About this file

This sole source justification document proposes securing contractor support services for the Navy's Robotic Process Automation program. The base period of performance is from August 3, 2021 to August 2, 2022 with a one-year option. The scope of deliverables will change annually as defined in the PWS. The estimated total value is for the base period and option period. The initial RPA prototype effort was awarded competitively in July 2020 to Accenture Federal Services through a Broad Agency Announcement with proposals received from four companies. As the prototype effort met its technical goals and the terms allow for follow-on production, this sole source follow-on production contract to Accenture is being justified under statutory authority. The point of contact is Nicole Ikena-Miller at the Navy Supply Systems Command.

SOLE SOURCE JUSTIFICATION

Robotic Process Automation (RPA) Program Management Support

1. Identification of Agency and Contracting Activity.

The requiring activity is NAVSUP Business Systems Center (BSC), Mechanicsburg PA; the contracting activity is NAVSUP Fleet Logistics Center (FLC) Norfolk, Contracting Dept., Mechanicsburg Office.

2. Description of the Action Being Approved.

This is a sole source action for the provision of Robotic Process Automation (RPA) Program Management Support services. The RPA Capability Prototype is currently being performed under Other Transaction Agreement (OTA) N683352090005. OTA N683352090005 was awarded as a result of NAVAIR Broad Agency Announcement (BAA) N00421-19-S-0001 on 07 July 2020 on a competitive basis as a firm fixed-price contract to Accenture Federal Services LLC (Accenture), a large business; the existing contract expires on 02 Aug 2021.

3. Description of Supplies/Services.

This sole source action is to secure contractor support services to maintain the existing RPA Governance model and expand RPA capabilities throughout the enterprise. The project will be conducted over a one-year period with one (1) one-year option. The scope of the deliverables will change for each year and has been broken out within the PWS. The estimated total value of this procurement is for the base period and for the option period). The resultant contract will be funded with Navy Working Capital Funds. The base period funds are currently available. The period of performance of the base period is planned to be 03 August 2021 to 02 August 2022, with a one year option.

4. Statutory Authority Permitting Sole Source.

The statutory authority permitting this sole source action is 41 U.S.C. 1901, Simplified acquisition procedures - a sole source acquisition using simplified acquisition procedures for the acquisition of commercial items, as implemented by FAR 13.501(a).

5. Rationale Justifying Use of Cited Statutory Authority.

10 U.S.C. § 2371b(f) “FOLLOW-ON PRODUCTION CONTRACTS OR TRANSACTIONS” states

(1) A transaction entered into under this section for a prototype project may provide for the award of a follow-on production contract or transaction to the participants in the transaction. (2) A follow-on production contract or transaction provided for in a transaction under paragraph (1) may be awarded to the participants in the transaction without the use of competitive procedures, notwithstanding the requirements of [10 U.S.C. § 2304], if— (A) competitive procedures were used for the selection of parties for participation in the transaction; and (B) the participants in the transaction successfully completed the prototype project provided for in the transaction.

Office of the Secretary of Defense Memorandum, Subj: Definitions and Requirements for Other Transactions Under Title 10, United States Code, Section 2371b, 20 November 2018, states:

Those organizations seeking to use the follow-on production authority provided for in subsection 2371b(f) shall apply the following definition for "successful completion." A transaction for a prototype project is complete upon the written determination of the appropriate approving official for the matter in question that efforts conducted under a Prototype OT: (1) met the key technical goals of a project; (2) satisfied success metrics incorporated into the Prototype OT; or (3) accomplished a particularly favorable or unexpected result that justifies the transition to production. Furthermore, successful completion can occur prior to the conclusion of a prototype project to allow the Government to transition any aspect of the prototype project determined to provide utility into production while other aspects of the prototype project have yet to be completed. Any Prototype OT shall contain a provision that sets forth the conditions under which that prototype agreement must be successfully completed.

Efforts conducted under OTA N683352090005 met the key technical goals of the project.

Competitively awarded OTA number N683352090005 contains the following language on pages 23-24:

Potential for Follow-On Production

1. 10 U.S.C. § 2371b(f) authorizes the Department of Defense (DoD) to structure OT prototype agreements with the potential to award a follow-on production contract or transaction to the participants in the transaction, without further competition. In order to do so, two criteria must be met: 1) competitive procedures must be used to select the performer and 2) the participants must have successfully completed the prototype project provided for in the transaction. This award was the result of competitive procedures through NAVAL AIR SYSTEMS COMMAND Digital Group Office-Wide Broad Agency Announcement (BAA) N68335-20-S-0001.

2. In accordance with 10 U.S.C. § 2371b(f), this competitively awarded Agreement may lead to follow-on production activities if the Key Technical Goals, as defined in the SOW, are met; or in the event that a particularly favorable or unexpected result is accomplished that justifies transition to production.

3. The Automation Center of Excellence (CoE) follow-on production

Agreement(s) can scale to provide support to up to all of the Navy Installations within the Continental United States (CONUS) and Outside CONUS (OCONUS). This includes designated geographically separated facilities (owned or leased) and support to uniformed military, Government civilian and Government on-site support contractors at those facilities.

The RPA Program Management Support follow-on production contract may be sole sourced to Accenture in accordance with statutory authority as: 1) the initial OTA was competed, 2) the terms and conditions of the OTA identify that production may follow after the OTA without further competition, and 3) the OTA is on track to be completed successfully.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable, including a Description of Market Research, if applicable, and a List of Interested Sources, if any.

NAVAL AIR SYSTEMS COMMAND Digital Group Office-Wide Broad Agency Announcement (BAA) N68335-20-S-0001 (the solicitation that would result in OTA N683352090005) received 4 proposals form the following vendors: (1) Booz Allen Hamilton on 07-Feburary 2020, (2) KPMG on 03-February 2020, (3) IT Partners, Inc. on 24-February 2020, and (4) Accenture Federal Services LLC on 27-February 2020. After a review of proposals from each vendor, Accenture Federal Services LLC was awarded the contract pilot for the development of a RPA program from NAVSUP.

As the OTA contract was openly competed with offers from multiple vendors and is on track to be successfully completed on time, robust market research was not conducted due to the statutory authority referenced under this OTA contract allowing to award a follow-on production contract.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this Justification will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVSUP has no plans at this time to compete future contacts for the types of RPA supplies/services covered by this document. If another potential source emerges, NAVSUP will assess whether competition for future requirements is feasible.

9. Contracting Point of Contact.

The point of contact at NAVSUP Fleet Logistics Center Norfolk, Mechanicsburg Office, is Nicole Ikena-Miller, Code 216, who may be contacted at DSN 430-5325, commercial (717) 605- 5325 or by e-mail at nicole.ikenamiller@navy.mil.
