DEPARTMENT OF THE TREASURY
SF 1013 - JUSTIFICATION & APPROVAL FOR FAR SUBPART 13.5 SOLE SOURCE
(INCLUDING BRAND NAME) ACQUISITIONS
Treasury Standard Form – 1013 (Rev 5/18)
Prescribed by Treasury: DTAP 1013.501 Tracking No.
1. Identification of the requiring activity and the contracting activity:
The requiring activity is the Department of Treasury’s Office of the Chief Information Officer (OCIO) and the contracting activity is IRS Procurement 2.a Nature and/or description of the action being approved:
The purpose of this sole source justification is to obtain approval to award a firm fixed price sole source Treasury Enterprise-wide IDIQ with TALX Corporation for the services described in section 3.a below. The need date for these items is 10/1/2020. The period of performance will be for one 12 month base and four twelve month option years. See to requisition number 20PR-SSPDIR-0219 for a copy of the SOW.
2.b Name of the vendor. TALX Corporation 2.c Requisition No.: 20PR-SSPDIR-0219 2.d Bridge contract: ☐ Yes ☒ No 2.e Brand name: ☒ Yes ☐ No
3.a A description of the supplies or services required to meet the agency’s needs:
The proposed acquisition is to establish an IDIQ for Unemployment Compensation services. This includes claims processing, data storage and processing, appeals administration services, and training.
3.b Includes IT: ☒ Yes ☐ No NAICS: 541612 PSC: R431 3.c IGCE/Estimated dollar value:
The IGCE is $3,712,999.03 inclusive of four twelve month option periods. Refer to the IGCE for additional details.
4. Identification of the authority being used (Check the box that applies):
☒ 41 U.S.C. 1901 – Simplified acquisition procedures.
☐ 41 U.S.C. 1903 – Special emergency procurement authority.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
TALX Corporation possess a proprietary claims processing system, developed previously under the prior contract with USDA and that Treasury used for the past 5 years. In addition, the contractor possesses the cleared resources, knowledge, experience, and tools to execute the work without any transition period. Establishing a new contract with a new vendor would require a new interface and infrastructure to be implemented and deployed which would take up additional time and money.
The agency has an urgency to provide these services without any lapse. A lapse in service will create Treasury to be out of compliance with 5 U.S.C. 8506, which requires Federal Agencies to disseminate information to State Agencies regarding compensation of Federal employees.
This acquisition requires the use of 41 USC 1901 Simplified Acquisition Procedures as the services being acquired are defined as commercial items and are not greater than $5M
6. A description of efforts to ensure that offers were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR subpart 5.2 and, if not, which exception under FAR 5.202 applies:
During the market research phase, the program office reached out to all participating bureaus and offices and determined that the only capable source was TALX Corporation due to their product being the only solution that is compatible with an existing interface with the National Finance Center. Treasury confirmed they do not utilize any resellers and the primary product http://www.gpo.gov/fdsys/granule/USCODE-2011-title41/USCODE-2011-title41-subtitleI-divsnB-chap19-sec1901 http://www.gpo.gov/fdsys/granule/USCODE-2011-title41/USCODE-2011-title41-subtitleI-divsnB-chap19-sec1903

required is not on any GWAC. Any public notices that are required will comply with FAR subpart 5.2
7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:
The CO will analyze pricing to ensure that they are in line with historical costs and are fair and reasonable
8. A description of the market research conducted (see FAR part 10) and the results or a statement of the reason market research was not conducted:
Market research was conducted by the Program Office between February 2020 and March 2020. The results of the market research supported the Government’s determination to obtain these services under a sole source basis. Refer to the SF 1010 Market Research Summary Report for specific details.
9.a Any other facts supporting this justification:
The underlying justification supporting this sole source approach is that infrastructure is already in place and an existing interface with the National Finance Center is required to be utilized for all customer agencies for payroll data. TALX Corporation is the only company in the marketplace with an existing interface that is compatible with NFC. Any other vendor would need to build and implement a new interface which would take additional time and money.
9.b Attachments: ☒ Yes ☐ No SOW, Market Research, Acquisition Plan, IGCE
10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition:
11. A statement of the actions, if any, the Requiring Activity or Contracting Activity may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
The Program Office will continue to search the market place for potential sources by holding industry days and publishing acquisition forecasts should the need for such services continue in the future. Treasury will maintain communication with potential vendors that have the capabilities to meet Treasury’s requirements.
