quantities.

(i) Quantities added to the original contract through the Option clause of this contract shall be included in the quantity canceled for the purpose of computing allowable cancellation charges.

FAR 52.217-8 - Option to Extend Services (Nov 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

AGAR 452.211-74 - Period of Performance (FEB 1988)

The period of performance of this contract is from 07/7/2023 to 07/6/2028.

AGAR 452.216-73 Minimum and Maximum Contract Amounts (FEB 1988)

During the period specified in FAR clause 52.216-18, Ordering, the Government shall place orders totaling a minimum of 200 8-unit or 12-unit traps, but not in excess of 10,000 8-unit or 12,500 12-unit traps.
