The City is soliciting unit-price bids for two alternative and mutually exclusive configurations: Bid Schedule A comprises approximately 340 linear feet of 17'-5" wide boardwalk extension, while Bid Schedule B comprises approximately 550 linear feet of 12'-wide boardwalk extension. Bidders must submit complete pricing for both configurations, though the City will select and award only one. The scope includes demolition of existing structures, boardwalk construction, ADA-compliant access ramp construction, railing system installation, riprap work, and tie-in to the existing Riverwalk. A mandatory pre-bid conference is scheduled for August 20, 2026, at 10:00 a.m. at Milton City Hall, 6738 Dixon Street, Milton, FL 32570. This project is funded entirely by the State of Florida, with all eligible costs required to be incurred on or before June 30, 2027. The solicitation is issued as a competitive sealed bid pursuant to Florida Statute 255.20, with payment based on actual quantities of work performed multiplied by unit prices bid. Bidders must provide bid security in the amount of not less than five percent of the total bid amount. The successful bidder must furnish Performance and Payment Bonds equal to 100% of the contract price, though bond submission is deferred pending City approval of the land lease for the project site. Liquidated damages are assessed at $500.00 per calendar day for failure to achieve Substantial Completion or Final Completion beyond the contract deadline. Minimum qualifications for bidders include current Florida General Contractor licensure, successful completion of at least three comparable boardwalk or elevated pedestrian structure projects within the past five years, bonding capacity equal to the full contract price, and statutory eligibility including E-Verify compliance. The City requires comprehensive insurance coverage including Commercial General Liability ($1,000,000 per occurrence / $2,000,000 aggregate), Automobile Liability ($1,000,000 combined single limit), Workers' Compensation, and Builders Risk Insurance for the full replacement value of project work.

SECTION 4 – SCOPE OF WORK
4.1 USACE Permit Notice to Bidders
IMPORTANT NOTICE REGARDING USACE PERMIT AND SCHEDULE:
Bidders are advised that the Work is governed by a U.S. Army Corps of Engineers
(USACE) permit which requires the Work to be completed no later than
November 9, 2026. Bidders shall account for this deadline in their proposed schedule, sequencing, manpower, and pricing.
If the full boardwalk extension for the configuration selected by the City (Bid
Schedule A or Bid Schedule B) is not completed by the permit deadline, coordination with USACE will be required to determine what measures may be necessary to allow completion of the boardwalk under a future project. An extension of the current USACE permit is unlikely, and USACE may require submission of a new permit application to authorize any remaining work. Bidders are cautioned to evaluate this risk in preparing their bids.
4.2 Project Description
The Blackwater Riverwalk South Extension Project consists of the construction of a new public boardwalk extending from the southern terminus of the existing
Blackwater Riverwalk. The Work shall be performed in accordance with this
Section, the Contract Documents and Exhibit A – Scope of Work and Technical
Specifications located in Appendix C of this ITB, the construction drawings, and all other applicable Contract Documents.
The City is soliciting unit-price bids for two alternative and mutually exclusive boardwalk configurations for the same Project, and Bidders shall submit complete pricing for both. The Project description set forth below in this Section
4 reflects the Bid Schedule A configuration (approximately 340 LF at a nominal width of 17’-5”). The Bid Schedule B configuration consists of the purchase, construction, and installation of approximately five hundred fifty (550) LF of twelve foot (12’)-wide boardwalk extension and shall be constructed to the dimensions, estimated quantities, and details shown for Bid Schedule B in the Bid
Schedule, the Contract Documents, and Exhibit A. Except for overall length and width and the resulting estimated quantities, the general character, materials, railing configuration, access ramp, tie-in, demolition, and riprap requirements described in this Section apply to both configurations to the extent applicable.
The City will select and award only one configuration.
The Project includes construction of an approximately three hundred forty (340)
LF boardwalk extension (the "Extension"), having a nominal width of seventeen feet five inches (17'-5"), together with one (1) access ramp. The Extension shall be constructed to align with and match the general configuration, elevation, and character of the existing Riverwalk.
The Extension shall include installation of a railing system along the shoreline side only, with no railing installed on the river side, such that the Extension remains open to the Blackwater River consistent with the existing boardwalk design. The
Project also includes removal of the existing deck located at the southern terminus of the current Riverwalk and minor extension and adjustment of existing riprap necessary to accommodate the Extension.
The completed Work shall provide a continuous, functional, and structurally integrated extension of the existing Riverwalk system.
4.3 Scope of Work
The Contractor shall furnish all labor, materials, equipment, supervision, and incidentals necessary to complete the Work as described herein and as further detailed in the Contract Documents.
The Scope of Work shall include, but is not limited to, the following:
1. Demolition and Site Preparation
Removal and lawful disposal of the existing deck at the southern terminus of the Riverwalk, including associated structural components, fasteners, and appurtenances, as necessary to accommodate the Extension.
2. Boardwalk Extension Construction
Construction of an approximately three hundred forty (340) linear foot boardwalk extension south of the existing Riverwalk at an approximate width of seventeen feet five inches (17'-5"), including all structural elements, framing, decking, connections, and appurtenances necessary to provide a complete and functional system. Final dimensions shall be as shown in the Contract Documents.
3. Access Ramp
Construction of one (1) ADA-compliant access ramp, including all required grading, structural components, handrails, edge protection, landings, surface treatments, and connections to the boardwalk system.
4. Railing System
Installation of a railing system along the shoreline side of the Extension only. No railing shall be installed on the river side of the Extension, consistent with the existing design.
5. Tie-In to Existing Riverwalk
Modification of the existing Riverwalk as necessary to provide a continuous and structurally integrated connection between the existing facility and the Extension, including required alignment and elevation adjustments.
6. Riprap Work
Extension, adjustment, and restoration of riprap within the project limits as necessary to support the Extension and maintain shoreline stability.
7. Coordination with City-Provided Services
The City will provide Construction Engineering and Inspection (CEI) services through Poly, Inc. The City will provide geotechnical engineering services through Tierra, Inc., including pile driving criteria, monitoring of production pile installation, and preparation of the Pile Certification
Package. The Contractor shall coordinate the Work with the City's CEI and geotechnical consultants and comply with all applicable inspection, testing, and pile installation requirements. The Contractor shall provide reasonable advance notice for inspections, pile driving operations, and other activities requiring consultant attendance.
8. Schedule Requirement
The Contractor shall achieve Substantial Completion no later than
November 9, 2026, in accordance with the requirements of the applicable U.S. Army Corps of Engineers permit.
9. Permitting and Compliance
The Contractor shall comply with all applicable permits, approvals, and regulatory requirements governing the Work. To the extent caused by the
Contractor's delay, the Contractor shall be responsible for costs associated with additional permitting or permit extensions required due to failure to complete the Work within the permitted timeframe.
10.Complete and Functional Work
The Work shall be delivered as a complete, operational, and fully integrated boardwalk extension. Labor, materials, equipment, and incidental work not specifically described but reasonably necessary for proper completion of the Work in accordance with the Contract
Documents shall be included within the Contractor's scope.
4.4 Payment Application Documentation
The Contractor shall submit payment applications on AIA Forms G702 and G703
(or substantive equivalents), using the Bid Schedule line items as the Schedule of
Values, showing quantities completed and accepted during the period and cumulatively. Each payment application shall be accompanied by (a) before-and-after photographs of the Work for which payment is requested, and (b) a certification by a licensed professional that the quantifiable portion of the Work for which payment is sought is complete. The City may align the timing and number of payment applications with the reimbursement draw schedule of the funding agreement.
4.5 Plans and Specifications
The Work shall be performed in strict accordance with the plans, drawings, technical specifications, and other Contract Documents issued with this ITB, including any addenda.
4.6 Safety and Worksite Conditions
The Contractor shall be solely responsible for initiating, maintaining, and supervising all safety precautions and programs in connection with the Work and shall comply with all applicable occupational safety and health requirements.
The Contractor shall maintain the Project site in a safe condition and take all necessary precautions to protect persons and property.
4.7 Standards of Performance
All Work shall be performed in a good and workmanlike manner, consistent with industry standards and in accordance with the Contract Documents.
Materials and equipment incorporated into the Work shall be new and of suitable quality unless otherwise specified.
4.8 Supervision
The Contractor shall designate a competent on-site superintendent authorized to act on behalf of the Contractor and shall maintain adequate supervision of the Work at all times during performance.
4.9 Work Hours
Work shall be performed during the hours of: Monday – Friday 7 am – 4:30 pm, excluding City-observed holidays.
Work outside of permitted hours may require prior written approval from the City.
4.10 Protection of Property and Coordination
The Contractor shall protect existing facilities, utilities, public and private property, and adjacent improvements from damage arising from the performance of the Work.
The Contractor shall coordinate the Work with the City, utility providers, and other contractors as necessary to ensure orderly and timely completion of the
Project.
4.11 Unauthorized Work
The Contractor shall not perform any work beyond the scope of the Contract
Documents without prior written authorization from the City.
The City shall not be responsible for payment for unauthorized work.
SECTION 5 – COMPENSATION AND
PRICING
5.1 Contract Price
This Solicitation is issued on a Unit Price basis. This Solicitation requests pricing on two alternative and mutually exclusive Bid Schedules (Bid Schedule A and Bid
Schedule B), only one of which the City will select for award. The Contract Price shall be the sum of the products of the actual quantities of Work performed and the unit prices stated in the Bid Schedule selected by the City for award, as adjusted by any Add Alternates accepted by the City and any approved
Change Orders executed in accordance with the Contract Documents.
The estimated quantities set forth in the Bid Schedule are approximate, are provided solely for the purpose of comparing Bids, and do not constitute a representation that actual quantities will correspond. Payment shall be based upon the actual quantities of Work satisfactorily performed and accepted, measured in accordance with the Contract Documents, multiplied by the applicable unit prices.
Each unit price shall constitute full compensation for furnishing and installing the associated item complete and in place, including all labor, materials, equipment, supervision, bonds, insurance, permits, mobilization, overhead, profit, and all incidental work necessary for a complete and functional installation, whether or not each item is specifically identified.
Payment application requirements and invoice documentation shall be governed by the Form of Agreement attached as Appendix C.

Cuba or Syria.
8. Statutory Eligibility. The Bidder must not be debarred, suspended, or otherwise prohibited from contracting with any federal, state, or local government entity pursuant to §§287.133–287.135, F.S.; and the Bidder must comply with §448.095, F.S.
Failure to meet any of the above minimum qualifications may result in the Bidder being determined non-responsible and ineligible for award.
SECTION 7 – SPECIAL REQUIREMENTS
7.1 Grant Funding Disclosure
This project is funded in whole or in part by the State of Florida. All work must be substantially complete, and all eligible costs must be incurred on or before June
30, 2027.
By submitting a bid, the Contractor acknowledges and agrees that this project is subject to the terms and conditions of the State Grant Agreement between the
City and the State of Florida and that certain grant requirements flow down to and are binding upon the Contractor. Those requirements are incorporated in the Contract Documents herein.
7.2 Business Tax Receipts
The successful Bidder shall obtain all required business tax receipts or local occupational licenses required to perform the work within the City prior to issuance of a Purchase Order or execution of the Contract, as applicable.
Submission with the Bid is not required.
7.3 License Verification
The Contractor must submit a copy of its current Florida General Contractor license with its bid. Subcontractors performing specialty work must hold appropriate Florida specialty licenses. The City reserves the right to verify licensure prior to award.
7.4 Insurance
The successful Bidder shall obtain and maintain, at its own expense, the minimum insurance coverages and limits specified in Sections 11.5 – 11.7 and shall maintain such coverage for the duration of the Contract. Proof of insurance shall be submitted to and approved by the City prior to contract execution and commencement of work.
7.5 Bid Bond
Each Bid must include Bid Security in the amount of not less than five percent
(5%) of the total Bid amount, payable to the City of Milton, Florida.
Bid Security shall be in the form of:
• A Bid Bond issued by a surety authorized to conduct business in the State of Florida and accompanied by a current and valid Power of Attorney; or
• A certified check or cashier’s check drawn on an FDIC-insured financial institution.
Failure to submit acceptable Bid Security in the required form and amount at the time of Bid opening shall render the Bid non-responsive.
7.6 Performance and Payment Bonds
Prior to execution of the contract, the successful Bidder shall furnish a performance bond and a separate payment bond, each in the amount of one hundred percent (100%) of the contract price.
Bonds must be:
• Issued by a surety company authorized to do business in the State of
Florida
• Executed on forms acceptable to the City
• Submitted within ten (10) calendar days after the City's written notice of
Land Lease Approval, as provided in Section 7.6.1
• Provided to the City for submission
Failure to provide the required bonds within the specified time may result in forfeiture of the bid security and award to the next lowest responsible and responsive bidder.
7.6.1 Deferral of Performance and Payment Bonds Pending Land Lease Approval
Notwithstanding any other provision of this ITB, and except for the Bid Security required under Section 7.5 (which remains due at the time of Bid submission and is not affected by this Section), the successful Bidder shall not be required to furnish the Performance and Payment Bonds described in Section 7.6 until the
City has obtained approval of the land lease for the Project site ("Land Lease
Approval").
The City will notify the successful Bidder in writing upon receipt of Land Lease
Approval, and the successful Bidder shall furnish the required Performance and
Payment Bonds within ten (10) calendar days after the date of the City's written notice.
The requirement to furnish Performance and Payment Bonds is deferred, not waived. The bonds remain required under §255.05, Florida Statutes. The City shall not issue a Notice to Proceed, and the Contractor shall not commence the
Work, until the required Performance and Payment Bonds have been furnished and approved by the City and Land Lease Approval has been obtained.
Deferral of the bond requirement under this Section does not relieve the Bidder of the obligation, at the time of bid and through award, to demonstrate the capacity to obtain Performance and Payment Bonds in the full amount of the

SECTION 8 – EVALUATION AND BASIS OF
AWARD
8.1 Evaluation
This Solicitation is issued as a competitive sealed bid pursuant to §255.20, F.S.
Award, if made, shall be to the lowest responsive and responsible Bidder whose
Bid conforms in all material respects to the requirements of this ITB.
The lowest responsive and responsible Bidder shall be determined based on the total of the extended unit prices (the Base Bid) stated in the Bid Form.
Because this Solicitation requests pricing on two alternative and mutually exclusive Bid Schedules (Bid Schedule A and Bid Schedule B), the City will first determine which configuration to award based on available funding, the requirements of the funding agreement, and the best interest of the City, and will identify the selected Bid Schedule prior to award. Within the selected Bid
Schedule, award, if made, shall be to the lowest responsive and responsible
Bidder, determined based on the Total Base Bid for that Bid Schedule as stated in the Bid Form.
A Bid that does not provide complete unit pricing for both Bid Schedule A and
Bid Schedule B may be deemed non-responsive. The City reserves the right, in its sole discretion, to select either configuration, to reject all Bids for either or both configurations, and to take any action authorized by applicable law and the
City’s Purchasing Policy.
Where Add Alternates are included, the City may determine award based on the Base Bid amount alone, or the Base Bid plus any combination of Add
Alternates selected by the City.
8.2 Responsiveness
The City will review each Bid to determine whether it is responsive to the requirements of this ITB.
A responsive Bid is one that conforms in all material respects to the Solicitation
Documents without material deviation, reservation, or irregularity.
Failure to submit required forms, failure to acknowledge addenda, failure to include required bonds, or failure to comply with material requirements of this ITB may result in the Bid being deemed non-responsive.
8.3 Responsibility
The City shall determine whether the lowest responsive Bidder is responsible.
In determining responsibility, the City may consider factors including, but not limited to:
• Relevant experience on projects of similar size and scope
• Financial capacity and bonding capability
• Availability of equipment and personnel
• Safety record
• Past performance on public construction projects
• Compliance with applicable statutory requirements
• Ability to obtain required insurance and permits
The City may request additional information to assist in its responsibility and determination. Failure to provide requested information within the time specified may result in a determination of non-responsibility.
8.4 Clarifications
The City may request clarification of information submitted in a Bid for the purpose of resolving ambiguities or confirming compliance with the requirements of this ITB.
Clarifications shall not constitute negotiations and shall not permit modification of price, scope, or other material terms of the Bid.
Clarifications shall not cure a material defect or omission.
8.5 Rejection of Bids
The City reserves the right to:
• Reject any or all Bids.
• Reject a Bid determined to be mathematically or materially unbalanced.
• Waive minor irregularities or informalities that do not affect price, competition, or substantive rights.
• Verify references and qualifications.
• Conduct investigations as permitted by law.
• Award in the best interest of the City as authorized by law.
The City’s determination of responsiveness and responsibility shall be final, subject to applicable protest procedures set forth in the City of Milton
Purchasing Policy 9.0.
8.6 Tie Bids
In the event of a tie between two or more lowest responsive and responsible
Bidders, the tie shall be resolved in accordance with the City of Milton
Purchasing Policy 9.0.
8.7 Bid Bond Return and Validity
Each Bid shall remain firm and shall not be withdrawn for a period of ninety (90) calendar days after Bid opening.
Bid Security of Bidders not under consideration for award shall be returned within a reasonable time after Bid opening. The Bid Security of the apparent successful
Bidder shall be retained until the Contract has been executed and required
Performance and Payment Bonds have been furnished and approved.
If the successful Bidder fails to execute the Contract or furnish required bonds within the time specified, the Bid Security may be forfeited in accordance with
Section 9.5.
SECTION 9 – AWARD PROCESS AND
CONTRACT
9.1 Notice of Intended Award
Following completion of the evaluation described in Section 8, the City will post a Notice of Intended Award identifying the lowest responsive and responsible
Bidder.
The Notice of Intended Award shall be posted in accordance with the City of
Milton Purchasing Policy 9.0.
9.2 Protest Procedures
Any actual or prospective Bidder who is aggrieved in connection with this
Solicitation or the intended award may file a protest in accordance with the procedures and timeframes set forth in the City of Milton Purchasing Policy 9.0.
The protest period shall commence upon posting of the Notice of Intended
Award. Failure to timely file a protest in accordance with Purchasing Policy 9.0 shall constitute a waiver of all protest rights.
9.3 Notice of Award
If no timely protest is filed, or upon resolution of any timely protest, the City may issue a Notice of Award to the successful Bidder.
Issuance of the Notice of Award does not authorize commencement of the
Work and does not constitute a binding contract between the parties.
9.4 Contract Execution and Bond Submission
Within the time specified in the Notice of Award, the successful Bidder shall:
• Execute the Form of Agreement;
• Furnish the required Performance and Payment Bonds in accordance with
§255.05, F.S.; subject to the deferral provisions of Section 7.6.1.; and
• Provide all required insurance documentation.
Execution of the Agreement and submission and approval of required bonds and insurance are conditions precedent to issuance of the Notice to Proceed.
9.5 Failure to Execute or Provide Required Bonds
Failure of the successful Bidder to timely execute the Agreement or furnish required bonds and insurance may result in withdrawal of the award and forfeiture of the Bid Bond as permitted by law.
The City may, at its discretion, award the Contract to the next lowest responsive and responsible Bidder or reject all Bids and re-solicit.
9.6 Notice to Proceed
The Contractor shall not commence Work until the City issues a written Notice to
Proceed. The Contract Time shall commence as stated in the Notice to
Proceed.
9.7 Contract Term
The Contract shall become effective upon execution by both parties and shall remain in effect until Final Completion has been achieved, all closeout requirements have been satisfied, and final payment has been made, unless terminated earlier in accordance with the Contract Documents.
9.8 Contract Time
Substantial Completion shall be achieved within 90 days following the Notice to
Proceed.
Final Completion shall be achieved 120 days following the Notice to Proceed.
9.9 Liquidated Damages
Failure to achieve Substantial Completion within the Contract Time shall result in assessment of Liquidated Damages in the amount of $500.00 per Calendar Day for each day the Work remains incomplete beyond the required completion date.
Failure to achieve Final Completion within the Contract Time shall result in assessment of Liquidated Damages in the amount of $500.00 per Calendar Day for each day the Work remains incomplete beyond the required completion date.
