Sole Source Justification 28321320Q00000250

The Social Security Administration (SSA) requires subscription renewal of Tone Dyna-Step software. DYNASTEP provides a critical application support function. It allows TSO-based applications to dynamically restructure the program library concatenation to place application code into the TSO session for execution. Many TSO applications depend on DYNASTEP to supplement or reorganize the program libraries to provide access to application and vendor tool support code.

Since DYNASTEP is heavily imbedded in SSA applications and system code, if it is not renewed SSA users one will be able to log on to the ESEF mainframe environments and most software will fail to execute properly. No programmatic changes, maintenance or new work required by law could be performed in the DEV/VAL mainframe environments. If not renewed, the product will have to be removed from hundreds of uses and each instance will have to be re-engineered to perform the same functions without the dynamic restructuring provided by the product.

This software is proprietary. Only Tone Software has access to the source code necessary to provide the required licenses and subscription, which are comprised of updates, upgrades, fixes and telephone support. Market research has indicated there are several authorized resellers.

The basis for this justification is within the authority of the Federal Acquisition Regulation (FAR) Part 13.106-1(b)(1)—“ … Soliciting from a single source. For purchases not exceeding the simplified acquisition threshold. Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).”
