Summary of Solicitation Cover Letter
This solicitation cover letter pertains to Grounds and Parks Maintenance Services for a Texas state or local government entity. The document outlines the procurement of comprehensive grounds and parks maintenance services, though specific quantities and detailed service line items are referenced within accompanying documentation. The solicitation establishes a formal timeline for potential bidders, with response dates and submission deadlines clearly delineated for interested contractors. The letter indicates that a site visit and/or bidder's conference may be scheduled to allow prospective vendors to gain familiarity with the properties and ask clarifying questions about the scope of work. The contract term and any renewal or extension options available to the awarding agency are specified within the solicitation materials.
The cover letter addresses pricing and payment terms, set-asides if applicable to minority or disadvantaged business enterprises, and identifies the incumbent contractor if one exists. Information regarding the funding source, budgeted amounts, and the agency's current maintenance requirements and operational environment is provided to give bidders context for proposal preparation. Any special qualifications, certifications, or bonding requirements necessary for contract award are outlined, along with evaluation criteria that will be used to assess competing proposals. The letter serves as the formal introduction to the complete solicitation package and directs bidders to additional exhibits and supporting documents that contain detailed specifications and contractual terms.

19.1.2 A Bidder may be determined not to be responsible for any factor that supports a reasonable conclusion that the Bidder is not able to perform fully and deliver in compliance with the contract requirements based on past performance, financial capabilities, and business management. Examples of these factors might be inadequate facilities or equipment to perform the work on time, lack of sufficient experience based on the size or complexity of the work, or inability to obtain required bonds or insurance.
19.2 Commissioners Court may award one or more contracts to responsive, responsible Bidders who submits the lowest and best bid for all, or a portion of the items described in the IFB or may reject all bids and issue a new solicitation if the goods or services are still needed. The County may also waive any minor informalities or irregularities in any bid.
19.3 Travis County may award on an “all or none”, or “group” or “line item” basis. The County may accept any item or group of items in this bid, unless the bidder limits acceptance of his bid on an
"All or None" basis. To be considered responsive, bidder must bid on all items in a group or groups that must be awarded together as stated in the IFB. A Bidder may bid on all groups or only some groups.
19.4 The Delivery Time or Delivery Schedule offered by Bidders will be considered in determining the lowest and best bid.
19.5 If the Bidder does not have its principal place of business in Texas, Texas law requires that nonresident Bidder to underbid Texas Bidders by the same amount that Texas bidders would be required to underbid that bidder in its home state. TEX. GOV'T CODE ANN., Ch. 2252. This does not apply to a contract involving federal funds.
19.6 If two or more responsive, responsible Bidders submit the lowest and best bid, the Commissioners
Court decides among them by drawing lots as prescribed by the County Judge. County may not award a contract to a Bidder who is not the lowest dollar Bidder meeting specifications unless, before the award, each lower Bidder is given notice of the proposed award AND an opportunity to appear before the Commissioners Court and present evidence about that Bidder's responsibility or responsiveness.
19.7 Prompt payment discounts will not be considered in determining low bids and making awards.
20.0 PROTEST AFTER AWARD.
20.1 Protests after award must be submitted within 10 Working Days after award by Commissioners
Court. The Purchasing Agent must issue a written decision on the protest within 10 Working Days after date of receipt of it.
20.2 The Bidder may appeal the Purchasing Agent's decision within 10 Working Days after receiving it.
The Bidder must submit the request for an appeal to the Purchasing Agent, who presents it to the
Commissioners Court. The Bidder is notified of the time and place that Commissioners Court will hear the appeal.
20.3 The full description of protest and appeals procedure is described in Section 18.004 Protest of
Award of the Travis County Purchasing Procedures Guide, available at:
21.0 REJECTION OF BIDS. County may reject a bid if it is not satisfactory to Commissioners Court.
21.1 The County may reject all bids and re-advertise if appropriate, whenever it is in the best interest of the County.
21.2 The County may reject any part of a bid unless the bid has been qualified as All or None.
22.0 COUNTY ETHICS POLICY.
